Through this series of regulations, the boundary of police auxiliary personnel's behavior is clearly defined, which provides legal support for police auxiliary personnel to perform their duties according to law.

Chapter I General Provisions

Article 1 In order to standardize the administration of police auxiliary personnel of public security organs, ensure police auxiliary personnel to perform their duties according to law, safeguard their legitimate rights and interests, and give full play to the role of police auxiliary personnel in assisting the people's police in maintaining social order, stopping and punishing illegal and criminal activities, and serving the people, in accordance with relevant laws and administrative regulations, combined with the actual situation of this province,

article 2 these regulations shall apply to the recruitment, use, supervision and guarantee of police auxiliary personnel of public security organs within the administrative area of this province.

the police auxiliary personnel of public security organs mentioned in these regulations (hereinafter referred to as police auxiliary personnel) refer to non-people police personnel who are openly recruited for the public and provide auxiliary support for police activities of public security organs according to the social security situation and the actual needs of public security work, and are divided into service police auxiliary personnel and civilian police auxiliary personnel.

People who are engaged in security, cleaning, catering and other logistics services in public security organs are not police assistants.

article 3 the management of police auxiliary personnel shall follow the principles of standardization according to law, clear responsibilities and rights, strict supervision and reasonable guarantee.

article 4 the local people's governments at or above the county level shall strengthen their leadership over the management of police auxiliary personnel within their respective administrative areas, establish a work coordination mechanism, implement safeguard measures, and study and solve major problems in the management of police auxiliary personnel.

article 5 the public security organs of local people's governments at or above the county level shall be responsible for the administration of the use of police auxiliary personnel within their respective administrative areas.

the departments of organization establishment, civil affairs, finance, human resources and social security, health and health, and retired military affairs shall do a good job in the management of police auxiliary personnel according to their respective responsibilities.

Article 6 The act of police assistants assisting the people's police to perform their duties according to law is protected by law, and citizens, legal persons or other organizations shall support and cooperate.

The public security organ that uses the auxiliary police personnel shall bear the consequences of their performance of duties.

article 7 police auxiliary personnel who have made outstanding achievements and contributions in their work or have other outstanding deeds shall be commended and rewarded in accordance with the relevant provisions of the state and province.

Chapter II Duties, Rights and Obligations

Article 8 Auxiliary police officers shall, under the command or leadership of the people's police, assist in carrying out relevant work in accordance with these regulations and relevant state regulations.

Article 9 Under the leadership of the people's police, service police assistants can assist in the following work:

(1) Public security management of rental housing, special industries, drug control, entry and exit and other related management and service activities;

(2) Implement traffic control and traffic safety inspection to stop and correct traffic safety violations;

(3) conducting interrogation and custody of persons suspected of committing crimes;

(4) receiving and reporting administrative cases, registering cases, accepting evidence, collecting case information, mediating and serving documents;

(5) Take temporary protective restraint measures against drunken people whose behaviors are out of control and mental patients who commit violent acts;

(6) supervision of public security's management service;

(7) maintain the order of large-scale public events;

(8) participating in emergency handling;

(9) Other work that can be carried out in accordance with relevant state regulations.

Article 1 Under the command or leadership of the people's police, auxiliary police officers may assist in the following work:

(1) Accepting and handling people's requests for help and resolving conflicts and disputes according to law;

(2) publicity and education on public security prevention, traffic safety, drug control and fire control;

(3) Dredge traffic, prompt and discourage traffic safety violations, collect traffic violation information, and guide the parties to the accident to handle minor traffic accidents through negotiation;

(4) maintain the order and safety of the case (incident) site, protect the case (incident) site and help the injured and trapped people;

(5) services such as information collection and registration of floating population;

(6) stop the ongoing illegal and criminal activities;

(7) patrol, on duty and safety inspection;

(8) Other work that can be carried out in accordance with relevant state regulations.

article 11 public security organs shall equip auxiliary police officers with necessary duty and safety protection equipment. Service police assistants can drive police vehicles, boats and other means of transportation during the performance of their duties.

auxiliary police officers are not allowed to use weapons and police equipment. In case of emergency endangering public security, social order and citizens' personal and property safety, auxiliary service police officers can assist in the use of binding police equipment under the command and guidance of the people's police.

Article 12 Under the command or leadership of the people's police, auxiliary civilian police officers may assist in the following work:

(1) Administrative services such as window service and telephone (letter) inquiry;

(2) Technical support work such as psychological consultation, medical treatment, translation, computer network maintenance, data analysis, communication guarantee and video monitoring;

(3) police security work such as custody and maintenance of police equipment other than weapons and police equipment;

(4) other work that can be carried out in accordance with relevant state regulations.

those who need to have corresponding qualifications to carry out the work specified in the preceding paragraph shall obtain corresponding professional qualifications.

Article 13 Auxiliary police officers shall not engage in the following tasks:

(1) Handling matters involving state secrets;

(2) technical reconnaissance;

(3) issue an appraisal report;

(4) identify the responsibility for traffic accidents;

(5) executing criminal compulsory measures;

(6) making decisions on administrative licensing, administrative compulsion and administrative punishment;

(7) reviewing cases;

(8) keep weapons and police equipment;

(9) Other jobs prohibited by laws, regulations and relevant state regulations.

Article 14 Auxiliary police officers shall enjoy the following rights:

(1) To obtain the necessary working conditions and safety protection for performing their duties;

(2) get remuneration for labor, enjoy welfare and participate in social insurance;

(3) Participate in business skills training;

(4) to put forward opinions and suggestions on the work of the public security organ;

(5) dissolving the labor relationship according to law;

(6) other rights stipulated by laws and regulations and agreed in the contract.

Article 15 Auxiliary police officers shall abide by the law and discipline, obey the management of public security organs and the command of the people's police, be loyal to their duties and perform their duties in a civilized manner, and shall not commit any of the following acts:

(1) Spreading remarks that undermine the authority of the Constitution, the reputation of the China * * * production party and the state, and organizing or participating in activities such as assembly, procession and demonstration aimed at opposing the Constitution, the leadership of the China * * * production party and the state;

(2) divulging state secrets, work secrets, business secrets, personal privacy and information of citizens;

(3) organizing or participating in illegal organizations;

(4) participating in or supporting pornography, drug abuse, gambling, superstition and other activities;

(5) participating in prohibited network communication or network activities in violation of relevant regulations;

(6) taking advantage of one's work to seek personal gain for oneself or others;

(7) engaging in or participating in profit-making activities related to the performance of duties;

(8) Failure to perform or improper performance of duties;

(9) being rude to the masses, being rude, deliberately making things difficult or taking things too seriously;

(1) other acts violating laws and disciplines.

article 16 the local people's governments at or above the county level shall scientifically allocate and strictly control the size of police auxiliary personnel according to the local economic and social development, social security and the tasks undertaken by the public security organs, and in accordance with the principles of total control, leaning towards the grassroots, dynamic adjustment and classified use.

the public security organ of the provincial people's government shall, jointly with the departments of organization establishment, finance, human resources and social security, make scientific research, calculation and analysis on the total demand for police auxiliary personnel, and formulate reasonable and feasible measures for the management of employment quota.

The public security organs should strengthen the informatization and intelligent construction, optimize the work posts and processes, improve the law enforcement ability and efficiency, and rationally use the auxiliary police personnel.

article 17 the recruitment of police auxiliary personnel shall be organized and implemented by the public security organ jointly with the human resources and social security department, or it may be organized and implemented by the public security organ separately within the scope of employing quota, and the specific measures shall be formulated by the public security organ of the provincial people's government jointly with the departments of organization establishment, finance, human resources and social security, etc.

article 18 the recruitment of police auxiliary personnel shall follow the principles of openness, equality, competition and merit-based, unify recruitment standards and procedures, define recruitment positions and strictly select and employ them.

Article 19 When recruiting police assistants, they should go through procedures such as registration, examination, physical examination, inspection and publicity, and be selected on the basis of merit.

When recruiting police assistants with professional qualifications or skills, the recruitment procedures can be appropriately adjusted or other evaluation methods can be adopted.

Article 2 To apply for police assistants, the following conditions shall be met:

(1) Support the Constitution, the leadership of the China Communist Party and the socialist system;

(2) citizens who have reached the age of 18;

(3) having a high school education or above;

(4) having good political quality and moral conduct;

(5) Having the physical condition, psychological quality and working ability that meet the post requirements;

(6) Other conditions required by the state and the province.

if the recruitment position has special requirements on professional skills and education level, the applicant shall meet the relevant requirements.

Article 21 A person who has one of the following circumstances shall not be employed as a police assistant:

(1) He has been investigated for criminal responsibility or the case of suspected crime has not been closed;

(2) Having been dismissed, dismissed or terminated the labor contract for violating the law and discipline;

(3) being listed as the object of joint punishment for dishonesty according to law;

(4) other circumstances stipulated by the state and the province that are not suitable for police assistance.

article 22 under the same conditions, priority shall be given to the recruitment of martyrs, spouses and children of people's policemen who died in the line of duty, retired soldiers and courageous people.

article 23 the employed police auxiliary personnel shall establish labor relations according to the recruitment positions.

article 24 before the newly hired police auxiliary personnel take up their posts, the public security organ shall take an oath with reference to the oath provisions of the people's police.

Chapter IV Management and Supervision

Article 25 Police auxiliary personnel shall be managed by classification, posts and levels. The public security organ shall establish and improve the management and supervision system with reference to the relevant management regulations of the people's police and in combination with the characteristics of police auxiliary personnel.

article 26 the public security organ shall, according to the job responsibilities and the nature of the work, carry out post management for service posts such as patrol prevention and control, community management, traffic co-management, dispute mediation, and civilian posts such as police reception, document co-assistance, information entry, and technical support, and specify specific work specifications and requirements.

the public security organ shall, according to the working years and assessment results of the police auxiliary personnel, implement hierarchical management of the police auxiliary personnel, and there is no leadership, command or subordinate relationship between the levels. The level of police auxiliary personnel is linked to the salary and treatment.

the specific measures for the management of police auxiliary personnel in different posts and at different levels shall be formulated by the public security organs of the provincial people's government.

article 27 the public security organ shall establish a training system for police auxiliary personnel, provide pre-job training for newly hired police auxiliary personnel on the basic ability of performing their duties, and provide ideological and political, legal knowledge, professional skills, safety protection and psychological quality training for on-the-job police auxiliary personnel, so as to improve their professional quality and professional level.

article 28 the public security organ shall assess the ideological and political quality, professional ability, work style, work performance and law-abiding of police auxiliary personnel.

The assessment results serve as the main basis for the promotion and demotion, rewards and punishments, and the retention or non-retention of police auxiliary personnel.

article 29 the public security organ shall, in accordance with relevant regulations, distribute uniform work certificates, clothes and signs to the police auxiliary personnel.

During the performance of their duties, police assistants should wear their clothes and signs as required, and show their work certificates to identify themselves when necessary; Those who need casual clothes shall carry their work certificates. During the period of non-performance of duties, you shall not wear the clothing and signs of police assistants. When a police assistant leaves his post, he shall return his work certificate, clothing, logo and equipment to the public security organ.

no organization or individual may illegally manufacture, sell, buy, hold and use the work certificates, clothes and logos of police assistants.

Article 3 When police auxiliary personnel assist in carrying out auxiliary work related to law enforcement under the leadership of the people's police, they shall publicize law enforcement and record the whole process in accordance with relevant state regulations.

Article 31 In the course of performing their duties, police assistants should withdraw under any of the following circumstances, and the parties concerned or their legal representatives have the right to apply for withdrawal:

(1) They are the parties to a case (matter) or their close relatives;

(2) I or my close relatives have an interest in the case (matter);

(3) having other relations with the parties to the case (matter), which may affect the fair handling.

the withdrawal specified in the preceding paragraph shall be decided by the relevant person in charge of the public security organ who uses police auxiliary personnel.

article 32 auxiliary police officers shall accept social supervision when performing their duties.
