Provisions of Xiamen Municipality on the Administration of Building Facade Decoration

Chapter I General Provisions Article 1 In order to strengthen the management of building facade decoration, ensure personal and property safety and beautify the city appearance and environment, these Provisions are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality.

Article 2 These Provisions shall apply to the facade decoration of buildings in this Municipality and its supervision and management activities.

Article 3 The term "building facade decoration activities" as mentioned in these Provisions refers to the activities of using decorative materials to treat the building facade and attaching various equipment, facilities and decorations to the building facade in order to make the building meet certain environmental landscape and use requirements.

The term "building facade" as mentioned in these Provisions includes external protective surfaces and ancillary building components such as building external walls, external doors and windows, balconies, etc.

Fourth building facade decoration should follow the principles of safety, beauty, energy saving and environmental protection.

Fifth city construction administrative departments responsible for the supervision and management of the city building facade decoration. District construction administrative departments are responsible for the supervision and management of building facade decoration within their respective management authority.

Planning, municipal management, urban management administrative law enforcement and other relevant administrative departments. Responsible for the management of building facade decoration within their respective responsibilities.

Sixth to encourage the use of safe, environmentally friendly and energy-saving new technologies, new materials and new processes in building facade decoration.

Chapter II General Provisions Article 7 The facade decoration of a building shall conform to the relevant regulations and standards of planning, construction, fire protection, environmental protection and city appearance. , handle the neighboring relations such as drainage, transportation and lighting, and shall not harm the legitimate rights and interests of neighboring obligees.

Eighth building facade design should meet the necessary contents and needs of building facade decoration. The existing building facade shall not be arbitrarily added with unsafe factors such as the appearance of the building facade, the surrounding environment and the obvious increase of load other than the original design.

Ninth urban and rural planning departments should be in accordance with the relevant provisions, the style and color of building facade decoration as the content of the construction project design review.

When reviewing the construction drawing design documents, the construction drawing review institution shall review the selection of materials, construction technology and installation of additional equipment and facilities for building facade decoration in accordance with these provisions. If the design is not carried out in accordance with the provisions, the construction drawing review institution shall not review the construction drawing design documents.

Tenth construction units and supervision units shall carry out construction and supervision in accordance with the approved construction drawing design documents for building facade decoration; Engineering quality supervision institutions shall specify the relevant supervision contents in the project quality supervision report when conducting engineering quality supervision.

If the construction is not carried out in accordance with these provisions, the construction unit shall not organize the completion and acceptance of the construction project.

Article 11 The person in charge of building facade maintenance and management shall regularly inspect, clean and maintain the building facade, inspect and replace the materials and decorations with shelf life on time, reinforce or dismantle the facade decoration and additional equipment and facilities with potential safety hazards in time, and eliminate potential safety hazards. If the person responsible for the maintenance and management of the building facade entrusts the realty service enterprise to manage it, the relevant rights and obligations shall be clearly defined in the realty service contract.

The person responsible for the maintenance and management of the building facade mentioned in the preceding paragraph refers to the owner and user of the building and its additional equipment and facilities.

Twelfth in case of major celebrations, large-scale activities and other special circumstances, the city needs to beautify the city environment, according to the requirements of the Municipal People's government, the organization of important areas of the building facade cleaning and painting.

Chapter III Exterior Wall Finishing of Buildings Article 13 The exterior wall finishing of buildings shall adopt safe, environmentally-friendly building materials with low reflection coefficient, as well as technical measures and construction techniques to prevent falling off. Encourage the use of high-performance architectural coatings with high weatherability, high stain resistance and high color retention.

Fourteenth building exterior wall decoration materials using stone panels, encourage the use of dry hanging construction technology for construction, restrict the use of cement mortar on-site paste stone panels. If it is really necessary to paste the stone veneer with cement mortar on site, reliable burying measures should be taken, and the height of the stone veneer wall should not exceed 3 meters from the ground.

Fifteenth building external wall height more than 24 meters from the ground area, shall not be used to paste tiles (boards).

In the area where the height of the external wall of the building is not more than 24 meters from the ground, and there are entrances and exits, passages or venues for people's activities under the pasted tiles (boards), protective facilities such as overhangs and ceilings or buffer zones such as green belts and podium houses should be set up.

Settings. The shelter and protection facilities such as overhangs and ceilings shall be no less than1.2m in length and have the strength to resist the impact of falling objects from above; If it is impossible to set shielding protection facilities, the corresponding parts of external wall tiles (boards) should be designed with anti-falling construction technology.

Chapter IV Building Curtain Walls and External Doors and Windows Article 16 The building curtain walls mentioned in these Provisions include glass curtain walls, metal curtain walls, stone curtain walls, wood-based panel curtain walls, composite panel curtain walls and their combinations.

Seventeenth building curtain wall, should be combined with the layout of the building, in its surrounding setting overhangs, ceilings and other protective facilities or green belts, podium and other buffer areas; If there are entrances and exits, passages or people's activity sites under the building curtain wall, shelter and protection facilities shall be set up, the length of which shall not be less than1.2m, and it shall have the strength to resist the impact of falling objects from high places.

Eighteenth building curtain wall construction project completion and acceptance, the construction unit shall provide the construction unit with instructions for the use of building curtain wall; When selling a building with a building curtain wall, the construction unit shall provide the buyer with the instruction manual of the building curtain wall.

The instruction manual of building curtain wall shall specify the design basis, main performance parameters, design service life, warranty obligations of the construction unit, daily inspection, maintenance requirements and matters needing attention in use.

Nineteenth buildings with building curtain walls, the maintenance and management of the building facade should be carried out in accordance with the requirements of the instruction manual of building curtain walls for daily inspection, maintenance and maintenance.

Twentieth commercial centers, transportation hubs, hospitals, schools, cultural and sports venues and other crowded places and buildings facing the street, which need to use more than two layers of glass curtain walls, should use safety glass and take fall prevention measures.

If the glass curtain wall adopts explosive glass such as tempered glass, safety measures such as sticking safety film should be taken.

Twenty-first new buildings using glass curtain walls and metal curtain walls may cause light pollution to the surrounding environment. Low-emissivity coated glass and unpolished metal plates shall be used, and mirror glass, polished metal plates and other materials shall not be used.

Twenty-second building doors and windows should be reliably connected with the main structure, and the fixed nodes should meet the stress requirements under wind load and earthquake load.

Chapter V Additional Equipment and Additional Facilities Article 23 The additional equipment mentioned in these Provisions includes air conditioning equipment, solar energy equipment, air energy equipment and other equipment attached to the facade of buildings; Additional facilities refer to the components set on the building facade for sealing, anti-theft, protection, drying, shading, decoration and installation of additional equipment.

Twenty-fourth additional equipment, additional facilities should be set up to facilitate installation, cleaning, maintenance and local replacement, reliable connection with buildings, in line with safety requirements and in line with relevant city appearance and environmental management regulations.

Twenty-fifth additional equipment and facilities shall not occupy sidewalks, entrances and exits, corridors, stairs and other places for safe evacuation and rescue.

If additional facilities are set along the road, on both sides of the public * * * passage and around the public * * * activity place, the height of the bottom of the additional facilities from the ground shall not be less than 2.5 meters.

Twenty-sixth additional facilities installation surface should be solid, with sufficient bearing capacity. When the strength of the installation surface does not meet the requirements, corresponding reinforcement, support or shock absorption measures should be taken.

Article 27 Newly-built houses and newly-built public buildings that do not use central air-conditioning systems shall be uniformly designed and equipped with seats specially used for installing air-conditioning equipment (hereinafter referred to as air-conditioning equipment seats) and air-conditioning condensate drainage pipes or balcony drainage systems that receive air-conditioning condensate (hereinafter referred to as air-conditioning condensate drainage pipes).

The number and size of air conditioning equipment seats should match the number of rooms and the area of the house.

Twenty-eighth air conditioning equipment has been unified, air conditioning equipment should be installed in the installation position.

If the air-conditioning condensate drain pipe has been set, the air-conditioning condensate should be discharged into the air-conditioning condensate drain pipe. Air conditioning condensate shall not be directly discharged to the exterior wall and outdoor ground of street-facing buildings.

Twenty-ninth new buildings using solar energy, air energy and other additional equipment, the design unit shall design and indicate the installation location of the additional equipment in the design documents, and the construction unit shall carry out the construction in accordance with the design documents.

The design and installation of additional equipment location should consider the installation, maintenance, ventilation, drainage and other contents of the equipment and its impact on the building appearance and surrounding environment.

Thirtieth building facade need to install anti-theft protection facilities, shall not exceed the building exterior wall settings, and meet the relevant fire safety requirements.

Thirty-first new high-rise buildings on both sides of the main and secondary roads in this city, and the balcony on the street side should be designed as a closed form.

If the existing building needs to close the balcony during the transformation, it shall not exceed the railing (pole) setting.

Article 32 The specific requirements for installing air-conditioning equipment, anti-theft protection facilities and other additional equipment, additional facilities and closed balconies on the fa? ades of buildings on both sides of primary and secondary roads and main roads in this Municipality shall be incorporated into the city appearance standards of this Municipality. The owners and users of the additional equipment and facilities of the building facade shall decorate the building facade in accordance with the requirements of the city appearance standard of this Municipality.

Thirty-third management regulations formulated by the owners' congress or temporary management regulations formulated by the development and construction units in the property management area shall uniformly stipulate the installation of air conditioning equipment, anti-theft protection facilities and other additional equipment and facilities and the closure of the balcony.

The municipal construction administrative department shall strengthen the management of building facade decoration, formulate the model text of management statute and temporary management statute, and incorporate the specific requirements of building facade decoration into it.

The realty service enterprise shall supervise the implementation of relevant management regulations and temporary management regulations according to law.

Thirty-fourth balconies, terraces, corridors and other parts of the use of glass guardrails, safety glass should be used, and measures should be taken to prevent the glass from bursting and falling off; Plug-in cantilever glass railings and external glass railings with glass as the main stress component shall not be used.

Thirty-fifth in the balcony, windowsill, the original design of flowerpots, flower beds and other special facilities to place flowerpots and other accessories, should deal with safety, drainage and other issues; Ornaments such as flower pots shall not be placed on balcony railings or outside window sills without special facilities.

Thirty-sixth new construction, renovation and expansion of the building facade pipelines and cabinets should be kept clean and beautiful.

Thirty-seventh landmark buildings, buildings in important areas and other buildings that have a significant impact on the night view of the city shall be designed, constructed and accepted at the same time with the buildings.

The installation of large lamps on the facade of a building should meet the requirements of beauty, neatness and environmental protection, and there are protective measures such as waterproof, fireproof, windproof, leak-proof and explosion-proof to ensure firm installation and safe use.

Chapter VI Punishment Article 38 In any of the following circumstances, the construction administrative department shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of more than 2000 yuan 10000 yuan shall be imposed:

(a) in violation of the provisions of the first paragraph of article fifteenth, the design unit adopts the paste ceramic tile (board);

(two) in violation of the provisions of the second and third paragraphs of article fifteenth and seventeenth, the design unit did not design shelter protection facilities or buffer zones;

(three) in violation of the provisions of the first paragraph of article eighteenth, the construction unit did not hand over the instruction manual of the building curtain wall to the construction unit when the construction project was completed and accepted;

(four) in violation of the provisions of article twenty-ninth, article twenty-seventh, the design unit did not design the installation location and supporting facilities of additional equipment.

Where laws and regulations have other provisions on the administrative punishment prescribed in the preceding paragraph, such provisions shall prevail.

Article 39 If, in violation of the provisions of Article 32 of these Provisions, the owner or user of the additional equipment and facilities of the building facade fails to decorate the building facade according to the standards of urban appearance, the urban management administrative law enforcement department shall handle it in accordance with the relevant provisions of the Regulations of Xiamen Municipality on the Administration of Urban Appearance and Environmental Sanitation.

Article 40 If the owner or user of the additional equipment and facilities of the building facade in the property management area violates the relevant provisions on the decoration of the building facade, the property service enterprise shall immediately stop it, and report it to the urban management administrative law enforcement department in time, and the urban management administrative law enforcement department shall handle it according to law.

Forty-first construction administrative departments and other relevant administrative departments staff dereliction of duty, abuse of power, corruption, shall be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter VII Supplementary Provisions Article 42 Where there are other provisions in laws and regulations on the decoration activities of buildings, historical buildings and facades of ancient buildings under cultural relics protection, those provisions shall prevail.

These Provisions shall not apply to the decoration activities of the facade of military projects, secret facilities projects and self-built houses in rural areas.

Article 43 These Provisions shall come into force on April 20 13 1 day. The Interim Provisions on the Management of Exterior Wall Decoration in Xiamen issued by Decree No.78 of Xiamen Municipal People's Government199910.72012 issued on March 8, revised by Decree No.48 of Xiamen Municipal People's Government shall be abolished at the same time.
