General rules for public selection of judges and recruitment of court system staff in Chongqing in 2009

According to the work needs of people's courts at all levels in our city, according to the Civil Service Law of People's Republic of China (PRC), the Judges Law of People's Republic of China (PRC), the Interim Measures for the Open Selection of New Judges and Prosecutors (No.25 [2008] of Chongqing Municipality) and the Interim Measures for the Employment of Staff of People's Courts and People's Procuratorates at All Levels (No.4 [2005] of Chongqing Municipality) and other relevant provisions, it is decided to be open, equal and fair. 370 judges were publicly selected and 342 court system staff were openly recruited by means of examination and assessment (for details, please refer to the Position Table of Public Selection of Judges and Public Recruitment of Court System Staff in Chongqing in 2009, hereinafter referred to as the Position Table, attached). The relevant matters are hereby announced as follows:

I. Application conditions

(a) with People's Republic of China (PRC) nationality, good conduct, law-abiding.

(2) As of July 3, 2009, Kloc-0, he has obtained a bachelor's degree or above recognized by the national education administrative department ("above" includes the corresponding level, the same below). If there are special requirements for academic qualifications and degrees in the job list, those provisions shall prevail.

(3) Age condition

Lower age limit: as of July 3, 2009, I have reached the age of 18 (that is, I was born before 3 1 91day).

Upper age limit: undergraduate, born after 10 month 1983 1; Postgraduate, an undergraduate who passed the national unified judicial examination, was working as a clerk (stenographer) in Chongqing court system as of July 3, 2009, and was born after 1 9791. Doctoral and master students who passed the national unified judicial examination were born after 1977 1; If there are special requirements for the age conditions of relevant positions in the position table, such provisions shall prevail.

(4) Having physical conditions for normal performance of duties and meeting the requirements of relevant physical examinations. According to the needs of the people's court, the body shall not be disabled. The height of men applying for the positions of judge, judge reserve and clerk is above1.65m, and that of women is above1.55m.. Those who apply for judicial police positions have binocular vision of 4.8 or above or corrected vision of 5.0 or above, male height of 1.70m or above and female height of 1.60m or above. ..

(5) Meet the qualifications for each position specified in the Position Table.

(six) in accordance with the relevant provisions of the people's court staff to avoid.

(seven) one of the following circumstances, can not apply:

1, has been given administrative demerit or severe warning within the party;

2. Having received criminal punishment for committing a crime or being put on file for review;

3. Being expelled from public office;

4. Being reeducated through labor;

5. Being administratively detained for violating the regulations on administrative penalties for public security;

6. Servicemen, civil servants whose probation period has not expired or who have been dismissed for less than five years (including civil servant law administrators and civil servants with appointment system), civil servants of Chongqing courts and procuratorates (including civil servant law administrators and civil servants with appointment system);

7. Part-time college graduates who are studying;

8, since 2004 by the competent department of civil servants that there is cheating in the civil service examination;

9. The spouse, lineal blood relatives and collateral blood relatives who have a great influence on me have been sentenced to death, or are serving a sentence, or have been given more than two criminal punishments, or engaged in political activities in China at home and abroad;

10, other circumstances that are not suitable for working in the people's court.

Second, the selection and recruitment procedures

(1) Online Registration

From March 5, 2009 10:00 to March 27, 2009 17:00, applicants logged into the registration system of Chongqing Leading Cadres Examination Network, carefully read the "Registration Instructions", filled in and submitted the application as required, uploaded electronic photos, and paid the written examination fee online.

Applicants can only choose one position in one unit to register, and can't register with both old and new ID numbers. The ID cards used for registration and examination must be the same. Applicants should truthfully and accurately fill in all the contents of the application information according to the requirements of the letter of commitment of good faith, upload electronic photos (bareheaded registration photos, jpg format, below 20kb), and remember the registration serial number and password assigned by the system (the registration serial number and password are used to log in to the registration system again, modify some application information, download and print the admission ticket and qualification examination form, and inquire about the results, etc.). ). Anyone who practices fraud, once verified, will be disqualified from the examination or employment.

After submitting the application, pay the written test fee online according to the prompts (the written test fee is 50 yuan for each subject, with a total of 100 yuan for two subjects and 150 yuan for three subjects), and confirm the reference. If the payment is not confirmed within the specified time, it will be deemed as an automatic waiver of registration reference.

Candidates from urban families and rural absolutely poor families who enjoy the national minimum living guarantee can reduce the written test fee. Such candidates should fill in the written test fee waiver information as required, pay the written test fee online first, and collect the returned written test fee at the examination room staff office within one hour after the written test, with the following certificates: urban family applicants who enjoy the national minimum living guarantee enjoy the minimum living guarantee certificate and low guarantee (photocopy) issued by the civil affairs department at or above the county level where their families are located, and rural absolutely poor family applicants receive the special hardship certificate and basic information file card (photocopy) issued by the poverty alleviation office at or above the county level where their families are located. If you fail to fill in the written test fee reduction and exemption as required at the time of registration, or if you fail to collect it in time at the end of the written test, you may not reduce the written test fee.

On March 30th, the registration and opening of the exam was announced on the Chongqing Leading Cadre Examination Network. The ratio of the number of plans for selecting judges' positions to the number of applicants shall not be less than 1:2, and the ratio of the number of plans for hiring other positions to the number of applicants shall not be less than 1:3. If the proportion is not reached, the number of people selected or the employment plan will be reduced accordingly. After reducing the number of candidates or the employment plan, the proportion of the examination is still not reached. There will be no examination this time, and candidates for this position can apply for other positions. If they don't apply for other positions, the written examination fee can be refunded.

From 9:00 on April 6th to 9: 00 on April 9th 17:00, candidates log in to the registration system of Chongqing Leading Cadres Examination Network to print the admission ticket (using A4 paper to ensure clear handwriting and photos). Candidates do not print the admission ticket on time as required, which affects their participation in the exam, and they are responsible for it. The admission ticket is one of the necessary documents for applicants to participate in written examination, qualification examination, professional skill test, physical fitness test and interview.

(2) written examination

The written test will be organized in Chongqing, tentatively scheduled for April 1 1 (the specific time, place and related requirements will be announced on April 6th in Chongqing leading cadre examination network and Chongqing court network, which are all below without notice).

Written test subjects and results: candidates for the position of judge are "Administrative Professional Ability Test" and "Application for Theory", each with 100; Those who apply for other positions are three subjects: administrative professional ability test, application and basic knowledge of law, each with 100. The written test does not specify the examination review book, and the scope of the "Administrative Professional Ability Test" and "Shen Lun" is subject to the "Chongqing 2009 Public Subject Examination Outline for Public Selection of Judges and Public Recruitment of Court and Procuratorate System Staff". The written test scores shall be uniformly stipulated by the Organization Department of the Municipal Party Committee when the written test results are announced. Eligible personnel will enter the next recruitment process according to a certain proportion of high scores to low scores according to the positions they apply for. If there is no qualified person in the written test of a position, the recruitment of the position will be stopped this time.

Those who pass the national unified judicial examination are exempted from taking the basic knowledge of law examination, and their scores are calculated according to the scores of all candidates. Among them, candidates who apply for the Municipal Higher People's Court, the Municipal Intermediate People's Court and Yuzhong, Jiangbei, Nan 'an, Shapingba, Jiulongpo, Yubei, Banan, Beibei, Dadukou, Wansheng, Changshou, Jiangjin, Yongchuan, Hechuan and Shuangqiao People's Courts must have legal professional qualification certificates or B certificates.

For the following two types of personnel, the written test scores will be improved by 5 points: as of July 3, 2009, college students who have served in the administrative area of Chongqing for 1 year after obtaining the service appraisal certificate, and whose service time does not exceed 1 year and pass the examination, volunteer to participate in the western (Chongqing) plan; Candidates who apply for the people's courts of Qianjiang District and Shizhu, Xiushan, Youyang and Pengshui Autonomous Counties and belong to the main local ethnic groups (the main ethnic group in Shizhu Autonomous County is Tujia, and the main ethnic groups in Qianjiang District and other autonomous counties are Tujia and Miao). The above two types of personnel shall be subject to the relevant certification materials (see "Qualification Examination" for details), and those who have more than two identities at the same time will only be awarded points once.

Exemption from the "Basic Knowledge of Law" (the score is calculated according to the scores of all candidates in this subject) and the written test score plus 5 points can be enjoyed at the same time.

Candidates fill in the application information when registering online, including exemption and bonus application. Anyone who fills in the information incorrectly will be disqualified from entering the next recruitment procedure.

The inquiry time of written test results will be notified on the day of written test.

(3) Qualification examination

The next day after the written test results are announced, the list of people who intend to enter the next recruitment process and the notice of qualification examination will be announced. Candidates who apply for the positions of appointment clerk and judicial police enter the qualification examination according to the positions they apply for, and the ratio of determining the number of employment plans according to the written test results is 1:3. Candidates who apply for judges and other staff members enter the qualification examination according to the positions they apply for, and the ratio of determining the number of transfer or employment plans according to the written test results is 1:2. If the written test scores of the last person who enters the qualification examination are tied, the tied personnel will enter the qualification examination. If the number of qualified people in the written test for this position does not reach the above ratio, it shall be determined according to the actual number.

Those who intend to enter the next recruitment procedure log in to the registration system of Chongqing Leading Cadre Examination Network, print the Qualification Examination Form for Public Selection of Judges and Public Recruitment of Court Staff in Chongqing in 2009 (printed on A4 paper to ensure clear handwriting and photos), and go to the designated place for qualification examination with the following documents and certificates within the specified time:

Graduates of full-time colleges and universities in 2009 must provide the qualification examination form signed by the school's enrollment and employment department and signed by themselves, the original and photocopy of ID card, and the original and photocopy of admission ticket; Other candidates are required to provide the qualification examination form signed by the work unit and myself (without the signature of the work unit), the original and photocopy of my ID card, the academic qualifications required for the reported position, degree certificate, and the original and photocopy of the admission ticket. Among them, candidates who have already enjoyed extra points for volunteer service in the West (Chongqing) plan must also provide a certificate issued by the Chongqing University Student Volunteer Service West Plan Project Office; Minority candidates who have enjoyed extra points must also provide the original and photocopy of the household registration book; Candidates who have enjoyed the exemption of "Basic Knowledge of Law" must also provide the original and photocopy of the corresponding legal professional qualification certificate; If there are other qualification requirements for the reported position, the corresponding certificate, original certificate and photocopy shall be provided.

If I can't take the qualification examination for some reason, I can entrust others to handle the relevant matters of the qualification examination (candidates who apply for judicial police must take the qualification examination in person), and the client must provide the original and photocopy of my ID card.

Those who have not accepted the qualification examination within the specified time or found that they do not meet the requirements of the position they are applying for, and those who have enjoyed exemption or extra points in basic legal knowledge but cannot provide valid certificates and certificates as required, will be disqualified from entering the next selection or recruitment procedure. If there is a vacancy, the next day after the first qualification examination, among the qualified personnel in the written test, fill in the list of personnel in the order of high to low written test scores. If the written test scores of the replacement personnel are tied, the tied personnel will also enter the next recruitment process. The replacement personnel shall go to the designated place for qualification examination with relevant certificates and certificates within the specified time according to the above requirements. If there is a vacancy again, fill it again according to the above method until the proportion of people who meet the next recruitment procedure is reached; If the proportion is not reached, it shall be determined according to the actual number. After the qualification examination, the list of people who will enter the next selection or recruitment process will be announced.

If a position is not qualified to inspect qualified personnel, the recruitment of this position will be stopped this time.

(4) Special post examination

1, professional skill test

Candidates who apply for the position of appointment clerk need to carry out professional skills test, which is organized in Chongqing. The specific time, place, candidates and related requirements will be notified the next day after the qualification examination. The professional skill test is written record (handwritten record), with a total score of 100. The query time of professional skills test results will be notified the next day. Candidates who enter the professional skills test after passing the qualification examination give up the exam and will not be replaced.

2. Physical fitness assessment

Candidates who apply for judicial police positions must carry out physical fitness assessment, which is organized in Chongqing. The specific time, place, candidates and related requirements will be notified the next day after the qualification examination. The physical fitness evaluation standard is implemented according to the Physical Fitness Evaluation Items and Standards for People's Police Employed by Public Security Organs (No.74 [2001]), and three of the four items are qualified if they meet the prescribed standards. If the ratio of recruitment plan 1: 2 cannot be reached due to unqualified physical fitness assessment or abandonment of assessment after passing the qualification examination, the written test scores of candidates applying for the same position will be replenished from high to low (telephone notification). The results of physical fitness assessment will be announced on the same day.

If there is no qualified person for a position, the recruitment for the position will be stopped this time.

(5) Interview

Candidates who have passed the qualification examination (candidates who apply for judicial police positions must also pass the physical fitness assessment) will enter the interview according to the position they apply for, according to the written test scores (the sum of written test scores and professional skills test scores for those who apply for the appointment system clerk position), and according to the ratio of the number of employment plans 1:2. According to the above method, if the written test scores (or the sum of written test scores and professional skills test scores) of the people who finally entered the interview are tied, all the tied people will enter the interview; Candidates who enter the interview give up the exam and will not be replaced. If it does not reach 1:2, it shall be determined according to the actual number of people.

The interview will be organized in Chongqing, and the specific time, place, candidates and related requirements will be notified on the third day after the professional skills test results are announced. Interview score 100, 60 points or above is qualified.

If there is no qualified interviewer for a position, the selection or recruitment of the position will be stopped this time.

(6) Physical examination

Among those who passed the interview, the formula for calculating the total score of applying for the position of judge is: written test score ÷2×60%+ interview score × 40%; The formula for calculating the total score of the clerk position in the appointment system is: written test score ÷3×45%+ professional skill test score × 15%+ interview score × 40%; The formula for calculating the total score of applying for other positions is: written test score ÷3×60%+ interview score ×40%). From high score to low score, the physical examination object is determined according to the ratio of the number of employment plans 1: 1. When the total score of the last person entering the medical examination is tied, the medical examination personnel shall be determined according to the order of the examination scores of "Administrative Professional Ability Test" and "Shen Lun".

The total score, physical examination time, candidates and related requirements will be announced the day after the interview.

Physical examination shall be carried out in accordance with the Notice on Printing and Distributing the General Standard for Physical Examination of Civil Servants (for Trial Implementation) (No.Y.F. [2007]113) and other regulations, and shall be organized and implemented by the Municipal Higher People's Court. Among them, those who apply for the position of judicial police shall be subject to the provisions of the Physical Examination Items and Standards for Public Security Organs to Employ People's Police (No.60 [2002]) and the Notice of the Ministry of Personnel and the Ministry of Public Security on Implementing the Height Standards for Open Recruitment of People's Police (No.76 [2006]).

Those who fail the physical examination (including height) shall be selected from the qualified interviewers who apply for the same position, and shall be replenished according to the total score from high to low. If the total score of the replacement personnel is tied, it shall be handled according to the above-mentioned method for determining the medical examination personnel. If the candidates who pass the job interview fail to pass the physical examination, the selection or recruitment of this position will be stopped this time.

(7) Evaluation

Those who pass the physical examination are listed as assessment objects. The assessment work shall be carried out in accordance with the provisions of the Interim Measures for the Employment of Staff of People's Courts and People's Procuratorates at All Levels in Chongqing.

Vacancies due to unqualified examinees will be filled by determining the physical examination objects (after passing the physical examination, they will be listed as the examination objects). If there is no substitute due to unqualified assessment, the recruitment for this position will be stopped this time.

(8) Publicity

After examination, physical examination and assessment, the personnel to be selected or hired shall be publicized by the Organization Department of the Municipal Party Committee and the Municipal Higher People's Court for 7 days. The publicity contents include name, gender, nationality, date of birth, education background, degree, major, work unit (fresh graduates are graduate institutions), legal professional qualification certificate number, volunteer service place in western (Chongqing), etc. , which proves that the applicants meet the conditions for entering the exam and the conditions for extra points and exemption, and accept social supervision.

After publicity, if it is found that it does not meet the selection or employment conditions, or there is a vacancy due to my abandonment, it will be replenished according to the method of determining the medical examination object (after passing the medical examination and assessment, it will be listed as a person to be hired for publicity). If there are no qualified personnel and no substitute personnel after publicity, the selection or recruitment of this position will be stopped this time.

(9) Mobilization and employment

1. If the publicity does not affect the selection and employment (except for applying for the position of appointment clerk), the transfer or employment procedures shall be handled according to the regulations. The elected judges are assigned corresponding job grades according to the original job grades. Other new recruits will be given a one-year probation period. Those who pass the probation period and pass the examination will be graded; Those who fail the exam will be disqualified.

2, publicity does not affect the appointment of the clerk, according to the provisions of the appointment procedures, and by the appointment of the court and the appointment of personnel to sign an employment contract. The starting time of employment shall be subject to the approval of the Organization Department of the Municipal Party Committee, with a term of three years, including a probation period of one year. After the probation period expires, those who pass the examination will be formally employed, and those who fail the examination will be disqualified. Upon the expiration of the employment period, employees shall be renewed or dismissed according to relevant regulations.

3. Those who have not obtained the required academic degree at the time of employment may extend the employment formalities appropriately, but no later than July 3, 20091day. As of July 3, 20091day, the unfinished academic degree shall be subject to the academic degree obtained. Applicants who do not meet the requirements for applying for this academic degree will be disqualified. Therefore, if there is a vacancy, it will be filled by determining the physical examination object (after passing the physical examination, assessment and publicity, the employment procedures will be handled). If there are no qualified personnel and no replacement personnel at the time of recruitment, the recruitment for this position will be stopped this time.

4. The successful candidate must have worked in the employment court for 5 years (except for the transfer approved by the organization due to work needs).

Three. any other business

Personnel employed by the Municipal Higher People's Court and the Intermediate People's Court who do not have grassroots work experience for more than two years shall be arranged by the court of the place of employment to work in the grassroots people's court for two years in a planned way.

The employed appointment clerk shall, in accordance with the Notice of the Central Organization Department, the Ministry of Personnel and the People's Court on Printing and Distributing the Administrative Measures for the Clerk of the People's Court (Trial) (No.[2003] 18 of the Central Organization Department), implement contract management and enjoy the salary and related welfare benefits of civil servants during their in-service period before the relevant provisions of the state are promulgated. During the validity period of the contract, both the employment court and the employee shall perform the provisions of the contract. After the labor contract is dissolved or terminated, the two parties dissolve the labor relationship, and the laborer no longer has the status of a staff member of the people's court and performs the duties of a clerk.
