Provisions of Shenzhen Special Economic Zone on Property Management at Land Ports and Checkpoints of Special Economic Zone Management Lines
The term "checkpoint" as mentioned in these Provisions refers to a specific area for people, means of transport and goods to enter and leave the special zone management line.
The term "property" as mentioned in these Provisions refers to the inspection sites, offices, public places and supporting facilities and equipment managed by the Shenzhen Municipal People's Government within the port and checkpoint areas.
The inspection place mentioned in these Provisions refers to the specific place for immediate customs clearance. Article 3 The port administration department of Shenzhen Municipal People's Government (hereinafter referred to as the port administration department) is the competent department of port and checkpoint property, and is responsible for the planning, construction, renovation and property management of ports and checkpoints. Article 4 The port administrative department shall, according to the relevant provisions of the state and the needs of inspection business, distribute the property to the relevant units at ports and checkpoints for use, and issue property use certificates to users.
The contents of the property use certificate at ports and checkpoints include: the name, location, area, use and current situation of the property; Name, rights and obligations of the property user. Article 5 Under the following circumstances, the port administrative department may make necessary adjustments to the distribution of property:
(1) The inspection methods at ports and checkpoints have changed;
(two) the overall planning and construction needs of ports and checkpoints.
Relevant units at ports and checkpoints should obey the deployment and replace the property use certificate in time according to the regulations. Article 6 With the authorization of the port administrative department, the property management service units at ports and checkpoints (hereinafter referred to as the property management service units) are responsible for the maintenance of the houses, sites, facilities and equipment of the inspection places within the port and checkpoint areas; Responsible for the management of water supply and power supply, fire safety, environmental sanitation, greening and beautification, parking lot, etc., to ensure a clean and tidy environment, so as to facilitate the normal operation of ports and checkpoints.
The port administrative department shall manage and supervise the property management service units. Seventh ports and checkpoints related units to use the property outside the inspection site, the user is responsible for the management, maintenance and payment of utilities. Article 8 Sources of funds for property management at ports and checkpoints:
(1) government financial subsidies;
(2) Port construction management fees charged in accordance with relevant state regulations;
(3) Income from property management and business services. Article 9 Property management service units may, with the consent of the port administrative department, make rational use of the property resources of ports and checkpoints, and carry out business and service activities according to law without affecting the safety and smoothness of ports and checkpoints and the regional environment. Article 10 The establishment of business service outlets at ports and checkpoints shall be planned in a unified way and reported to the port administrative department for examination and approval. Eleventh ports, checkpoints and property users shall comply with the following provisions:
(a) shall not arbitrarily change the structure and appearance of the property and related facilities and equipment;
(two) shall not be unauthorized construction, renovation, expansion and demolition of any building;
(three) shall not change the use of the property without authorization, and shall not lease or transfer the property or occupy public space for personal use;
(4) No commercial advertisements shall be set up;
(five) shall not violate the provisions of water, electricity lines and gas pipelines;
(six) shall not be stacked flammable, explosive, toxic, radioactive and other items;
(seven) shall not use the property to engage in activities that endanger public interests or safety;
(eight) shall not infringe upon the legitimate rights and interests of other units. Twelfth in the port and checkpoint area, the following acts are prohibited:
(1) trampling on and encroaching on green belts;
(2) occupying stairs, passages, roofs, platforms, roads, parking lots, bicycle sheds and other public facilities;
(three) littering, sundry;
(four) disorderly construction, disorderly stacking, disorderly excavation, etc. ;
(5) Parking vehicles and honking horns at will;
(6) Damage to buildings;
(seven) other acts prohibited by laws and regulations. Thirteenth port and checkpoint units really need to build property in the port and checkpoint areas, they should seek the opinions of the port administrative departments and submit them for approval according to relevant procedures; When the project is accepted, the port administrative department shall participate. Article 14 After the completion and acceptance of the newly-built port real estate, the development and construction unit shall hand over the following construction materials to the port management department:
(a) port, checkpoint area planning, land red line map, the completion of the general plan;
(2) as-built drawings of single buildings, structures and equipment;
(3) Completion drawing of underground pipe network;
(4) Other necessary information. Fifteenth property management service units in business activities, affecting the safety and normal order of ports and checkpoints, the port administrative department shall order them to make corrections within a time limit; If it fails to change within the time limit or the circumstances are serious, the directly responsible person in charge and the directly responsible person shall be investigated for responsibility.
