Provisions of Ningbo Municipality on the Administration of Police Auxiliary Personnel of Public Security Organs

Article 1 These Provisions are formulated in accordance with relevant laws and regulations and the actual situation of this Municipality in order to standardize the management of police auxiliary personnel of public security organs, safeguard their legitimate rights and interests and give full play to their auxiliary role in public security work. Article 2 These Provisions shall apply to the recruitment, use, management, guarantee and supervision of police auxiliary personnel of public security organs within the administrative area of this Municipality.

The auxiliary police of public security organs mentioned in these Provisions (hereinafter referred to as auxiliary police) refers to the non-people police who are openly recruited by public security organs in accordance with these Provisions and provide auxiliary support for police activities and daily operations of public security organs. Auxiliary police are divided into service auxiliary police and civilian auxiliary police. Article 3 The municipal, district and county (city) public security organs are the competent departments in charge of the management of auxiliary police within their respective administrative areas, and are responsible for the recruitment, use and management of auxiliary police.

City and county (city) institutions, finance, human resources and social security, veterans affairs and other departments shall, in accordance with their respective responsibilities, do a good job in the recruitment, management and security of auxiliary police. Article 4 Auxiliary police shall, in accordance with the relevant provisions of the state, assist the people's police of public security organs to perform law enforcement tasks and other duties, mainly including:

(a) To help prevent and stop illegal and criminal activities;

(2) Assisting in public security patrols and inspections, and conducting safety inspections on places where people gather;

(three) to assist in the investigation, blocking, monitoring and detention of criminal suspects;

(four) to help maintain the order of cases (events), protect cases (events), and rescue the injured;

(five) to help ease traffic, discourage and correct traffic safety violations, and collect traffic violation information;

(six) to assist in the management and supervision of public security;

(seven) other tasks that can be assisted by the auxiliary police. Article 5 The civilian auxiliary police shall, in accordance with the relevant provisions of the state, assist the people's police of public security organs in administrative management, technical support and police support, mainly including:

(a) to assist the clerical assistant, file management, wiring inquiry, window service, certificate processing, information collection and entry and other administrative work;

(two) to assist in psychological counseling, medical treatment, translation, computer network maintenance, data analysis, software research and development, security monitoring, communication guarantee, fund analysis, non-confidential financial management, laboratory analysis and other technical support work;

(three) to assist in the custody and maintenance of police equipment and other police security work;

(four) other tasks that can be assisted by civilian auxiliary police. Article 6 Auxiliary police officers shall be engaged in police auxiliary work under the command and supervision of public security organs and their people's police, and may not enforce the law alone or in their own names.

The public security organ and its people's police shall not arrange auxiliary police to engage in the following work:

(1) domestic security and technical reconnaissance;

(2) Handling matters involving state secrets;

(three) the case investigation and evidence collection, issue an appraisal report, and identify the responsibility for traffic accidents;

(four) the implementation of criminal compulsory measures;

(5) Making administrative decisions;

(6) Examining cases;

(7) Keeping weapons and police equipment;

(8) Work that must be performed by the people's police of public security organs according to law. Seventh auxiliary police shall not have the following acts:

(1) divulging work secrets;

(2) Illegally depriving or restricting the personal freedom of others, corporal punishment, ill-treatment, beating or insulting criminal suspects or other personnel;

(3) taking advantage of his position to seek personal gain for himself or others;

(4) Embezzling or damaging the property involved;

(five) unauthorized use of public security digital certificates, illegal acquisition, sale and disclosure of information of other organizations and individuals;

(6) Other violations of discipline and law. Article 8 The establishment of auxiliary police personnel shall be set according to the economic and social development level, social security situation and police force allocation of the administrative region, and be dynamically adjusted.

City, county (city) organization department shall, jointly with the public security and financial departments at the same level, prepare the quota of auxiliary police of public security organs at the same level, and implement it after approval in accordance with relevant regulations. Article 9 The municipal, district and county (city) public security organs shall, jointly with the human resources and social security departments at the same level, formulate the recruitment plan according to the staffing and use of auxiliary police officers, and organize and implement the recruitment work in a unified manner. Auxiliary police recruitment should follow the principles of openness, equality, competition and merit-based, unify recruitment standards and procedures, strictly select and appoint, and the recruitment plan should be publicized to the public.

The public security organ shall sign a labor contract with the auxiliary police according to law. Article 10 An auxiliary police shall meet the following conditions:

(1) Having People's Republic of China (PRC) nationality;

(two) support the leadership of China, support the Constitution of People's Republic of China (PRC), abide by laws and regulations, and have good conduct;

(three) at least eighteen years of age;

(4) Having a college degree or above;

(5) Having the physical quality and working ability required to perform their duties;

(6) Other conditions stipulated by laws and regulations.

Personnel with special skills such as martial arts, explosive ordnance disposal, assault, or professional expertise such as information technology, as well as retired military personnel and courageous advanced elements, may appropriately relax their academic qualifications, age and other conditions, but the relevant conditions should be clearly defined when compiling the conscription plan.
