Conditions and legal basis for changing property companies

The conditions for changing the property company are:

2. The agreement is terminated. When it is necessary to change the realty service enterprise due to the reasons stipulated in the realty management entrustment contract, it can be directly carried out by the owners' committee according to the stipulations of the realty management entrustment contract, or it can be terminated with the realty service enterprise after specific operations according to the complaints of the owners or users of the property.

What is the procedure for changing a property company?

1. Convene the owners' meeting and vote, and obtain the consent of more than two thirds of the owners;

2. Notify the property company in writing 60 days in advance to handle the dismissal procedures;

3, formulate management requirements and cost standards, open property bidding;

4. Open bid evaluation and sign a property management agreement;

5. Arrange the handover of new and old property companies, and the new property company will enter the site.

Legal basis: Article 946th of the Civil Code of People's Republic of China (PRC).

If the owner decides to dismiss the property service provider according to legal procedures, the property service contract may be terminated. If it decides to dismiss, it shall notify the property service provider in writing 60 days in advance, unless the notice period is otherwise stipulated in the contract.

If the termination of the contract in accordance with the provisions of the preceding paragraph causes losses to the property service provider, the owner shall compensate for the losses, except for reasons not attributable to the owner.
