Measures of Ningxia Hui Autonomous Region on property management of urban residential quarters

Chapter I General Provisions Article 1 In order to strengthen the property management of urban residential quarters, standardize the use, maintenance and other management activities of residential properties, safeguard the legitimate rights and interests of owners, users and property management enterprises, and create a good living environment for residents, these measures are formulated in accordance with the relevant provisions of national laws and regulations and combined with the actual situation of our district. Article 2 These Measures shall apply to the property management of urban residential quarters within the administrative area of this Autonomous Region. Article 3 The term "city" as mentioned in these Measures refers to the towns established by the state according to the administrative system.

The term "residential property" as mentioned in these Measures refers to houses and related public facilities.

The term "property owner" as mentioned in these Measures refers to the owner of the property.

The term "user" as mentioned in these Measures refers to the lessee of the property and other people who actually use the property.

The term "property management enterprise" as mentioned in these Measures refers to the enterprise that accepts the entrustment of the residential property management committee and provides professional management services according to the property management service contract. Fourth autonomous region construction administrative departments in charge of the city's residential property management, responsible for organizing the implementation of these measures.

City and county construction administrative departments or real estate administrative departments (hereinafter referred to as real estate management departments) are responsible for the property management of urban residential areas within their respective administrative areas.

Planning, industry and commerce, price, sanitation, greening, municipal, public security and other relevant administrative departments, in accordance with their respective responsibilities, coordinate the implementation of these measures.

Neighborhood offices and town people's governments shall assist relevant administrative departments to supervise property management. Article 5 Property management shall follow the principle of combining industry management of competent departments, autonomous management of owners and users with professional management services entrusted by property management enterprises. Sixth new residential areas must implement property management in accordance with these measures. Residential areas and residential quarters that have been accepted and delivered before the implementation of these measures shall also implement property management in accordance with these measures. Chapter II Property Management Organization Article 7 Urban residential areas and residential quarters (hereinafter referred to as residential quarters) shall establish residential quarter property management committees (hereinafter referred to as administrative committees) in accordance with these Measures. Management Committee is a mass organization representing the legitimate rights and interests of all owners and users of residential areas, and is composed of representatives of owners and users.

Sub-district offices, residents' committees and public security police stations may send representatives to participate in the work of the CMC. Eighth CMC organized by the local real estate management department held a meeting of the owners and users of residential areas or the owners and users' representatives will be elected.

Representatives of residents' committees and public security police stations shall be invited to attend the meeting of owners and users or the meeting of owners and users' representatives.

After the establishment of the CMC, the CMC is responsible for convening a meeting of owners and users of residential quarters or a meeting of representatives of owners and users.

The meeting of owners and users or the meeting of owners and users' representatives shall be held at least once a year. Article 9 The owners' and users' congress or the owners' and users' representatives will exercise the following functions and powers:

(1) To elect and recall members of the Central Military Commission;

(two) to consider and pass the articles of association of the CMC and the residential district convention;

(three) to listen to the work report of the CMC;

(four) to listen to the work report of the property management enterprise;

(five) to change or cancel the inappropriate decision of the CMC;

(six) to decide on other major matters of property management. Article 10 The CMC consists of five to fifteen members, who are generally part-time and serve for three years, and may be re-elected.

The CMC has one director and several deputy directors, who are elected by the CMC members and reported to the local real estate management department for the record. Eleventh CMC shall exercise the following functions and powers:

(a) to draft the articles of association of the administrative committee and the residential area convention;

(two) hiring property management companies;

(three) to supervise the implementation of residential property management and the implementation of rules and regulations;

(four) to consider the annual management plan formulated by the property management enterprise and the major measures to serve the management of residential quarters;

(five) to assist the property management enterprises in management;

(six) mediation of property management disputes;

(seven) to convene the owners and users' congress or the owners and users' congress, and report the work and related matters to the congress. Twelfth CMC within fifteen days from the date of election, with the following documents to the local real estate management department for registration:

(a) the application for registration of the CMC;

(two) the list of members of the CMC;

(3) Constitution of the Central Military Commission. Chapter III Property Management Enterprises Article 13 Property management enterprises shall implement the system of qualification certification and annual qualification examination.

Property management enterprises enjoy the preferential policies of the state for the tertiary industry.

Property management enterprises shall uniformly implement the Financial Management Regulations of Property Management Enterprises issued by the Ministry of Finance. Article 14 A property management enterprise must pass the qualification examination of the construction administrative department of the autonomous region, register with the administrative department for industry and commerce, apply for a fee permit from the price management department, and register with the local real estate management department before accepting the entrustment to undertake the property management of residential quarters. Fifteenth property management enterprises to the autonomous region construction administrative departments to apply for qualification certification, shall provide the following documents and materials:

(1) An application for qualification certification of the property management enterprise;

(2) Articles of association of the enterprise;

(3) A capital verification certificate issued by a statutory capital verification institution;

(four) the appointment or appointment of economic, technical and management personnel, technical title certificate and property management training certificate.
