Regulations of Zhuhai Municipality on Property Management of Residential Quarters
Sporadic residential development can be incorporated into residential areas, and the specific measures shall be formulated by the Zhuhai Municipal People's Government (hereinafter referred to as the municipal government).
The term "property" as mentioned in these Regulations refers to all kinds of buildings in residential areas and their supporting public facilities, safety facilities and public venues.
The term "owners" as mentioned in these Regulations refers to the owners of properties in residential areas. Non-owners can enjoy the rights of owners and undertake corresponding obligations according to the entrustment of owners.
The term "property management" as mentioned in these Regulations refers to the daily maintenance, repair and renewal of the property entrusted by the owners, as well as the daily management of greening, traffic, public security, environmental sanitation and other projects in residential areas.
The term "property management company" as mentioned in these Regulations refers to an enterprise with corresponding qualifications, registered by the administrative department for industry and commerce and engaged in the service business of residential quarters. Article 4 Public facilities, safety facilities and public venues in residential areas shall be used and maintained by all owners. Fifth owners have the right to manage residential quarters and the obligation to abide by the owners' convention and other systems of residential quarters. Article 6 Property management shall be based on the principle of combining owner autonomy with professional services, territorial management with industry management, and gradually implement socialized, professional and operational management. Seventh city housing management department is the competent department of residential property management in this city, responsible for the guidance, supervision and industry management of residential property management in this city.
The administrative departments of construction, planning, environmental protection, public security, transportation, industry and commerce shall be responsible for the management of residential property according to their respective responsibilities.
Sub-district offices are responsible for the management of residential areas in accordance with their duties. Chapter II Handover and Management of Residential Quarters Article 8 If a residential quarter passes the acceptance test, the development and construction unit shall go through the handover formalities with the owners' committee of the residential quarter on the strength of the comprehensive acceptance certificate of the residential quarter and report it to the municipal housing management department for the record; If the owners' committee is not established, the development and construction unit shall handle the transfer formalities with the housing management department on the strength of the Comprehensive Acceptance Certificate of Residential Quarters.
If the residential area has gone through the handover procedures, the owners' committee and the property management company shall sign the "Property Entrustment Management Contract"; If the owners' committee is not established, the housing management department and the property management company shall sign the "Property Entrustment Management Contract".
The owners' committee may, under the guidance of the housing management department, select a property management company through bidding. Ninth development and construction units in the transfer of residential areas, residential areas should be handed over to the comprehensive inspection files. Tenth development and construction units in the transfer of residential areas, should be a certain proportion of one-time payment of special funds for public facilities in residential areas to the city housing management department; The special fund belongs to all the owners, and the housing management department sets up a special account with the residential area as the unit, which is earmarked for special purposes, and accepts the supervision of the financial department.
Measures for raising and using the special fund for public facilities in residential quarters shall be formulated by the municipal government. Eleventh development and construction units in the transfer of residential areas, should be in accordance with the provisions of the municipal government to provide residential management special housing and commercial housing. Special rooms and commercial houses are supervised by the housing management department. Twelfth development and construction units within two years from the date of handling the transfer procedures of residential quarters, have the responsibility to assist in the property management of residential quarters. Chapter III Owners' Congress and Owners' Committee Article 13 Owners shall set up owners' congresses or owners' representative meetings in residential quarters. The owners' meeting is composed of all the owners of the residential area, and the owners' representative meeting is composed of representatives elected by all the owners of the residential area.
Owners' congress or owners' representative meeting is the institution where owners exercise property management rights. Fourteenth owners' congress or owners' representative will exercise the following rights:
(a) elected by the owners' committee;
(two) to approve the articles of association of the owners' committee;
(3) adopting or amending the owners' convention;
(four) to supervise the work of the owners' committee;
(five) to supervise the property management company to do a good job in management;
(six) to decide on major issues of residential property management. Fifteenth articles of association of the owners' committee and the model text of the owners' convention shall be formulated by the municipal housing management department. Sixteenth residential occupancy rate has reached more than 50%, the development and construction unit shall be responsible for convening the first owners' meeting or owners' congress under the guidance of the housing management department. After the establishment of the owners' committee, the owners' assembly or owners' representative meeting shall be held at least once a year. Article 17 When the owners' committee holds a meeting, it may invite relevant personnel and owners' representatives from relevant government departments, sub-district offices, residents' committees, property management enterprises and other units to attend the meeting as nonvoting delegates.
