Chapter I General Provisions Article 1 In order to standardize the construction, use, maintenance and management of civil air defense projects, these Measures are formulated in accordance with the People's Republic of China (PRC) Civil Air Defense Law, the Measures for the Implementation of the People's Republic of China (PRC) Civil Air Defense Law in Jiangsu Province and the Regulations on Property Management in Jiangsu Province. Article 2 These Measures shall apply to the planning, construction, use, maintenance and management of civil air defense works and their ancillary facilities within the administrative area of this Municipality.

The civil air defense works mentioned in the preceding paragraph (hereinafter referred to as civil air defense works) refer to underground protective buildings built separately for wartime protection of personnel and materials, civil air defense command and medical rescue. And basements that can be used for air defense in wartime. Article 3 The construction, use and management of civil air defense works shall follow the principles of "what should be built must be built", "quality first", "combination of peacetime and wartime" and "rational utilization", and the management system of "whoever uses it will maintain it" shall be implemented. Article 4 The people's governments of cities and counties (districts) shall strengthen their leadership over the construction and management of civil air defense projects. Civil air defense projects should be incorporated into the national economic and social development planning, into the national land space planning, into the government's work objectives and assessment system. Fifth city and county (District) administrative departments for civil air defense (hereinafter referred to as the competent departments for civil air defense) shall be responsible for the supervision and management of the construction, use and maintenance of civil air defense projects within their respective administrative areas.

Development of parks, scenic spots and other management institutions, in accordance with the responsibilities of the supervision and management of the construction and use of civil air defense projects in this region.

City, county (District) development and reform, public security, finance, natural resources, emergency management, urban management, health and market supervision and other administrative departments shall, according to their respective responsibilities, do a good job in the supervision and management of the construction and use of civil air defense projects. Chapter II Planning and Construction Article 6 The municipal and county competent departments for civil air defense shall, jointly with the competent departments of natural resources, scientifically plan the construction of civil air defense projects according to factors such as urban protection categories, population density, regional development intensity and distribution of key protection targets. Solicit the opinions of military organs at the same level, and report to the people's government at the same level for approval and implementation after being examined and approved by the competent civil air defense department at a higher level, and incorporate it into the national land and space planning.

The preparation of civil air defense engineering construction planning should implement and deepen the relevant contents and requirements of city and county land space planning, and do a good job in connecting with urban underground space, comprehensive transportation, common ditch, earthquake relief, medical and health care and other related planning. Gradually realize the interconnection between civil air defense projects and underground buildings, and connect them into a network to improve the comprehensive protection ability of the city. Seventh city and county administrative departments of natural resources in the preparation of land and space planning, should seek the opinions of the competent departments of civil air defense at the same level, clear the control index of civil air defense engineering construction; When reviewing the planning scheme of the construction project, the opinions of the competent departments for civil air defense at the same level shall be sought on the configuration scheme of the civil air defense project of this project. Article 8 The development and utilization of underground space in urban planning areas shall take into account the needs of civil air defense.

City and county (District) civil air defense departments are responsible for the management, supervision and inspection of civil air defense protection matters in the development and utilization of underground space in this region, and cooperate with the departments of development and reform and natural resources. The planning, development, utilization and examination and approval of underground space should be done in accordance with their respective responsibilities.

The key parts and facilities of underground projects, such as underground traffic trunk lines and underground traffic integrated hubs, which take into account the needs of civil air defense, shall meet the standards for civil air defense protection. Article 9 Newly-built (including reconstruction and expansion) civil buildings within a planned urban area shall be built with an air defense basement in the proportion of 5%-9% of the total construction area of the construction project excluding the air defense basement.

The civil buildings mentioned in the preceding paragraph include all non-productive buildings except industrial production workshops and productive supporting facilities. Tenth in line with the civil air defense engineering construction planning of civil air defense command and communication engineering, public personnel shelter engineering, evacuation trunk road engineering, organized by the competent department of civil air defense construction; The air defense professional team project is built by the air defense professional team; Medical rescue projects are built by medical institutions at all levels in new medical projects. Article 11 A newly-built civil building that should build an air defense basement, under any of the following circumstances, shall be applied by the construction unit, and with the approval of the competent department for civil air defense, the construction unit shall pay the fee for ex situ construction of the air defense basement in accordance with the provisions on ex situ unified construction:

(a) the land where it is located prohibits or restricts the development and utilization of underground space;

(two) due to underground rivers, quicksand, shallow bedrock and other geological, topographic or structural conditions, it is not suitable to build an air defense basement;

(three) due to the dense buildings around the construction site or the dense underground pipeline facilities, the civil air defense project can not be constructed or it is difficult to take measures to ensure the construction safety;

(four) according to the prescribed standards, the area of civil air defense projects should be less than 1000 square meters;

(five) meet the requirements of detailed planning or other national and provincial civil air defense planning control indicators;

(six) other special circumstances need to be relocated. Twelfth projects that meet the conditions of ex situ construction, the construction unit shall submit the following written materials:

(a) belongs to the prohibition or restriction of the development and utilization of underground space, it shall submit the relevant materials of natural resources, transportation, water conservancy, cultural relics and other departments;

(two) due to underground rivers, quicksand, shallow bedrock and other geological conditions. , shall submit the engineering geological survey report and description; Due to the limitation of terrain, the original topographic map, architectural design documents and corresponding explanations shall be submitted; Due to the limitation of building structural conditions, corresponding explanations should be submitted, including the usual building functions, safe distance, entrances and exits, pipeline crossing, etc. , can not meet the requirements of technical specifications, and the unit cost is extremely uneconomical and reasonable;

(three) due to the dense buildings or underground pipeline facilities around the construction site, the engineering geological survey report, the drawings of surrounding buildings or underground pipe network issued by the competent unit and the corresponding explanations shall be submitted.

The examination and approval department of civil air defense engineering construction shall organize more than 3 experts to demonstrate the above projects, and the members of the expert group shall be randomly selected from the relevant professional and technical talent pool of this Municipality. The examination and approval department of civil air defense engineering construction shall refer to the opinions of experts when making the examination and approval conclusion.
