The Regulations of Dalian Municipality on Property Management came into effect on June 2009 10. Below I have compiled the full text of the regulations for you, hoping to help you.

Chapter I General Provisions

Article 1 These Measures are formulated for the purpose of implementing the Regulations of the State Council Municipality on Property Management and combining with the actual situation of this Municipality.

Article 2 These Measures shall apply to the activities of hiring property service enterprises by the owners within the administrative area of Dalian. The owners and the property service enterprises shall, in accordance with the stipulations of the property service contract, repair, conserve and manage the houses, supporting facilities and related sites, and maintain the environmental sanitation and related order in the property management area.

Third city and county (city) district real estate administrative departments responsible for the supervision and management of property management activities within their respective administrative areas.

The Management Committee of Dalian Economic and Technological Development Zone and other agencies of the Municipal People's Government are responsible for the supervision and management of property management activities within the management scope.

Price, civil affairs, industry and commerce, construction, urban construction, urban and rural planning, public security and other administrative departments shall be responsible for the related work of property management activities according to their respective responsibilities.

Neighborhood offices and Township People's governments shall coordinate the relationship between property management and community construction, and assist the real estate administrative departments to supervise and manage property management activities. The residents' committee shall perform its duties according to law, and support and guide the daily work of the owners' committee.

Fourth to encourage the establishment of property services industry associations in accordance with the law. Property service industry associations should strengthen industry guidance and self-discipline, standardize business practices, train employees, mediate internal disputes in the industry, safeguard the legitimate rights and interests of members, and promote the healthy development of the industry.

Chapter II Owners and Owners' Congress

Article 5 The owner of a house is the owner.

Owners enjoy the following rights in property management activities:

(a) in accordance with the provisions of the realty service contract, accept the services provided by the realty service enterprise;

(two) proposed to convene a meeting of the owners' congress, and put forward suggestions on matters related to property management;

(three) put forward suggestions on formulating and amending the management statute and the rules of procedure of the owners' congress;

(four) to participate in the owners' meeting and exercise the right to vote;

(five) to elect members of the owners' committee and enjoy the right to be elected;

(six) to supervise the work of the owners' committee;

(seven) to supervise the realty service enterprise to perform the realty service contract;

(eight) the right to know and supervise the use of * * * parts of the property, * * facilities and equipment and related sites;

(nine) to supervise the management and use of special maintenance funds for * * * parts of the property and * * * facilities and equipment (hereinafter referred to as special maintenance funds);

(ten) other rights stipulated by laws, regulations and rules.

Article 6 Owners shall perform the following obligations in property management activities:

(a) abide by the management regulations, the rules of procedure of the owners' congress, and perform the property service contract;

(two) abide by the rules and regulations of the use of * * * parts and facilities, the maintenance of public order and environmental sanitation in the property management area;

(three) to implement the decisions of the owners' congress and the decisions of the owners' committee authorized by the owners' congress;

(four) in accordance with the relevant provisions of the state to pay special maintenance funds;

(five) to pay the property service fee on time;

(six) to participate in the owners' meeting and abide by the meeting procedures;

(seven) to provide detailed and accurate contact information to the property service enterprises;

(eight) to accept the supervision of the owners' congress and the owners' committee on their performance of the obligations of the owners;

(nine) other obligations stipulated by laws, regulations and rules.

Article 7 The following matters shall be decided by the Owner:

(a) to formulate and amend the rules of procedure of the owners' congress;

(2) Formulating and amending management regulations;

(three) to elect the owners' committee or replace the members of the owners' committee;

(four) the selection and dismissal of property services companies;

(five) to raise and use special maintenance funds;

(six) the renovation of buildings and their ancillary facilities;

(seven) other major matters related to the management of * * * and * * *.

To decide the matters specified in items (5) and (6) of the preceding paragraph, it shall be agreed by the owners whose exclusive parts account for more than two thirds of the total building area and more than two thirds of the total number of owners; Decisions on other matters specified in the preceding paragraph shall be subject to the consent of the owners whose exclusive parts account for more than half of the total building area and more than half of the total number of people.

Eighth new property projects, including phased construction and development and construction of multiple units, whose supporting facilities, equipment and related sites are used by * * * *, shall be divided into a property management area. However, if the property project is large in scale and is separated or closed by municipal roads, it can be divided into several independent property management areas.

The property management area of new property projects shall be delineated by the competent department of urban and rural planning on the detailed planning map.

Ninth owners in the same property management area shall set up owners' meeting according to law.

If the exclusive part of the house actually delivered accounts for more than 50% of the total construction area, the owners' meeting may be established.

Article 10 If the property management area meets the conditions for the establishment of the owners' meeting and is ready to establish the owners' meeting, the construction unit (public housing selling unit) shall submit a written report on the establishment of the first owners' meeting to the real estate administrative department of the county (city) where the property is located within 30 days, and provide the details of the property sale and the owner's occupancy, the basic information of the property and other materials.

The real estate administrative department shall, within 30 working days from the date of receiving the report, guide the establishment of the preparatory group for the owners' meeting in conjunction with the sub-district office or the township people's government. The preparatory group consists of three representatives of the owners, one representative of the sub-district office or township people's government and the construction unit (public housing sale unit), and five representatives. Among them, the owners' representatives are elected by the owners or under the guidance of sub-district offices and township people's governments. After the list of members of the preparatory group is confirmed, a written announcement will be made in the property management area.

If the construction unit (public housing sale unit) fails to submit the report of the first owners' meeting, it may submit the report of the first owners' meeting in writing to the county (city) district real estate administrative department where the property is located upon the proposal of more than 20% owners. In line with the conditions, the real estate administrative department shall, in accordance with the provisions of the preceding paragraph, guide the formation of the preparatory group for the owners' meeting, and the construction unit (public housing sale unit) shall provide the details of the property sale and the owner's occupancy, the basic information of the property and other materials.

The expenses for preparing for the establishment of the first owners' meeting shall be borne by the owners and construction units (public housing sales units) according to their own construction areas.
