Legal Analysis: In order to standardize the parking order in residential property management areas and protect the legitimate rights and interests of both parking management parties, according to the Civil Code of People's Republic of China (PRC), the Regulations on Property Management of the State Council and the Regulations on Residential Property Management of Shanghai, the Municipal Housing Management Bureau formulated the Regulations on Motor Vehicle Parking Management in Residential Property Management Areas in Shanghai, which came into effect from June 20021to 10. If a parking management unit is added, the provisions on parking management in the previous realty service contract, realty service contract, owner management statute, temporary management statute, residential parking management system or parking management service contract shall be fulfilled; Publicize parking fees in a prominent position in the property management area; Formulate the responsibilities of parking management personnel, the disposal plan for moving vehicles in case of emergency, and the parking charge management system. According to the scheme adopted by the owners' meeting, the parking spaces that are not originally planned and designed shall be designated, and the designated parking spaces shall comply with the relevant provisions on fire control; Mechanical parking facilities must be equipped with vehicle management personnel with special equipment operation certificates and other related responsibilities.

Article 1 About the use, allocation and transfer of parking spaces. According to the newly revised "Regulations of Shanghai Municipality on the Administration of Residential Property", articles 61 and 62 shall be amended.

The second is about the setting of fixed parking spaces. If parking spaces are set up in areas other than the original planned parking spaces, they shall not be rented to specific owners and users as fixed parking spaces.

Article 3 Parking management service agreement. It is clear that if the parking management unit provides parking management services in the residential property management area, the service content and charging standard shall be agreed in the preliminary property service contract, property service contract or parking management service contract. The relevant contents agreed in the contract shall not conflict with the temporary management regulations, management regulations and parking management system in the community.
