Measures for the prevention and control of dust pollution in Yantai City

Chapter I General Provisions Article 1 In order to prevent and control dust pollution, protect and improve the atmospheric environment, safeguard people's health and promote the construction of ecological civilization, these measures are formulated in accordance with the Environmental Protection Law of People's Republic of China (PRC), the Air Pollution Prevention Law of People's Republic of China (PRC), the Regulations on the Prevention and Control of Air Pollution in Shandong Province and the Administrative Measures for the Prevention and Control of Dust Pollution in Shandong Province, and in combination with the actual situation of our city. Article 2 These Measures shall apply to the prevention and management of dust pollution within the administrative area of Yantai City.

The term "dust pollution" as mentioned in these Measures refers to the adverse effects of loose particles produced in engineering construction, demolition of buildings (structures), material handling, transportation and stockpiling, road cleaning, mining and soil borrowing, landscaping and other activities on the atmospheric environment and human health. Article 3 The prevention and control of dust pollution shall follow the principles of government leading, departmental supervision, territorial management, public participation, prevention first, comprehensive management and liability for damage. Fourth people's governments at all levels, relevant departments and units should strengthen the publicity and education of laws and regulations on the prevention and control of dust pollution, and improve the public's awareness of environmental protection and the concept of rule of law.

The news media should actively carry out public welfare propaganda on the prevention and control of dust pollution and strengthen public opinion supervision on the prevention and control of dust pollution. Article 5 All units and individuals have the obligation to prevent and control dust pollution, and should consciously practice green and frugal production, life and consumption methods to reduce dust pollution, and have the right to report the units and individuals that cause dust pollution.

Ecological environment, housing and urban construction, urban management and other departments should establish a dust pollution complaint reporting system, promptly accept dust pollution complaints and reports, and deal with them according to law. Sixth to encourage and guide the popularization and application of new technologies, new processes and new equipment for the prevention and control of dust pollution.

Encourage and support industry associations to formulate and implement professional standards for dust pollution prevention and control, and strengthen self-discipline management. Chapter II Responsibility for Prevention and Control Article 7 The municipal government shall uniformly lead the prevention and control of dust pollution in the whole city, establish a mechanism of overall coordination, long-term management and information sharing, study and formulate relevant policies and measures, and coordinate the prevention and control of dust pollution across regions.

The municipal, district (city) people's governments shall incorporate the prevention and control of dust pollution into the environmental protection planning and environmental protection target responsibility system, establish a joint meeting system with the participation of ecological environment, housing and urban construction, urban management, transportation, natural resources and planning, water conservancy, public security and other departments, study and formulate relevant policies and measures, and protect and improve the quality of the atmospheric environment.

The township (town) people's government and sub-district offices are responsible for the supervision and implementation of dust pollution prevention and control work within their respective jurisdictions, and do relevant specific work according to the arrangements of the people's government at a higher level and relevant departments.

Village (neighborhood) committees shall assist in the prevention and control of dust pollution, timely discover, discourage and report illegal acts of dust pollution, and cooperate with relevant departments to deal with them according to law. Article 8 The competent department of ecological environment shall be responsible for the unified supervision and management of the prevention and control of dust pollution within their respective administrative areas, and for the supervision and management of the prevention and control of dust pollution during the mining and recovery of industrial enterprises and open-pit mines. Other relevant departments shall, in accordance with the following division of responsibilities, do a good job in the supervision and management of dust pollution prevention and control:

(a) the competent department of housing and urban and rural construction is responsible for the supervision and management of the prevention and control of dust pollution, such as housing construction and municipal infrastructure projects, and the demolition of buildings (structures) that have been included in the housing expropriation procedures on state-owned land; Responsible for the management of construction waste and resource utilization and the supervision and management of dust pollution prevention and control;

(two) the urban management department is responsible for the supervision and management of the prevention and control of dust pollution such as municipal roads, public places and public facilities, pipe networks, gas, heat, greening projects, transportation management, and construction waste disposal within its jurisdiction;

(three) the competent department of transportation is responsible for the supervision and management of traffic engineering construction, road maintenance, ports and docks and other dust pollution prevention and control work;

(four) the competent department of natural resources and planning is responsible for the supervision and management of the prevention and control of dust pollution such as reserved land to be developed;

(five) the water conservancy department is responsible for the supervision and management of dust pollution prevention and control within the management scope of water conservancy projects, rivers and reservoir areas;

(VI) The traffic administrative department of the public security organ is responsible for setting the forbidden and restricted areas and times for vehicles carrying dust-prone materials, investigating and handling road traffic violations according to law, and cooperating with the urban management department to conduct joint law enforcement inspections on vehicles carrying dust-prone materials;

(seven) other departments responsible for the prevention and control of dust pollution shall do a good job in the prevention and control of dust pollution in accordance with their respective responsibilities and the division of labor of the people's governments at all levels. Ninth construction units shall comply with the following provisions:

(a) to formulate dust pollution assessment and prevention measures, and incorporate them into the environmental impact assessment documents of construction projects;

(two) according to the provisions of the standard rate of dust pollution prevention and control costs included in the project cost, and be clear in the construction contract, timely and full disbursement;

(three) clear the responsibility of the construction unit to prevent and control dust pollution, and incorporate it into the bidding documents and construction contracts;

(four) according to the construction contract, supervise the construction unit to implement the responsibility of dust pollution prevention and control. Tenth construction units shall bear the responsibility of dust pollution prevention and control during the construction period, and formulate specific implementation plans for dust pollution prevention and control during the construction period.

Construction units engaged in building construction, municipal infrastructure construction, river regulation and building demolition shall file with the competent department responsible for the supervision and management of dust pollution prevention and control.
