In fact, the owner can not refuse to pay the property fee because the property contract is not renewed, but must meet certain conditions, otherwise the owner will still pay the property fee.

Legal basis: Article 41 of the Regulations on Property Management, the owner shall pay the property service fee according to the agreement in the property service contract. If the owner and the user of the property agree that the user of the property shall pay the property service fee, the owner shall bear joint and several liability from the agreement.

After the expiration of Article 948 of the General Principles of Civil Law of People's Republic of China (PRC), if the owner fails to make a decision to renew or hire other property service providers according to law, and the property service providers continue to provide property services, the original property service contract will remain valid, but the service period will be indefinite. Both parties may terminate the indefinite property service contract at any time, but shall notify the other party in writing 60 days in advance.
