Provisions of Xiamen Municipality on the Administration of Water Conservancy Project Construction (revised 20 17)

Article 1 In order to standardize the construction procedures of water conservancy projects and strengthen the management of water conservancy projects, these Provisions are formulated in accordance with the Water Law of People's Republic of China (PRC), the Measures for the Implementation of the Water Law of Fujian Province and other laws and regulations, combined with the actual situation of this Municipality. Article 2 The water conservancy projects mentioned in these Provisions refer to various projects such as moisture prevention, flood control, drainage, irrigation, hydroelectric power generation, water diversion (water supply), soil and water conservation, water resources protection and their supporting and ancillary projects. Article 3 The municipal and district water administrative departments shall be responsible for the unified supervision and management of water conservancy projects within their respective administrative areas.

Municipal, planning, land and real estate, development and reform, finance and other relevant administrative departments shall be responsible for the management of water conservancy projects in accordance with their respective responsibilities. Article 4 The construction of water conservancy projects shall conform to the comprehensive planning of river basins and regions and related professional planning, and be coordinated with the overall land use planning, urban and rural planning and marine functional zoning.

The professional planning of water conservancy projects as mentioned in the preceding paragraph shall be compiled by the municipal water administrative department in conjunction with the relevant administrative departments, comprehensively coordinated by the municipal planning administrative department, and approved and implemented by the Municipal People's Government according to the prescribed procedures. Fifth municipal and district water administrative departments in accordance with the principle of hierarchical management, in accordance with the provisions of relevant laws and regulations of water conservancy project construction for examination and approval management.

The examination and approval management of the following water conservancy projects shall be the responsibility of the municipal water administrative department:

Water conservancy projects invested by the municipal finance and approved by the municipal development and reform administrative department;

2. Large and medium-sized water conservancy projects, such as large sluices, small (1) reservoirs, dikes above Grade III, and river mainstream control projects with a basin area of over 50 square kilometers;

Three trans-regional water conservancy projects;

Four other water conservancy projects determined by the Municipal People's government, the municipal water administrative department is responsible for the construction approval and management.

The examination and approval management of water conservancy projects other than those specified in the preceding paragraph shall be the responsibility of the district water administrative department where it is located. Sixth by the municipal water administrative department is responsible for the construction approval and management of water conservancy projects, water conservancy project departments or relevant administrative departments shall establish or clarify the project legal person before the project starts; Other water conservancy projects, conditional should also set up or clear the project legal person. The organization and staffing of the project legal person shall be commensurate with the scale, importance and technical complexity of the project undertaken.

Failing to set up a water conservancy project or clarify the project legal person as required, the municipal and district water administrative departments may report to the people's government at the same level, and the municipal and district people's governments shall instruct the project competent department or relevant departments to make corrections within a time limit.

The project legal person is responsible for the quality, progress, fund management and safety production of water conservancy projects. Seventh water conservancy projects to implement the construction drawing design document review system. Before the construction drawing design documents are put into use, the project legal person shall entrust a construction drawing review institution with corresponding qualifications for review; Emergency projects such as emergency rescue and disaster relief can also organize experts recognized by the water administrative department to form an expert group for review. The project legal person shall promptly report the review report issued by the review institution or expert group to the corresponding water administrative department for the record.

The scope of examination of construction drawings of water conservancy projects shall be determined and published by the municipal water administrative department in accordance with the relevant provisions of the state and province. Eighth in accordance with the relevant provisions of the state, province and city, the water conservancy project shall be subject to tender, and the project legal person shall conduct tender in the municipal construction engineering trading center according to law. The water administrative department shall supervise the bidding activities of water conservancy projects according to law, and investigate and deal with illegal acts in bidding activities according to law.

The preparation of bidding documents for water conservancy projects and the signing of contracts shall use the model text of bidding documents and contracts for water conservancy projects. Article 9 The municipal water administrative department shall establish a credit evaluation, credit incentive and disciplinary system for water conservancy projects. Tenth financial investment and financing construction of water conservancy project is divided into multiple projects for bidding, the project legal person can hold a single contract project put into use acceptance certificate, to the financial audit institutions for a single contract project completion audit procedures. Eleventh water conservancy projects managed according to law in this Municipality are determined by the following methods:

State-owned large sluices, small (1) reservoirs, and water conservancy projects with levees above Grade III shall be determined by the municipal water administrative department in conjunction with the municipal finance and project departments;

State-owned water conservancy projects other than those specified in the first paragraph of this article shall be determined by the local water administrative department in conjunction with the finance and project departments at the same level;

Non-state-owned water conservancy projects are determined by the owners or operators of water conservancy projects. Twelfth the following water conservancy projects shall establish or determine the management institution as the water conservancy project manager:

Small (1) reservoir;

Water conservancy projects in the main streams of Dongxixi, Houxi, Guanxun and Jiuxi;

More than three medium-sized sluices;

Levees of Grade IV and above.

Full-time or part-time management personnel shall be established for water conservancy projects other than those specified in the preceding paragraph. Thirteenth water conservancy project managers are specifically responsible for the operation, maintenance and safety management of water conservancy projects. Its duties are:

1. Formulate daily management system, and do a good job in engineering inspection, observation, recording and analysis of relevant data;

(two) maintenance of water conservancy projects, maintaining the integrity and normal operation of water conservancy facilities;

(3) Timely reporting of water regime, operation scheduling, flood control and drought relief;

In case of danger that may endanger the safety of water conservancy projects, emergency rescue and protection measures shall be taken and reported to the competent department in time;

Other duties as prescribed by laws, regulations and rules.
