Measures of Dongguan Municipality on Gas Management (20 17)

Chapter I General Provisions Article 1 In order to strengthen the management of gas, standardize the operation order of the gas market, ensure the safety of citizens' lives and property, and promote the development of gas industry, these measures are formulated in accordance with the Regulations on the Administration of Town Gas, the Regulations on the Administration of Guangdong Gas and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the compilation of gas development planning, the construction and protection of gas facilities, gas operation and service, gas use and appliance management, emergency rescue and other related supervision and management activities within the administrative area of this Municipality.

These measures are not applicable to the production and import of natural gas and liquefied petroleum gas, the pipeline transportation of natural gas outside city gates, power generation and industrial production with gas as raw materials, and the production and use of biogas and straw gas. Article 3 The gas management in this Municipality follows the principles of overall planning, supporting construction, safety and convenience, guaranteed supply, standardized service, energy saving and high efficiency. Article 4 Urban people's governments (street offices, park management committees) shall strengthen their leadership over gas management, incorporate gas work into the national economic and social development plan, establish a coordination mechanism for gas development, and deal with major issues in gas management in a timely manner.

The municipal gas administrative department shall be responsible for the supervision and management of gas within the administrative area of this Municipality, and organize the implementation of these measures. Specifically responsible for the preparation of gas development planning within the administrative area of this Municipality, the examination and approval of gas operation and installation and maintenance license of gas burning appliances, the construction management of gas projects, the supervision and management of gas operation and use safety in conjunction with relevant departments, the delineation of the protection scope of gas facilities in conjunction with the planning administrative department and other duties that should be performed according to law. Fifth municipal development and reform, safety supervision, quality supervision, transportation, industry and commerce, public security, urban and rural planning, land and resources, food and drug supervision, environmental protection and other relevant administrative departments. Should perform their respective duties according to law, do a good job in gas management:

(a) the municipal development and reform administrative department is responsible for the examination and approval of gas supply pipe network, natural gas filling station and its supporting facilities projects in line with industrial policies and related plans;

(II) The municipal administrative department in charge of production safety supervision is responsible for the comprehensive supervision and management of production safety in the whole city, guiding, coordinating and supervising the gas safety work of the administrative department in charge of gas and relevant departments, and the people's government of the town (street offices, park management committees), and investigating and handling gas production safety accidents according to law;

(III) The municipal administrative department of quality and technical supervision is responsible for the license approval, safety supervision and management of gas pressure vessels and pressure pipelines (excluding public pipelines in the municipal gas pipeline network), liquefied petroleum gas cylinder filling units and liquefied petroleum gas cylinder inspection units, and other duties that should be performed according to law;

(IV) The municipal administrative department of transportation is responsible for the examination and approval of gas road transport and waterway transport licenses, the supervision and management of road traffic safety of gas transport vehicles, the supervision and management of gas waterway transport safety, the qualification determination of relevant personnel of gas transport enterprises, the investigation and punishment of acts of engaging in gas transport without obtaining the license for transporting dangerous goods according to law, and the investigation and punishment of illegal acts of drivers, crew members, loading and unloading managers and escorts of gas transport enterprises without professional qualifications; Highway management agencies are responsible for the approval, supervision and management of road-related construction permits for buried highway pipelines and building control areas on both sides of the highway;

(five) the municipal administrative department for Industry and commerce is responsible for investigating and dealing with the quality violations of gas burning appliances and accessories in the circulation field;

(six) the municipal public security organ is responsible for investigating and dealing with illegal storage, sale, transportation, misappropriation of gas and destruction of gas facilities that endanger public safety; Fire control institutions of public security organs are responsible for the review of fire control design documents of gas construction projects and the fire control acceptance after completion, the fire control safety inspection of gas business stations, gas business places and gas storage places, and investigate and deal with illegal acts in violation of fire control safety regulations according to law;

Other relevant departments shall, in accordance with the provisions of relevant laws, regulations and these Measures, do a good job in gas supervision and management within their respective functions and duties.

Village (neighborhood) committees shall accept the business guidance of the administrative department of gas, assist the administrative department of gas to conduct daily inspections, strengthen the publicity of gas safety, and report to the relevant departments immediately when problems are found. Article 6 The Municipal Gas Industry Association shall strengthen the self-discipline management of the industry, organize the formulation of codes of conduct and service standards for the gas industry, urge the gas operating enterprises to operate according to law, be honest and trustworthy, and promote the gas operating enterprises to improve their service quality and technical level. Article 7 This Municipality encourages citizens, legal persons and other organizations to supervise the gas industry. Units and individuals who report the illegal operation of gas, destroy gas facilities and gas safety hazards, effectively avoid major risks and recover major losses shall be rewarded in accordance with relevant regulations. Article 8 Municipal and Town People's governments (street offices, park management committees) and gas administrative departments shall regularly carry out publicity and education on gas safety, strengthen the publicity and popularization of gas safety knowledge, enhance citizens' awareness of gas safety, and improve citizens' ability to prevent and respond to gas accidents.

Gas enterprises shall provide users with a handbook on safe gas use, publicize common sense of safe gas use, equipment maintenance and emergency handling of accidents.

The realty service enterprise shall cooperate with the gas administrative department and the gas business enterprise to publicize the gas safety.

Newspapers, radio, television, internet and other news media should actively carry out public welfare propaganda on safe use of gas, gas conservation and protection of gas facilities.

Schools should carry out gas safety knowledge education in combination with educational activities.
