What should the property service company do if it neglects to manage the public facilities in the community and causes inconvenience or damage to the owners?

According to the provisions of Article 2 of the Property Management Regulations, property management refers to the activities that the owner selects a property service company, and the owner and the property service company, in accordance with the provisions of the property service contract, repair, maintain and manage the house, supporting facilities and related sites, and maintain the environmental sanitation and related order in the property management area. In other words, the matters and contents of the services provided by the realty service company are mainly based on the stipulations of the realty service contract. Generally speaking, it mainly includes the following items: (1) the management of the main body of housing construction and the daily supervision of residential decoration; (2) the management of housing equipment and facilities; (3) Environmental sanitation management; (4) Greening maintenance management; (five) to cooperate with the public security fire department to maintain public order and safety in residential areas; (6) Vehicle road management and service; (seven) the maintenance and management of public places of leisure and entertainment and facilities; (8) Other agreed services. Article 36 of the Property Management Regulations stipulates that property service enterprises shall provide corresponding services in accordance with the provisions of the property service contract.

The realty service enterprise fails to perform the provisions of the realty service contract, causing personal and property safety damage to the owner, and shall bear corresponding legal responsibilities according to law. This article clearly stipulates that if there is any breach of contract in the process of property service, which causes damage to the owner, the property service company shall bear the liability for compensation for breach of contract. Article 3 of the Supreme People's Court's Interpretation on Several Issues Concerning the Specific Application of Law in the Trial of Property Service Disputes stipulates that if a property service enterprise fails to perform or fails to fully perform its maintenance, conservation, management and repair obligations as stipulated in the property service contract or determined by laws, regulations and relevant industry norms, the people's court shall support it if the owner requests the property service enterprise to bear the liabilities for breach of contract such as continuing to perform, taking remedial measures or compensating for losses.
