Regulations of Ningbo Municipality on the Administration of City Appearance and Environmental Sanitation (20 13)

Chapter I General Provisions Article 1 In order to strengthen the management of city appearance and environmental sanitation, create a clean, beautiful and civilized city environment, and ensure people's health, these Regulations are formulated in accordance with the Regulations of the State Council Municipality on the Administration of City Appearance and Environmental Sanitation, the Regulations of Zhejiang Province on the Administration of City Appearance and Environmental Sanitation and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to urban built-up areas within the administrative area of this Municipality, economic development zones, industrial parks, tourist attractions outside the built-up areas, and other areas determined by the municipal and county (city) people's governments to implement urbanization management. Third city appearance and environmental sanitation work, adhere to the principles of unified leadership, hierarchical management, departmental cooperation, public participation and social supervision, and implement scientific, standardized and convenient management. Article 4 The people's governments of cities and counties (cities) shall strengthen their leadership over the work of city appearance and environmental sanitation, strengthen the infrastructure construction of city appearance and environmental sanitation, improve the management system of city appearance and environmental sanitation, and improve the service capacity and equalization level of city appearance and environmental sanitation. Fifth City Urban Management Bureau is the competent department of city appearance and environmental sanitation, responsible for the management of city appearance and environmental sanitation. The Municipal Urban Management Bureau may entrust the city appearance and environmental sanitation management institution to be specifically responsible for the city appearance and environmental sanitation management.

County (city) district city appearance and environmental sanitation department is responsible for the management of city appearance and environmental sanitation in this administrative region. The city appearance and environmental sanitation management responsibilities of economic development zones, industrial parks, tourist attractions and scenic spots shall be implemented in accordance with relevant local laws and regulations.

Street offices and town people's governments are responsible for the management of city appearance and environmental sanitation within their respective jurisdictions.

Planning, industry and commerce administration, health, environmental protection and other departments shall, according to their respective responsibilities, do a good job in the management of city appearance and environmental sanitation. Article 6 Unless otherwise provided for in these Regulations, the administrative punishment stipulated in these Regulations and the administrative coercive power related to administrative punishment shall be implemented by the competent department of city appearance and environmental sanitation.

In areas where the power of administrative punishment in urban management is relatively concentrated, the administrative punishment stipulated in these regulations and the administrative coercion related to administrative punishment shall be implemented by the administrative law enforcement department of urban management according to law. Seventh city, county (city) city appearance and environmental sanitation department shall, jointly with the planning department, according to the requirements of the overall urban planning, prepare a special plan for city appearance and environmental sanitation facilities, and report it to the people's government at the same level for approval before promulgation and implementation. Article 8 The competent department of city appearance and environmental sanitation shall, jointly with the planning departments and other departments, formulate the standards of city appearance in their respective administrative areas according to the national standards of city appearance, and report them to the people's government at the corresponding level for approval before promulgation and implementation.

Urban appearance standards include the appearance requirements of architectural landscape, public facilities, roads, landscaping, advertising signs, shop name signs, public places, waters, residential areas and so on. Article 9 The competent department of city appearance and environmental sanitation, the departments of press and publication, education and health, culture, radio and television, and the business units or management units in public places such as airports, stations, docks and tourist attractions shall strengthen the publicity and education of city appearance and environmental sanitation laws and regulations and scientific knowledge, and enhance citizens' awareness of maintaining city appearance and environmental sanitation.

Broadcasting, television, newspapers and other news media and publicity columns (columns) in public places should arrange public welfare publicity content in the aspect of city appearance and environmental sanitation. Article 10 All units and individuals have the right to enjoy a clean and beautiful city appearance and environment, and have the obligation to maintain a clean and tidy city appearance and environment, and have the right to dissuade, complain and report acts that damage the city appearance and environmental sanitation facilities.

All units and individuals shall respect the environmental sanitation workers and their labor, and shall not hinder or obstruct their normal operation.

The competent department of city appearance and environmental sanitation may employ voluntary supervisors of city appearance and environmental sanitation among citizens to assist in publicity and education and correct illegal acts. Eleventh to promote and encourage community residents' committees to organize residents to formulate conventions for the maintenance of city appearance and environmental sanitation, mobilize residents to actively participate in the management of city appearance and environmental sanitation, and create a clean, beautiful and civilized community. Chapter II Responsibility of City Appearance and Environmental Sanitation Article 12 This Municipality implements the management system of the city appearance and environmental sanitation responsibility area. The relevant units and individuals shall do a good job in the city appearance and environmental sanitation work in the area of responsibility.

The area of responsibility for city appearance and environmental sanitation refers to buildings, structures, facilities and places owned, used or managed by relevant units and individuals within a certain range and their areas. Thirteenth city appearance and environmental sanitation departments to organize the implementation of city appearance and environmental sanitation responsibility area management system, the implementation of city appearance and environmental sanitation work, responsible for the supervision and inspection of city appearance and environmental sanitation.

The person in charge of city appearance and environmental sanitation is responsible for the city appearance and environmental sanitation work in the responsible area. Article 14 The owner of buildings, structures or other facilities and places is the person responsible for city appearance and environmental sanitation. Where the owner, user and manager have an agreement on management responsibilities, such agreement shall prevail.

The person responsible for city appearance and environmental sanitation in the following areas shall be determined in accordance with the following provisions:

(a) public areas such as urban roads, bridges, public toilets, etc., shall be responsible for the management of city appearance and environmental sanitation;

(two) rail transit, tunnels, underpasses, highways and railways shall be the responsibility of the business units or management units;

(three) cultural and entertainment venues, stadiums, tourist attractions, parks, green spaces, squares, airports, stations, docks and other public places, by the business units or management units;

(four) the waters of rivers, lakes and rivers shall be in the charge of the management unit;

(five) all kinds of markets, commercial squares, shops, supermarkets, hotels, restaurants, exhibitions and other places, by the business units or management units;

(six) the residential quarters that employ property service enterprises shall be responsible for the property service enterprises entrusted by the owners;

(seven) residential areas that have not hired property service enterprises shall be responsible for the professional service units of city appearance and environmental sanitation determined by sub-district offices, town people's governments or county (city) district people's governments;

(eight) the back streets and alleys outside the red line of residential planning are in charge of the city appearance and environmental sanitation management institution or the subdistrict office and the town people's government;

(nine) the management area of organs, military units, institutions, social organizations, enterprises and individual industrial and commercial households shall be in charge of this unit;

(ten) the construction site is the responsibility of the construction unit, and the land to be built is the responsibility of the property right unit;

(eleven) newsstands, telephone booths, bus shelters, outdoor advertising and other facilities and overhead pipelines, by the property unit or management unit;

(twelve) septic tanks, septic tanks, the property unit is responsible for; If the property right is unclear, the city appearance and environmental sanitation management institution or the property service enterprise shall be responsible for it.

If the responsible area and person are not clear, it shall be determined by the local city appearance and environmental sanitation administrative department or the town people's government; Cross-administrative areas shall be determined by the administrative department of city appearance and environmental sanitation at the next higher level.
