Regulations of Shijiazhuang Municipality on the Administration of River Parks in Urban Areas

Chapter I General Provisions

Article 1 In order to promote the harmonious development between man and nature, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality.

Article 2 The term "urban river park" as mentioned in these Regulations refers to the landscape green space with flood discharge and disaster prevention functions, which is made up of plants, water bodies and related facilities according to the overall urban planning, relying on artificial rivers or reconstructed natural rivers, and is open to the public.

Article 3 These Regulations shall apply to the planning, construction, maintenance and management of urban river parks such as Minxin River and Taiping River within the urban area of this Municipality.

Article 4 The management of urban river parks shall follow the principles of scientific planning, unified management, rational utilization and ensuring safety.

Fifth city landscaping administrative departments in accordance with these regulations to implement unified management of urban river parks.

City planning, land resources, construction, urban management, environmental protection, public security, water conservancy, finance, price, transportation, culture, sports and other administrative departments and the relevant county (city) and District People's governments shall, according to their respective functions and duties, do a good job in the management of urban river parks.

Article 6 All units and individuals shall take good care of the facilities, water bodies and green spaces of urban river parks, maintain the order of urban river parks, and discourage or report violations of these regulations.

Article 7 The Municipal People's Government shall incorporate the funds for urban river park construction projects and management and protection funds into the municipal fiscal budget.

The municipal landscaping administrative department shall organize the construction and management of river parks through market-oriented and socialized operation.

The Municipal People's Government encourages units and individuals to participate in the development, construction and maintenance of urban river parks through donations, voluntary labor or recognition and adoption.

Chapter II Planning and Construction

Eighth city landscaping administrative departments in accordance with the overall urban planning, in conjunction with the municipal planning, land resources, water conservancy and other administrative departments to prepare a detailed construction plan for urban river parks, submitted to the Municipal People's government for approval before implementation.

The relevant departments shall solicit the opinions of the municipal landscaping administrative department in advance when preparing various plans involving urban river parks.

Article 9 For new construction, renovation and expansion projects within the red line of urban river park construction, the municipal landscaping administrative department shall prepare the project plan according to the detailed planning of urban river park construction, report it to the Municipal People's Government for examination and approval, and go through other relevant examination and approval procedures in accordance with the provisions.

Existing buildings (structures) that do not meet the detailed planning of river park construction before the red line of urban river park construction is determined shall gradually withdraw from the red line of urban river park construction.

Article 10 The design, construction and supervision units of construction projects within the red line of urban river parks shall be determined through bidding.

The design, construction and supervision of construction projects within the red line of urban river park construction shall be undertaken by units with corresponding qualifications.

Article 11 Construction and maintenance of bridges, culverts and other facilities within the red line of urban river park construction, installation of pipelines, buildings (structures) and stacking of materials shall solicit the opinions of the municipal landscaping administrative department in writing, and go through the relevant examination and approval procedures in accordance with the provisions.

Twelfth units and individuals that have been approved to carry out construction within the red line of urban river park construction shall protect the facilities and environment within the construction scope. Demolition of urban river park facilities shall be restored to the original state after the completion of the project, and shall be organized and accepted by the municipal landscaping administrative department. If it cannot be restored to its original state, it shall pay the compensation fee for the facilities. Damage to urban river park facilities shall be compensated.

Thirteenth in the red line of urban river park construction, in accordance with the principle of maintaining the landscape of river park and preventing water pollution, delimit the control zone and bring it into the scope of urban river park construction planning and management. The control zone of urban river park shall be specifically delineated by the municipal planning administrative department in conjunction with the municipal landscaping administrative department.

Fourteenth municipal administrative departments of development and reform, planning, land and resources, environmental protection, etc. shall strictly control the construction of projects that affect the landscape, overall function, surrounding environment and may cause water pollution in urban river parks.

When examining and approving the construction project planning of the control zone outside the red line of urban river park construction, if there is no detailed planning, the opinions of the municipal landscaping administrative department shall be sought in writing.

Fifteenth city river park supporting service facilities, should be adapted to the landscape, style and overall function of the river park.

The construction scheme of supporting service facilities of urban river park shall be approved by the municipal landscaping administrative department and submitted to the Municipal People's government for approval.

Chapter III Protection and Management

Sixteenth any unit or individual shall not arbitrarily change the nature of the green space within the red line of urban river park construction, and shall not occupy the green space or destroy the topography, landforms and vegetation of the green space.

Due to the adjustment of urban construction planning, if it is really necessary to requisition the green space in the red line of urban river park construction, a green space replacement scheme shall be formulated, and the municipal landscaping administrative department shall put forward opinions jointly with the administrative departments of urban planning and land resources, and with the consent of the Municipal People's government, go through the replacement examination and approval procedures in accordance with the examination and approval procedures for green space planning and construction.

Seventeenth because of urban construction or other special needs to temporarily occupy the red line of urban river park green space or cut down or trim trees, according to the provisions of the relevant examination and approval procedures.

Eighteenth urban landscaping administrative departments shall, in accordance with the principle of saving water and rationally developing water sources, formulate water use plans for urban river parks.

The recharge of urban river parks should make full use of the available surface water sources such as reclaimed water and rainwater.

Nineteenth city river park construction should meet the requirements of flood control. The municipal landscaping administrative department shall formulate a flood control plan, maintain the safe water level of the river during the flood season, timely observe the water regime, and ensure smooth drainage and flood discharge according to the dispatch of the flood control headquarters.

Article 20 To hold business activities within the red line of urban river park construction, the applicant entity or individual shall put forward an activity plan, report it to the municipal landscaping administrative department for examination and approval, and pay the fees in accordance with the relevant provisions, which shall be included in the scope of government charge management. Organizers or individuals shall strengthen management, maintain normal order and a clean and beautiful environment, and shall not pollute water bodies.

Twenty-first in the urban river park to hold non-operating activities, the application of the organization of the unit or individual, should put forward the activity plan, reported to the municipal landscaping administrative departments for approval. Large-scale activities shall be audited by the municipal public security and the municipal landscaping administrative department and reported to the Municipal People's government for approval.

Organizers or individuals shall engage in activities in accordance with the approved time limit, area and content, and shall not expand the venue, change the content and extend the time of activities without authorization.

Twenty-second archaeological excavations or ecological and biological scientific research within the red line of urban river park construction shall seek the opinions of the municipal landscaping administrative department in advance, and shall compensate for the damage caused.

Twenty-third urban landscaping administrative departments should strengthen the vegetation management and pest control in urban river parks, and keep the survival rate of trees above 95% and the preservation rate above 80%.

Article 24 The municipal landscaping administrative department shall set up boundary markers and safety warning signs in urban river parks, improve safety facilities, organize regular inspections, and repair the damage in time to ensure that the facilities are in good condition.

Twenty-fifth urban landscaping administrative departments should strengthen the management of water and water quality in river parks and conduct regular water quality testing.

The municipal landscaping administrative department shall regularly desilt, timely salvage floating objects, keep the water clean, prevent water pollution, and make the water quality meet the national standards for landscape and entertainment water quality.

Twenty-sixth city river park maintenance and management, should be through market-oriented way, bidding operation team selection.

Twenty-seventh city river park building red line prohibit the following acts:

(a) the use of trees to build or enclose trees, and the use of trees or facilities to hang and tie items;

(two) spitting, urinating and littering;

(3) damaging flowers and trees, picking flowers and fruits, collecting seeds, trampling on green land, smearing, posting and depicting buildings, facilities, trees and roads;

(four) driving and parking all kinds of vehicles in the green space without authorization, and driving and parking motor vehicles in Yonglu;

(5) Cutting grass, collecting herbs and stocking livestock and poultry;

(6) Burning garbage, leaves and other sundries;

(seven) motor vehicles enter the beach;

(8) Killing and injuring animals;

(nine) damage and move boundary markers, safety warning signs, facilities, unauthorized blasting, dredging, soil, farming;

(10) Dumping garbage and muck without authorization, setting up garbage spots and stacking materials;

(eleven) set up business stalls without authorization;

(twelve) other acts that damage the green space, facilities and environmental sanitation of urban river parks.

Twenty-eighth city river park waters prohibit the following acts:

(1) Swimming and skating;

(two) boating and other recreational activities without authorization;

(3) Washing articles that pollute water bodies;

(four) unauthorized water diversion;

(five) occupation of waters for aquaculture, fishing, fried fish, electric fish, fishing in non designated areas;

(six) throwing debris, dumping snow, garbage and waste;

(seven) the use of fish medicine, pesticides or dumping of toxic and harmful substances;

(8) discharging sewage into water bodies;

(nine) to open and close the sluice, lift the dam bag and adjust the water level without authorization;

(ten) other acts of damage and pollution of water bodies.

Twenty-ninth city landscaping administrative departments should keep the city river park clean and tidy, facilities and equipment in good condition, standardized signs, reasonable settings, and standardized management of flowers and trees.

Thirtieth city landscaping administrative departments should regularly train law enforcement personnel, the implementation of certificates. Law enforcement personnel should enforce the law in a civilized manner, be polite to others and serve warmly. [ 1]

Chapter IV Legal Liability

Thirty-first in violation of the provisions of article eleventh of this Ordinance, the municipal landscaping administrative department shall order it to stop the illegal act, restore the original state or take remedial measures, and impose a fine of more than twenty thousand yuan and fifty thousand yuan.

Thirty-second in violation of the provisions of the first paragraph of Article 16 of these regulations, the municipal landscaping administrative department shall order it to stop the illegal act, restore to its original state, and impose a fine of more than 50,000 yuan100,000 yuan, and dismantle the buildings (structures) that occupy green space within a time limit.

Article 33 Whoever, in violation of the provisions of Article 17 of these regulations, cuts down trees without approval shall be ordered by the municipal landscaping administrative department to stop the illegal act, take remedial measures or compensate for the losses, and be fined five to ten times the value of the trees cut down; Unauthorized occupation of green space, shall be ordered to stop the illegal behavior, restitution or compensation for losses, and impose a fine of five to ten times the value of green space, and the building (structure) occupying green space shall be demolished free of charge within a time limit.

Thirty-fourth in violation of the provisions of the provisions of article twentieth, the municipal landscaping administrative department shall order it to stop the illegal act, compensate for the losses caused, and impose a fine of more than two hundred yuan and two thousand yuan.

Thirty-fifth in violation of the provisions of article twenty-seventh, one of the following acts, shall be given a warning by the municipal landscaping administrative department, shall be ordered to stop the illegal act, and impose a fine:

(a) according to the tree to build or enclose trees, using trees or facilities hanging, tying things, spitting, urinating, littering, punishable by a fine of ten yuan;

(II) Damaging flowers and trees, picking flowers and fruits, collecting seeds, trampling on green spaces, smearing, posting and depicting buildings, facilities, trees and roads under construction, driving or parking all kinds of vehicles in green spaces without authorization, and driving or parking motor vehicles in Yonglu, and imposing a fine of not more than 20 yuan;

(three) mowing, collecting medicinal materials, stocking livestock and poultry, and impose a fine of ten yuan to fifty yuan;

(four) burning garbage, leaves and other debris, motor vehicles entering the beach, punishable by a fine of fifty yuan and two hundred yuan;

(5) Whoever kills or injures animals shall be fined between fifty yuan and five hundred yuan;

(six) damage, mobile boundary markers, safety warning signs and facilities, unauthorized blasting, dredging, soil, breeding, shall be ordered to restore to the original state, and impose a fine of more than 5000 yuan in 500 yuan;

(seven) unauthorized dumping of garbage, muck, set up garbage spots or stacked materials, shall be ordered to clear, and impose a fine of more than 500 yuan 10000 yuan;

(eight) without setting up business stalls, shall be ordered to clear, and impose a fine of more than one thousand yuan and ten thousand yuan.

Thirty-sixth in violation of the provisions of the provisions of article twenty-eighth, by the municipal landscaping administrative department shall be ordered to stop the illegal behavior, and were given the following penalties:

(a) swimming, skating or other recreational activities, after being discouraged, shall be fined fifty yuan;

(two) rowing without authorization, punishable by a fine of fifty yuan and two hundred yuan;

(three) washing the articles that pollute the water body, and impose a fine of not less than one hundred yuan but not more than five hundred yuan;

(four) unauthorized water diversion, according to the standard of per cubic meter 100 yuan, it is difficult to determine the amount of water diversion, and impose a fine of 5 thousand yuan from 500 yuan;

(five) the occupation of aquaculture waters, punishable by a fine of one thousand yuan and ten thousand yuan; Fishing in non-designated areas is ineffective after dissuasion, and a fine of fifty yuan is imposed; Fried fish, fried fish, electric fish, ranging from fifty yuan to five hundred yuan fine;

(six) throwing debris, punishable by a fine of fifty yuan; Dumping snow, garbage and waste, shall be ordered to clear, and impose a fine of more than 500 yuan 1 10,000 yuan;

(seven) the use of fish medicine, pesticides or dumping of toxic and harmful substances, shall be ordered to take remedial measures, and impose a fine of more than one thousand yuan to ten thousand yuan;

(eight) the discharge of sewage into the waters, punishable by a fine of one thousand yuan and twenty thousand yuan; Causing serious consequences, a fine of more than 20 thousand yuan and less than 50 thousand yuan;

(nine) to open and close the gate, lift the dam bag and adjust the water level without authorization, and impose a fine of not less than two thousand yuan but not more than twenty thousand yuan.

Thirty-seventh in violation of the provisions of this Ordinance, resulting in river park facilities and trees, green space damage or water pollution, loss, unable to restore the original state, the parties shall be liable for compensation.

Article 38 The staff of the municipal landscaping administrative department who, in violation of the provisions of Article 24 and Article 25 of these regulations, neglect their duties, abuse their powers or engage in malpractices for selfish ends in management, which does not constitute a crime, shall be given administrative sanctions by their units or higher authorities.

Chapter V Supplementary Provisions

Thirty-ninth the red line of urban river park construction as mentioned in these Regulations refers to the boundary line of urban river park determined by planning.

Article 40 These Regulations shall come into force on June 6+1October 6+1October 6, 2008. The Regulations on the Administration of Minxin River in Shijiazhuang promulgated on June 8, 2000 shall be abolished at the same time.
