Regulations of Wuxi Municipality on Water Environmental Protection (revised in 2008)

Chapter I General Provisions Article 1 In order to protect and improve the water environment, ensure the safety of drinking water, and promote the comprehensive, coordinated and sustainable development of economy, society and environment, these Regulations are formulated in accordance with the Water Law of People's Republic of China (PRC), the Law on Prevention and Control of Water Pollution in People's Republic of China (PRC), the Regulations on Prevention and Control of Water Pollution in Taihu Lake, Jiangsu Province, and the actual situation of this Municipality. Article 2 These Regulations shall apply to the water environmental protection of surface water bodies and underground water bodies such as Neijiang, rivers, lakes, swings, beeches, reservoirs and wetlands within the administrative area of this Municipality. Article 3 Water environmental protection shall adhere to the principles of scientific planning, comprehensive protection, unified management, graded responsibility, prevention first and comprehensive management, strictly control the total discharge of pollutants, implement paid use of water environmental resources, restore and optimize water ecological functions, and promote the overall improvement of water environment. Fourth people's governments at all levels are responsible for the quality of water environment within their respective administrative areas, and their main responsible persons are mainly responsible for achieving the water environment protection objectives during their term of office.

Implement the responsibility system for water quality compliance in surface water (environment) functional areas and the responsibility system for water quality handover in administrative boundary water sections, and incorporate them into the government's environmental protection term responsibility objectives. Article 5 People's governments at all levels should increase capital investment in water environmental protection, promote the marketization of environmental governance and protection, and include the required funds in the fiscal budget. Article 6 The competent departments of environmental protection of cities, cities not divided into districts and districts shall exercise unified supervision and management over the water environmental protection within their respective jurisdictions.

Departments of development and reform, economy and trade, construction, water conservancy, municipal administration, planning, transportation, agriculture, forestry, land and resources, health, finance, science and technology, industry and commerce, quality and technical supervision, etc. shall supervise and manage the water environmental protection work in accordance with the duties stipulated by laws, regulations and the government. Seventh people's governments at all levels and their relevant departments shall organize publicity and education of laws, regulations and scientific knowledge on water environmental protection, and enhance the awareness of water environmental protection in the whole society.

Staff of state organs and persons in charge of enterprises and institutions should always receive education in laws, regulations and scientific knowledge on water environmental protection. Eighth to encourage and support citizens, enterprises and institutions, social organizations and other organizations to participate in water environmental protection; Any unit or individual has the right to punish acts that damage the water environment.

Discourage, report and expose.

Units and individuals that have made outstanding achievements in water environmental protection shall be commended and rewarded by the municipal, municipal and district people's governments or relevant departments. Chapter II Water Pollution Control Article 9 The Municipal People's Government shall, in accordance with the provisions of the state and the province, determine and issue targets for the total discharge of water pollutants and emission reduction, and gradually incorporate the total discharge of phosphorus and nitrogen pollutants into the control targets. The people's governments of cities and districts without districts shall, according to the requirements of total control and emission reduction targets in their respective administrative areas, decompose the total control targets, formulate emission reduction plans, and implement them to pollutant discharge units.

The competent department of environmental protection shall regularly announce to the public the completion of the total amount control targets in various regions, and supervise and manage the implementation of water pollutant emission reduction projects in pollutant discharge units. Tenth the implementation of regional compensation system for environmental resources. If the water quality at the junction of administrative areas fails to reach the control target, the people's government of the responsible area shall compensate the people's government of the damaged area. Specific measures shall be formulated by the Municipal People's Government. Eleventh in accordance with the provisions of the state, the implementation of sewage declaration and registration and sewage permit system; It is forbidden to discharge pollutants without a pollutant discharge permit or not in accordance with the provisions of the pollutant discharge permit. Article 12 The people's governments of cities, cities not divided into districts and districts and their relevant departments shall organize the preparation of overall land use planning, regional and river basin construction, development and utilization planning and related special planning, and shall organize environmental impact assessment in accordance with the provisions.

All kinds of industrial parks and industrial concentrated areas (hereinafter referred to as industrial parks) shall prepare environmental plans and perform the examination and approval procedures for environmental impact assessment according to law.

New construction, renovation and expansion of construction projects that may produce water pollution shall be subject to environmental impact assessment according to law. If the environmental impact assessment document of a construction project has not been approved by the competent department of environmental protection, other examination and approval departments shall not approve its construction, and the construction unit shall not start construction. Thirteenth Municipal People's Government shall organize environmental protection, water conservancy, municipal administration, agriculture, forestry, health, meteorology and other departments to implement the construction and management of the city's water environment monitoring and control system.

The municipal and district people's governments not divided into districts shall set up automatic monitoring devices at the junction of administrative areas, the mouth of major rivers entering rivers (lakes), key protected river sections and drinking water sources, and connect them with the city's environmental monitoring system. Article 14 The operating units of urban centralized sewage treatment facilities and the key pollutant discharge units determined by the competent department of environmental protection shall install automatic monitoring devices for pollution sources networked with the urban environmental monitoring system, and ensure their normal operation. The parameters and monitoring data of the automatic monitoring device for pollution sources shall not be changed without authorization, and the automatic monitoring device for pollution sources shall not be stopped without authorization. Article 15 The competent department of environmental protection shall, in accordance with the relevant provisions, uniformly announce the water environmental quality and the environmental information of key pollutant discharge units to the public.

Enterprises should disclose their environmental information to the public, and the competent department of environmental protection has the right to consult the environmental information published by enterprises. Sixteenth all kinds of development and construction activities shall conform to the national and local industrial policy guidance catalogue and environmental protection access conditions. Prohibit the following construction behaviors that produce water pollution:

(a) new construction, renovation and expansion of chemical pulping and papermaking, tanning, brewing, dyeing, electroplating and other enterprises and projects that discharge pollutants such as phosphorus and nitrogen;

(two) new construction, renovation and expansion of sewage can not be connected to urban sewage centralized treatment facilities construction projects and business projects;

(three) in addition to pollution control projects, new and expanded industrial projects outside the industrial park;

(four) other construction activities prohibited by laws and regulations.
