Chapter 1 General Provisions Article 1 In order to strengthen the management of construction project bidding and bidding, standardize construction market transactions, and protect the legitimate rights and interests of bidders and bidders, according to the "Regulations on the Management of Bidding and Bidding for Construction Projects of Hunan Province" , these measures are formulated based on the actual situation of this city. Article 2 All units and individuals that conduct bidding activities for construction projects within the administrative region of this city must abide by these Measures. Article 3 The term “construction project bidding and bidding” as mentioned in these Measures refers to the construction project bidding and bidding for earthwork, civil engineering, equipment installation, pipeline and line laying, and decoration. Article 4 The construction project management departments of the municipal and county (city) people's governments are in charge of construction project bidding and bidding. The municipal and county (city) construction project bidding and bidding management agencies are responsible for the specific implementation of the daily work of construction project bidding and bidding. Their main responsibilities are: :
(1) Review the qualifications of bidding units;
(2) Review the bidding documents;
(3) Organize the review of the base bid and the bid evaluation and determination methods ;
(4) Supervise bid opening, bid evaluation, bid determination and bid negotiation, and approve bid winning notices;
(5) Supervise construction contracting, signing and performance of contract contracts;

(6) Mediate disputes in bidding and tendering activities;
(7) Reject the bidding results that violate the bidding regulations. Article 5 Construction bidding and tendering are not restricted by region or department, and the principles of openness, fairness, fair competition and merit-based bidding are adhered to. Chapter 2 Bidding Article 6 The following construction projects shall be subject to bidding:
(1) House construction with a construction area of ??more than 1,000 square meters and other civil construction projects with a project cost of more than 500,000 yuan;

(2) Equipment installation and pipeline laying projects with a project cost of more than 500,000 yuan;
(3) Decoration and earthwork projects with a project cost of more than 300,000 yuan.
Tendering is encouraged for projects below the above quota. Article 7 Whether the following construction projects require bidding shall be decided by the investors themselves:
(1) Wholly foreign-owned enterprises, domestic private investment, and overseas donations;
(2) People at or above the county level Confidentiality, emergency rescue, and disaster relief confirmed by the government;
(3) Projects of units with corresponding building construction qualification levels;
(4) Small and medium-sized water conservancy and small hydropower projects. Article 8 A construction unit shall meet the following conditions when inviting bids: (1) It is a legal person or other organization established in accordance with the law; (2) It has the economic and social background suitable for the bidding project. (3) Ability to organize the preparation of tender documents and base bids;
(4) Ability to review the qualifications of bidding units;

Construction units that do not meet the above items (2) to (5) should entrust construction project consulting, supervision and other units with corresponding qualifications to act as agents for bidding work. Article 9 Bidding units shall enjoy the following rights:
(1) Prepare bidding documents and bid evaluation and bid determination methods;
(2) Participate in the selection of qualified bidding units;< /p>
(3) Organize bidding activities;
(4) Other rights enjoyed by law. Article 10 Construction bidding for construction projects shall meet the following conditions:
(1) The construction project has been approved by the planning, land, planning and other competent departments;

(3) Drawings and technical data required for construction are available;
(4) Sources of construction funds and major equipment have been secured. Article 11 Construction bidding for construction projects may be conducted through public bidding, invitational bidding or negotiation.
In public bidding, the bidding unit shall publicly issue a bidding notice. In invitational bidding, the bidding unit shall issue a bidding invitation letter to the selected construction unit. The number of bidders shall not be less than 3. It is not suitable for public bidding and invitation bidding. For special construction projects that are highly technical, professional and have a tight construction period, more than two construction units will be selected for bid negotiation after being reviewed by the bidding management agency and reported to the construction project management department for approval. Article 12 Construction bidding for construction projects shall not be divided into separate bidding projects, except for partial projects such as basic projects, secondary decoration projects, and professional equipment installation projects that may be subject to divisional bidding due to special reasons.
Article 13 Construction bidding for construction projects shall be conducted according to the following procedures:
(1) Submit a bidding application to the bidding management agency;
(2) Prepare a bidding document in accordance with regulations, And submit it to the bidding management agency for review;
(3) The bidding unit issues a bidding notice or invitation letter;
(4) The bidding unit applies to the bidding unit for bidding;

(9) The bidding and bidding management agency shall organize a bid evaluation team together with the bidding unit;

(11) The bid evaluation team evaluates the bid, and the bidding unit determines the winning bidder based on the opinions of the bid evaluation team; The bid winning notice approved by the bidding management agency;
(13) The bidding unit signs a construction contract with the winning bidder.
