Xi city housing use safety management regulations

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with relevant laws and regulations and in the light of the actual situation of this Municipality, in order to strengthen the management of housing use safety and ensure the safety of people's lives and property. Article 2 The term "house use safety management" as mentioned in these Regulations refers to the house structure safety management, house safety appraisal management and dangerous house prevention management. Article 3 These Regulations shall apply to the use safety management of urban houses and houses on state-owned land in suburban areas within the administrative area of this Municipality.

The safety management of housing use of military, religious and cultural relics protection units shall be implemented in accordance with relevant state regulations. Fourth housing use safety management should follow the principles of rational use, regular inspection, prevention first and ensuring safety. Article 5 The municipal housing administrative department is the competent department in charge of the safety management of urban housing use in this Municipality.

The housing administrative departments of Yanliang, Lintong, Chang 'an District and the counties under the jurisdiction of the city shall be responsible for the safety management of urban housing use within their respective jurisdictions in accordance with the prescribed duties.

The administrative departments of planning, construction, municipal administration, public security, fire protection and safety production supervision shall, according to their respective responsibilities, coordinate in the safety management of housing use. Sixth housing administrative departments should strengthen the supervision and inspection of housing use safety, and establish and improve various systems of housing use safety management according to law.

The housing administrative department shall promptly investigate and deal with the report and reflection of acts that endanger the safety of houses or houses with major security risks, and reply the results to the informants or reflect people. Chapter II Safety Management of Building Structures Article 7 The owners and users of houses shall rationally use the houses according to their designed structures and uses, so as to ensure the safe use of the houses. Eighth in the process of housing use, prohibit the following acts endangering the safety of housing structure:

(a) demolition, destruction of load-bearing walls, beams, plates, piers, columns and other structures;

(two) in the floor or balcony to increase the load beyond the standard;

(three) the installation of facilities and equipment that affect the structural safety of the house;

(four) other acts endangering the safety of building structures. Ninth in the process of building use, it is necessary to excavate the wall or floor, add structures to increase the load, and change the use function, which may affect the structural safety of the building. The building owner and user shall handle it in accordance with the following provisions:

(a) the implementation of property management, solicit the written opinions of the property management companies in advance;

(two) the commercial housing that has been sold without property management shall solicit the opinions of the selling unit in writing in advance;

(three) the use of public housing and housing units run by themselves, solicit written opinions from the housing property unit in advance;

(four) the use of other houses, prior written consultation with the housing administrative department where the house is located.

Property management companies, housing units for sale, housing property units and housing administrative departments shall conduct on-site investigation within 3 working days after receiving the comments, and put forward opinions on whether it will affect the structural safety of houses; Property management companies, selling units, housing property units, housing administrative departments that affect the safety of housing structure, housing owners, users are not allowed to build. Article 10 In case of any of the following situations endangering the structural safety of a house, the house management department shall immediately organize and guide the house owners, users and property management enterprises to take safety precautions:

(1) Suffering from natural disasters such as rainstorm, flood, earthquake, landslide, ground subsidence and ground fissures;

(2) Damaged by explosion or fire;

(three) there are other major security risks. Eleventh housing administrative departments shall regularly organize relevant departments to conduct general surveys or spot checks on the housing safety of schools, kindergartens, nursing homes, hospitals and other key units and public places such as shopping malls, theaters and so on.

Property management enterprises and housing property units shall conduct safety inspection and maintenance of houses and their accessories, make records of house safety inspection, and establish archives of house safety management. Chapter III Management of Housing Safety Appraisal Article 12 Housing safety appraisal refers to the appraisal and judgment of housing use safety. The appraisal conclusion made by the housing safety appraisal institution is the basis for determining the housing safety status. Thirteenth housing owners, users to the local appraisal institutions to apply for appraisal, must hold legal documents to prove that they have relevant civil rights. Fourteenth in any of the following circumstances, the owner, user or construction unit shall apply for housing safety appraisal:

(a) change the housing structure;

(two) the construction and production may affect the safety of the surrounding houses;

(three) the house continues to be used beyond the prescribed service life;

(4) Other circumstances that may endanger public safety.

If the owner, user or construction unit fails to apply for housing safety appraisal in accordance with the provisions of the preceding paragraph, the housing administrative department shall notify him to apply within a time limit; If the application is not made within the time limit, the housing administrative department shall designate a housing safety appraisal institution for appraisal, and the appraisal fee shall be borne by the responsible person determined by the housing administrative department. Article 15 Housing safety appraisal institutions must have the qualification of Grade B or above in housing construction engineering design, and housing safety appraisers must obtain corresponding qualifications, and the housing safety appraisal business undertaken must adapt to their qualifications and qualifications.
