3. Can the property management fee be increased at will?
1. The standard of property management fee shall be implemented in accordance with the provisions of the property management contract or the commercial housing sales contract. Developers and property management companies are not allowed to raise prices unilaterally unless the government adjusts prices. Both parties shall implement the property management fee according to the standards agreed in the property management contract. If one party changes it without authorization, it shall bear the liability for breach of contract: it can be mediated by the price department or settled through arbitration or litigation.
2. An important prerequisite for increasing property fees. Property companies can raise property fees within a reasonable range, but there is an important premise, which is to obtain the consent of the owners. There is an important premise for property companies to adjust property fees, that is, the premise for property service companies to increase property fees is to accept the entrustment of owners. In other words, the price increase of property fees must be approved by the owners. According to the regulations, the property fees of residential areas where owners' committees have been established shall be agreed by both parties. Property requirements for price increases must be approved by the owners who account for more than half of the total construction area and more than half of the total number.
