Provisions of Guangdong Province on Mobilization and Requisition of Maritime Civil Ships

Chapter I General Provisions Article 1 In order to do a good job in the mobilization and requisition of civilian ships at sea in our province, improve the emergency support ability of mobilized civilian ships, and meet the needs of mobilization and requisition of civilian ships in wartime and under special circumstances, these provisions are formulated in accordance with the National Defense Law of People's Republic of China (PRC) and the National Defense Traffic Regulations. Article 2 The mobilization and requisition of civilian ships in the whole province must abide by these provisions.

The mobilization and requisition of civilian ships as mentioned in these Provisions refers to the activities of organizing and calling civilian ships, their equipment and operators in a unified way in wartime or under special circumstances. Article 3 Provincial, municipal and county national defense transportation authorities shall be responsible for the mobilization and requisition of civil ships in the region and perform the following duties:

(a) to guide and organize the investigation, statistics and pre-mobilization registration of civilian ships, and to establish pre-mobilization and requisition files and databases of civilian ships;

(two) to guide and inspect the implementation of mobilization and requisition preparations for civilian ships at the corresponding level, and coordinate research and solve related problems;

(three) responsible for the daily management and professional service training of civil ship mobilization and requisition;

(four) responsible for the development of civilian mobilization and requisition plan and implementation plan;

(five) to be responsible for the mobilization and requisition of civilian ships for demobilization and compensation. Article 4 Departments of maritime affairs, fisheries, transportation, finance, civil affairs and national defense economic mobilization shall, according to their respective functions and duties, cooperate with each other to jointly do a good job in mobilizing and requisitioning civil ships.

All relevant departments should cooperate closely with the military departments to ensure the completion of the mobilization and requisition of civilian ships. Article 5 The mobilization and requisition of civilian ships shall follow the principles of unified leadership, graded responsibility and combination of peacetime and wartime. Sixth national defense transportation authorities, civil ship management departments at all levels and the units where civil ships are located shall strengthen the daily management of pre-mobilization and requisition of civil ships.

Units and individuals that own civilian vessels shall fulfill their responsibilities and obligations of mobilizing and requisitioning civilian vessels according to law, and ensure that mobilized civilian vessels and their equipment are in good technical condition and that crew members have corresponding skills. Chapter II Pre-mobilization, Requisition, Registration and Training Article 7 Civil ships must be pre-mobilized and registered for requisition:

(a) seaworthy passenger ships, high-speed passenger ships (hovercraft, hydrofoil), passenger ro-ro (ferry) ships, general cargo ships, bulk carriers, ro-ro ships, multi-purpose ships, container ships, semi-submersible ships, oil tankers, bulk (liquid) chemical tankers, dredgers, piling ships, crane ships and mud (stone) barges.

(two) marine motorized fishing boats with a gross tonnage of more than 50 tons.

The above-mentioned civil ships must be registered according to relevant laws and regulations, and their crew members must also hold certificates of competency or other legal certificates issued by the maritime, fishery and other administrative authorities in People's Republic of China (PRC) (China). Ships holding the Registration Certificate for Pre-mobilization and Requisition of Civil Ships are inspected once a year. The inspection work shall be carried out by the maritime, transportation, marine and fishery departments in combination with the annual inspection of ships, or in the annual inspection of transportation licenses, ship business licenses and fishing licenses, and the inspection results shall be notified to the competent national defense transportation authorities in a timely manner. Article 9 The pre-mobilization requisition of civilian ships shall be implemented by the provincial defense transportation authorities according to the requirements, scale and system of the combat readiness professional support team, and the combat readiness formation shall be implemented according to the port of registry. Article 10 Provincial, municipal and county national defense transportation authorities shall, according to the task of pre-mobilization and requisition, work out a plan for mobilization and requisition of local civil ships in conjunction with relevant departments and units, report it to the national defense mobilization committee at the same level for examination and approval, and report it to the national defense transportation authorities at higher levels for the record.

The competent department of national defense communications shall promptly notify the units or individuals that have mobilized and requisitioned civil ships in advance of the relevant contents of the approved plan for mobilizing and requisitioning civil ships. Article 11 In case of ownership transfer, mortgage, bareboat charter and cancellation of a civil ship holding the Registration Certificate for Pre-mobilization and Requisition of Civil Ships, it shall go through the relevant registration formalities with the ship registration authority within 10 days. The ship registration authority shall notify the national defense transportation authorities of the above situation. Twelfth major transformation pre mobilization and requisition of civil ships must be reported to the local national defense transportation authorities for approval. The national defense transportation authority shall make a decision on approval or disapproval within 10 days from the date of receiving the report, and notify the reporter. Thirteenth national defense transportation authorities at all levels must organize professional training for pre-mobilized and requisitioned ships and crew. Need to carry out military knowledge training, in accordance with the requirements of the military department. Article 14 The crew members and their management commanders who hold the Registration Certificate for Pre-mobilization and Requisition of Civilian Ships must participate in relevant training and drills according to the specified time. Article 15 National defense transportation authorities at all levels and transportation, fishery and military departments shall, according to the division of labor, strengthen the guidance on civilian ship training, solve the difficulties and problems in training, and conduct regular assessments to ensure the quality. Chapter III Implementation Article 16 When the State issues a general mobilization order, a local mobilization order or there is an urgent need to mobilize and requisition civil ships, the provincial, municipal and county national defense transportation authorities shall carry out the mobilization and requisition of civil ships according to the tasks assigned by the State. Article 17 If an army unit needs a civilian ship, it shall apply to the competent national defense transportation authority in the theater according to the centralized unit determined by the theater; Armed police forces and militia organizations that need civilian boats shall apply to the local national defense transportation authorities.
