Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of owners, property users and property service enterprises, improve people's living and working environment, create a social governance pattern of * * * * buildings, and constantly meet people's growing needs for a better life, according to the Property Law of People's Republic of China (PRC) and the Property Management Regulations of the State Council and Hubei Province Article 2 These Regulations are applicable to property management and its supervision and management within the administrative area of this Municipality.

The term "property management" as mentioned in these Regulations refers to the maintenance, conservation and management of houses and their supporting facilities, equipment and related sites by the owners themselves or by employing property service enterprises, and the activities of maintaining environmental sanitation and order in the property management area. Article 3 Property management shall follow the principle of combining the owner's autonomy under the leadership of the China Communist Party with the government's supervision according to law. Article 4 The municipal and district people's governments (including the administrative committees of development zones and scenic spots, the same below) shall incorporate property management into the development planning of modern service industry, community construction planning and social governance system, adhere to the combination of autonomy, rule of law and rule of virtue, establish a comprehensive coordination mechanism for property management, improve the property management mechanism combining public welfare with marketization, promote property management through the construction of grassroots party organizations, and promote the integration of property management into urban grassroots social governance. The competent civil affairs department is responsible for guiding, supervising and assessing the neighborhood offices, township people's governments and neighborhood (village) committees to perform relevant duties in the establishment of the owners' congress and the election of the owners' committee.

Urban and rural planning, land, construction, public security, urban management, price, environmental protection, water affairs, industry and commerce administration, gardens, forestry and other departments shall be responsible for the supervision and management of property management activities according to their respective responsibilities. Article 6 Sub-district offices and Township People's governments shall, under the leadership of Party organizations at the same level and civil affairs departments at higher levels, organize and guide the owners within their respective jurisdictions to set up owners' congresses and elect owners' committees according to law, supervise the owners' congresses and owners' committees to perform their duties according to law, coordinate the relationship between property management and community management and community service, and mediate property management disputes.

Neighborhood (village) committees shall assist neighborhood offices and township people's governments in doing a good job in property management.

Property management should be included in the assessment content of spiritual civilization construction at the grassroots level. Seventh street offices and Township People's governments shall establish a joint meeting system of property management. The joint meeting was convened by the sub-district offices and township people's governments, and representatives of housing management, public security, civil affairs, urban management, judicial administration and neighborhood (village) committees, people's mediation organizations, owners' committees, property service enterprises and professional business units participated. , specifically solve the problems that need to be coordinated in property management and its supervision and management activities.

Street offices, township people's governments and housing management, public security, civil affairs and other departments shall establish and improve the information sharing mechanism and inform each other of property management information. Eighth neighborhood (village) committees, owners' committees and property service enterprises shall establish and improve the coordination and linkage mechanism of property management under the leadership of community party organizations. Article 9 Property management industry associations shall formulate property service norms and grade standards, promote the standardization of property services, establish and improve the self-discipline system of property service enterprises and their employees, carry out evaluation of property management demonstration projects and training of employees, mediate disputes among property service enterprises, and assist the housing management department in managing credit information. Chapter II Newly-built Property and Pre-property Management Article 10 Before obtaining the pre-sale permit or filing, the construction unit shall divide the property management areas according to the scope of the red line determined in the land planning permit for construction projects, combined with the facilities and equipment used by the property, building scale, community construction and other factors, and report to the district housing management department for filing in accordance with the following provisions:

(a) the supporting facilities and equipment of the property shall be divided into a property management area; However, if the scale is too large, it is not easy to manage by dividing it into one property management area, or it has been divided into several natural blocks or closed communities, and its supporting facilities and equipment can be divided into independent property management areas;

(two) projects built by stages or projects developed and built by two or more units, and the supporting facilities and equipment have been used, can be divided into a property management area;

(3) The completed projects with relatively complete and concentrated supporting facilities can be divided into a property management area.

The competent department of urban and rural planning shall, when reviewing the planning and design scheme of construction projects, make overall consideration of the impact of project staging and supporting facilities and equipment on property use and management. Article 11 The construction unit shall publicize the detailed distribution map of the property management area registered in a prominent position in the property management area, as well as the configuration and construction standards of the * * * used parts, * * used facilities and equipment, and make it clear in the house sales contract.

The filed property management area shall not be adjusted without authorization; Need to be adjusted, in accordance with the relevant provisions of the "Regulations" of Hubei Province on the management of property services. Twelfth new property, the construction unit shall, in accordance with the provisions of the free allocation of property services. Property service rooms belong to all owners, and no unit or individual may change their use without authorization.

Housing allocated for property services should be relatively concentrated, which is convenient for the implementation of property management. The construction area should not be less than two thousandths of the total construction area of the property and not less than one hundred square meters. The office space of the owners' committee shall be arranged from the property service space, and its construction area shall not be less than 20 square meters.

Property service rooms should have basic functions such as water supply, power supply, communication, lighting and ventilation, and office conditions, be equipped with independent and qualified metering devices such as water and electricity, and have the conditions for registration of real estate ownership.

The competent department of urban and rural planning shall, when implementing the construction project planning permit, review the design of the realty service house in accordance with the prescribed standards, specify the construction area of the realty service house in the construction project planning permit, and indicate its specific location in the attached drawings.

When the housing management department implements the housing sales license, it shall check the property service places.
