In order to standardize the behavior of early property service charges in ordinary residential quarters and protect the legitimate rights and interests of owners and property service enterprises, the Municipal Development and Reform Commission and the Municipal Housing and Construction Bureau have studied and formulated the benchmark price standard of early property service charges in ordinary residential quarters in Tianshui City according to the State Council's Regulations on Property Management (Revised Edition), Gansu Province's Pricing Catalogue (20 18), Gansu Province's Implementation Measures for Property Service Charges, and other relevant regulations. The relevant matters are listed as follows.
I. Contents and management forms of pre-property services
(a) the prophase realty service refers to the realty service activities implemented by the construction unit before the owners and the owners' congress select realty service enterprises. Where a construction unit selects a property management enterprise, it shall sign a written preliminary property service contract. Newly-built affordable housing and other affordable housing projects (residential areas), property service charges continue to be subject to government-guided price management, which shall be examined and approved by the government price department in accordance with the price management authority.
(2) Pre-property fees refer to the fees charged by property service enterprises to owners or property users for the maintenance, conservation and management of houses and their supporting facilities and related sites, and for maintaining environmental sanitation and order in relevant areas. The Pricing Catalogue of Gansu Province (20 18) stipulates that the early property service charges of ordinary houses shall be managed by government-guided prices.
(3) The charging standard for the preliminary property service of ordinary residential quarters corresponds to the Grade of Property Service of Tianshui Residential Quarters (Provisional Standard). The preliminary property services of ordinary residential quarters are divided into four levels from high to low, with the highest level and the lowest level. The higher the service level, the higher the corresponding property service charge standard.
(four) the early property service charges of ordinary residential quarters shall be subject to unified leadership and hierarchical management. The municipal price department shall, jointly with the property administrative department at the same level, be responsible for formulating the charging standards for pre-property services in ordinary residential areas where the municipal government is located; County (District) price departments in conjunction with the county (District) property administrative departments, in accordance with the management authority, responsible for the development of the administrative area of ordinary residential areas in the early stage of property service charges.
Second, the relevant management requirements
(a) ordinary residential areas in the early stage of the property service charges to implement the "one fee system", according to the property area charges. If the property right certificate has been handled, the construction area recorded in the property right certificate shall prevail; If the property right certificate is not handled, the construction area indicated in the purchase contract shall prevail, and it shall be collected monthly or quarterly with the consent of the owner. The charging standard does not include other water and electricity costs such as public lighting, intelligence and landscape facilities in the property management area, and the secondary energy costs of power equipment such as water supply and heating. The cost is calculated separately by the realty service enterprise, apportioned according to the facts, and published regularly. Property service enterprises shall not force services or charge fees.
(2) The management principles and specific allocation methods of electricity charges for secondary water supply, heating and other electrical equipment shall be implemented according to this document 2.
(III) For the prophase property service charges of ordinary residential quarters, the development and construction unit shall, according to the characteristics, service requirements and service items of the property services, draw up the service level, determine the specific charging standard through bidding or consultation with the property service enterprises within the charging standard range of the corresponding service level, and stipulate in the prophase property service contract that the charging standard shall not be higher than the highest guiding price of the corresponding level, and there is no floating upper limit.
(IV) The owners' assembly or owners' committee directly selects ordinary residential quarters where property service enterprises provide property services, and the charging standards for property services shall be determined by both parties through consultation, and market-oriented management shall be implemented.
(five) property service charges should be clearly marked. The realty service enterprise shall strictly perform the realty service contract, and provide the owners with services that match the quality and price. The name of the service enterprise, service content, service standard, charging standard, charging basis and "123 15" report and complaint telephone number shall be publicized in a prominent position in the property management area, and the owner shall accept the supervision, and shall not charge the owner or the property user any fees that are not marked.
(VI) The market supervision department of the city and county (district) shall, jointly with the property administrative department, strengthen the daily supervision of the preliminary property service charges of ordinary residential quarters, and the property administrative department shall assess the service level of the property service enterprises according to the "Tianshui Residential Quarter Property Service Level (Provisional Standards)", and the assessment results shall be linked to the preliminary property service charge standards, and regularly inform the society.
(seven) ordinary residential area prophase property service charges for the record management. Charge for the record, by the realty service enterprise according to the property service contract signed by the construction unit and the realty service enterprise and the realty service agreement signed by the realty service enterprise and the owner and other relevant information (copy), in accordance with the price management authority to the competent price department at the same level for the record.
Third, the implementation time.
This notice shall be implemented as of the date of issuance. Problems in the implementation process, please promptly report to the Municipal Development and Reform Commission, the Municipal Housing and Urban-Rural Development Bureau. The original Notice of Tianshui Price Bureau and Tianshui Housing Management Bureau on Approving the Charge Standard of Property Management Services in Residential Areas (Non-residential) (Shi Tianchengfa [2008] 13) shall be abolished at the same time.
