Under what circumstances can the owner own the property?

Article 81 of China's Property Law stipulates: "Owners can manage buildings and their ancillary facilities by themselves, or they can entrust property service enterprises or other managers to manage them."

Therefore, the owner can own the property under the following circumstances.

1. If there is only one owner, or the number of owners is small, all owners agree unanimously to own the property. (Article 10 of China's Property Management Regulations stipulates that if there is only one owner, or the number of owners is small, with the unanimous consent of all owners, it is decided not to set up the owners' meeting, and the owners will perform the duties of the owners' meeting and the owners' committee. )

2. Entrusted or hired by the construction unit, if the service quality makes your owners dissatisfied, you can decide to hire a new property service enterprise by holding a community owners' meeting. (For the realty service enterprise or other manager selected by the construction unit, the owner has the right to replace it according to law by convening the owners' meeting of the community. )

3 If the service contract of the selected realty service enterprise expires, it can be decided to renew or re-select other realty service enterprises by convening a community owners' meeting.

4。 "The owner has the right to co-manage the part of * * * except the proprietary part", and (stipulated in Article 70 of China's Property Law) can decide at his own discretion to "use the part of * * * to operate and distribute the use income." (Item (9) of Article 17 of the Guidelines for Owners' Committees issued by the Ministry of Housing and Urban-Rural Development of China)

Note: the owners' meeting has been established in the community, and all matters related to self-management must be decided by the owners' meeting.
