Regulations of Ningxia Hui Autonomous Region on Police Auxiliary Personnel of Public Security Organs

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the relevant laws and administrative regulations and in the light of the actual situation of the autonomous region in order to standardize the management of auxiliary police personnel in public security organs, safeguard their legitimate rights and interests and give full play to their auxiliary police functions. Article 2 These Regulations shall apply to the recruitment, employment, occupational security, management and supervision of police auxiliary personnel of public security organs within the administrative area of the autonomous region. Article 3 The auxiliary police of public security organs as mentioned in these Regulations (hereinafter referred to as auxiliary police) refers to the personnel who are recruited for the society and provide auxiliary work for police activities of public security organs.

Auxiliary police are divided into civilian auxiliary police and service auxiliary police according to their post responsibilities. Article 4 The people's governments at or above the county level shall incorporate the construction of auxiliary police into the planning for the construction of the public security team, and incorporate the auxiliary police's salary and welfare, equipment and clothing, education and training, daily management and other funds into the fiscal budget at the corresponding level for protection. Fifth public security organs at or above the county level shall be responsible for the recruitment, management and use of auxiliary police in accordance with the principle of "who uses, who manages and who is responsible".

The public security organ at a higher level shall guide and supervise the management of the auxiliary police of the public security organ at a lower level. Article 6 The relevant departments of the people's governments at or above the county level shall perform the following related duties:

(a) the financial department is responsible for ensuring the funds needed for the construction of the auxiliary police team;

(two) the human resources and social security department is responsible for guiding the recruitment, wage determination and work-related injury insurance of auxiliary police;

(three) the Department of Veterans Affairs is responsible for the martyr evaluation, review and martyr pension payment of auxiliary police who meet the conditions for martyr evaluation;

(four) the medical security department is responsible for the medical insurance management of auxiliary police.

Other departments related to the management and service of auxiliary police should do a good job in corresponding management and service according to their duties. Chapter II Recruitment Article 7 The recruitment of auxiliary police shall follow the principles of openness, equality and merit, and unify the recruitment standards and procedures. Article 8 The public security organs of the autonomous region shall, jointly with the departments of establishment, finance, human resources and social security at the same level, verify the number of auxiliary police officers in the whole region and report to the people's government of the autonomous region for approval before implementation. Article 9 The public security organ at or above the county level shall put forward an auxiliary police recruitment plan within the recruitment quota, which shall be audited by the establishment, finance, human resources and social security departments at the same level, submitted to the people's government at the same level for approval, and jointly organized and implemented by the human resources and social security departments. Article 10 Personnel participating in the recruitment of auxiliary police shall meet the following conditions:

(1) Having China nationality;

(2) Abiding by the Constitution, laws and regulations;

(3) At least 18 years old;

(4) Having the educational level and qualification skills required to perform the duties of the post;

(five) physical and mental health, good conduct;

(6) Other conditions required by the public security organ.

Candidates who have the priority employment situation stipulated by the state and the autonomous region shall have priority employment under the same conditions. Eleventh any of the following circumstances, shall not be recruited as an auxiliary police:

(1) Having been subjected to criminal punishment or being investigated for suspected illegal crimes;

(2) Being under administrative detention, reeducation through labor or having a history of drug abuse;

(3) Being expelled, dismissed or dismissed by public security organs or other units for violating discipline and regulations;

(four) other circumstances that are not suitable for the work of the auxiliary police. Article 12 The public security organ shall sign a labor contract with an auxiliary police officer who has decided to be employed according to the procedures of examination, physical fitness test, physical examination, inspection and publicity. Chapter III Post Responsibilities, Rights and Obligations Article 13 The behavior of auxiliary police in performing their duties according to law shall be protected by law, and the public security organ where they work shall bear legal responsibility for the consequences of their behavior. Fourteenth civilian auxiliary police can assist the people's police in non-law enforcement positions such as administrative management, technical services and police security.

Under the command of the people's police, the service auxiliary police can assist the relevant work of law enforcement posts.

The post responsibilities of the auxiliary police shall be stipulated by the public security organs of the autonomous region according to the relevant provisions of the state and the autonomous region. Article 15 Auxiliary police officers shall enjoy the following rights:

(a) to obtain the necessary working conditions for performing their duties;

(2) Obtaining remuneration for labor according to law and enjoying the welfare and social insurance benefits stipulated by the state;

(3) Participating in on-the-job training;

(four) to put forward opinions and suggestions on the work of this unit;

(5) Dissolving the labor contract according to law;

(six) other rights stipulated by laws and regulations and agreed in the labor contract. Article 16 Auxiliary police shall perform the following obligations:

(1) Obeying the management of public security organs and the command of the people's police;

(two) study political theory and professional knowledge, improve work ability;

(3) Strictly abide by work discipline and keep secrets;

(four) be loyal to their duties and perform their duties in a civilized and standardized manner;

(five) other obligations stipulated by laws and regulations and agreed in the labor contract. Chapter IV Occupational Security Article 17 The public security organ of the autonomous region shall, jointly with the human resources, social security and finance departments at the same level, verify the salary standard of auxiliary police in the whole region and report it to the people's government of the autonomous region for approval before implementation.

The salary standard of auxiliary police is dynamically adjusted.
