Measures of Xiamen Municipality on the Administration of Bidding for Construction Projects

Chapter I General Provisions Article 1 These Measures are formulated according to the actual situation of this Municipality in order to strengthen the management of bidding for construction projects, promote the healthy development of the construction market, protect the legitimate rights and interests of the parties involved in bidding, ensure the quality of construction projects and improve the investment benefit. Article 2 All bidding activities for construction projects within the administrative area of this Municipality must abide by these Measures. Article 3 The following construction projects with a construction area exceeding 654.38 million square meters or a project cost exceeding 654.38 million yuan shall be subject to construction bidding in accordance with these Measures:

Government investment;

(2) Self-raised investment by administrative and public institutions;

(3) invested by state-owned enterprises;

(4) Investment by collective economic organizations;

(five) the enterprise investment shares of more than 50% of the state-owned enterprises and collective economic organizations.

For projects other than those specified in the preceding paragraph, if the construction unit decides to conduct construction bidding and other necessary bidding as stipulated by laws and administrative regulations, these measures shall be followed.

The construction of special projects such as emergency rescue and disaster relief, security and confidentiality may not be subject to construction bidding with the approval of the Municipal People's Government. Article 4 The term "construction projects" as mentioned in these Measures refers to civil construction projects, pipeline and equipment installation projects, architectural decoration projects, landscaping projects and other new construction, reconstruction, expansion and technical transformation projects. Article 5 The responsibility system of the construction unit shall be implemented in the construction bidding. Article 6 Construction bidding shall adhere to the principles of openness, fairness, impartiality, legality, selection of the best and good faith. Article 7 The municipal administrative department of construction is the competent department of construction bidding in this Municipality, and is responsible for the supervision and management of construction bidding in this Municipality.

The district construction administrative departments shall be responsible for the supervision and management of construction bidding within their respective management authority under the business guidance of the municipal construction administrative department.

Other relevant government departments shall, within the scope of their respective duties, supervise the construction bidding activities according to law. Article 8 Bidding activities for construction projects shall be notarized by notary organs according to law. Chapter II Bidding Article 9 The bid invitation organizer shall hold the qualification certificate of the construction bidding organization.

The bid organizer mentioned in the preceding paragraph is the construction unit or a bidding agency with the qualification of construction bidding organization.

The construction unit that does not have the qualification of construction bidding organization shall entrust a bidding agency with corresponding qualifications to bid; Bidding must sign a written agency agreement. Tenth city construction administrative departments in accordance with the relevant provisions of the construction bidding organization qualification examination, meet the conditions, issued to the construction bidding organization qualification certificate.

The qualification of construction bidding agencies shall be subject to the annual inspection system. Article 11 A tender organizer shall enjoy the following rights:

(a) the preparation of tender documents, organize construction bidding activities;

(2) Selecting and determining qualified bidders;

(three) according to the principle of bid evaluation, determine the evaluation and calibration methods;

(4) Other rights enjoyed according to law. Twelfth construction project bidding shall meet the following conditions:

(a) the construction project has been formally included in the national, departmental or local annual fixed assets investment plan;

(two) the construction project construction procedures have been completed;

(three) there are construction drawings and technical data to meet the needs of construction;

(four) has received a construction project planning permit and a temporary construction permit for basic projects;

(five) the sources of construction funds and main building materials and equipment have been implemented and can meet the requirements of the contract period;

(six) the construction site of the construction project has been completed or included in the scope of construction bidding. Thirteenth construction project bidding can be adopted by project bidding, unit project bidding, special professional project bidding and other ways. However, for unit projects, except for the partial projects of foundation, secondary decoration and professional equipment, which can be subject to partial bidding for special reasons, others shall not be dismembered. Fourteenth construction project bidding can adopt the following methods:

(a) public bidding, bidding organizers through newspapers, radio, television and other means to release the tender announcement;

(2) Invitation to bid: The bid organizer shall send invitations to three or more enterprises capable of undertaking project construction, and at least three enterprises shall participate in the bidding. Fifteenth construction project bidding should be carried out according to the following procedures:

(a) to determine the organizer of the tender;

(two) the preparation of tender documents and pre-tender estimate;

(three) to apply to the municipal and district construction administrative departments for bidding, and get approval;

(four) issued a tender announcement or invitation to bid;

(five) the qualification examination of the tendering units, and notify the applicant of the examination results;

(6) Holding a bidding meeting, selling bidding documents and technical data of design drawings to qualified bidders, and organizing bidders to visit the site;

(seven) organize designers and bidders to answer questions about the bidding documents, and form written materials to distribute to bidders. Sixteenth city and district construction administrative departments to review the tender application, within 7 days from the date of receipt, to meet the provisions of Article 9, Article 12 and Article 15 (1) and (2), to be approved; Do not meet the requirements, it shall make a written reply of disapproval, and explain the reasons.
