Encourage property management to adopt new technologies and methods, and improve management and service level by relying on scientific and technological progress. Article 5 Xi real estate administrative department is the administrative department in charge of property management in this Municipality, and is responsible for the supervision and management of property management activities in this Municipality.
Outside the six districts of Xincheng, Beilin, Lianhu, Yanta, Weiyang and Baqiao, the district and county real estate administrative departments are the administrative departments in charge of property management in this district and county, and are responsible for the supervision and management of property management activities within their respective jurisdictions.
The administrative departments of construction, planning, municipal administration, civil affairs, gardens, public security, prices, industry and commerce shall cooperate in management according to their respective responsibilities. Chapter II Owners and Owners' Congress Article 6 The owner of a house is the owner.
The owners' rights and obligations in property management activities shall be implemented in accordance with the relevant provisions of the "Regulations on Property Management" of the State Council. Seventh owners' meeting is composed of all owners in the property management area, and a property management area establishes an owners' meeting; However, if there is only one owner, or if the number of owners is small and all owners agree unanimously, it is decided not to set up the owners' meeting, and the owners will jointly perform the duties of the owners' meeting and the owners' committee.
The voting right of the owners at the first owners' meeting is determined according to the building area of the property owned by the owners, the number of residential units and other factors. Residential housing is a set of one vote; For non-residential houses, according to the construction area, there is one vote for those below 100 square meters, and one vote for every 100 square meters above 100 square meters (if less than 100 square meters, it shall be rounded off). The voting rights held by a single owner at the first owners' meeting shall not exceed 30% of all voting rights. The property right of the house is * * *, and the property owner elects a representative to exercise the right to vote. Eighth meet one of the following conditions, the owners' meeting shall be established:
(a) in the property management area, the construction area of commercial housing sold and delivered exceeds 50%, or the first set of commercial housing has been sold and delivered for more than two years;
(two) public housing has legal property management conditions and the sale rate has reached more than 50%. Ninth owners to prepare for the establishment of the owners' meeting, should be under the guidance of the administrative department of property management, by the owners' representatives, construction units, public housing sales units to form a preparatory group for the owners' meeting, responsible for the preparations for the owners' meeting.
After the list of members of the preparatory group for the owners' meeting is confirmed, it will be published in writing in the property management area. The announcement time is not less than 7 days. Tenth owners of the preparatory group shall perform the following duties:
(a) to determine the time, place, form and content of the first owners' meeting;
(two) put forward the draft rules of procedure of the owners' congress and the draft owners' convention;
(three) to register and confirm the identity of the owners and verify the number of voting rights of the owners at the first meeting of the owners' general assembly;
(four) put forward the draft method for the members of the owners' committee;
(five) other preparations for the first owners' meeting. Eleventh owners of the preparatory group shall, within 30 days from the date of its establishment, under the guidance of the administrative department of property management, organize the owners to hold the first owners' meeting.
The preparatory group of the owners' meeting shall announce the relevant contents of the owners' meeting in the property management area before the first meeting of the owners' meeting 15. Twelfth meetings of the owners' congress shall be held regularly in accordance with the rules of procedure of the owners' congress. Upon the proposal of the owners above 1/5, the owners' committee shall organize an interim meeting of the owners' meeting. Thirteenth owners' congress in the property management activities within the property management area, represent and safeguard the legitimate rights and interests of all owners, and perform the following duties:
(1) Electing and replacing members of the owners' committee and supervising the work of the owners' committee;
(two) to formulate and amend the owners' convention and the rules of procedure of the owners' congress;
(three) the selection and dismissal of property management companies;
(four) to listen to and consider the work report and financial report of the owners' committee;
(five) to formulate and modify the use system of * * * parts and * * * facilities and equipment in the property management area, and maintain public order and environmental sanitation;
(six) to decide on the use and renewal of special maintenance funds, and supervise the implementation;
(seven) to change or cancel the inappropriate decisions of the owners' committee;
(eight) to decide on the way to bear the working expenses of the owners' congress and the owners' committee;
(nine) other duties related to property management as stipulated by laws, regulations or the rules of procedure of the owners' congress. Article 14 The owners' committee shall be elected by the owners' congress from among the owners. The owners' committee consists of five to nine members, and the director and deputy director are elected from among the members of the owners' committee. The term of office of the owners' committee shall be decided by the owners' congress.
Members of the owners' committee shall be conscientious, responsible, impartial, law-abiding, enthusiastic about public welfare undertakings, and have certain working ability and working hours.
The owners' congress shall announce the list of elected members of the owners' committee in a prominent position in the property management area.
