Regulations of Wenzhou Municipality on Elevator Safety

Article 1 In order to strengthen elevator safety management, prevent and reduce elevator accidents, and ensure personal and property safety, these Regulations are formulated in accordance with the Law of the People's Republic of China on Safety of Special Equipment, Regulations on Safety Supervision of Special Equipment, Regulations on Safety Management of Special Equipment in Zhejiang Province and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the production (including design, manufacture, installation, renovation and maintenance), operation, use, maintenance, inspection, emergency response and safety supervision and management activities of elevators within the administrative area of this Municipality.

The elevators mentioned in these Regulations include manned (cargo) elevators, escalators and moving sidewalks. The specific scope is determined according to the catalogue of special equipment stipulated by the state. Article 3 The people's governments of cities and counties (cities, districts) shall strengthen their leadership over elevator safety work within their respective administrative areas, establish and improve the elevator safety coordination mechanism, urge all relevant departments to perform their duties according to law, and ensure the necessary funds for elevator safety supervision and management.

Township (town) people's government, neighborhood offices and development zone (park) management institutions shall strengthen supervision and inspection of elevator safety within their respective jurisdictions, and cooperate and assist relevant departments to perform their duties of elevator safety supervision and management according to law. Fourth city and county (city, district) people's government special equipment safety supervision and management department is responsible for the supervision and management of elevator safety within their respective administrative areas.

The municipal special equipment safety supervision and management department shall regularly analyze the elevator safety status, inspection and testing, emergency response and the operation of elevator safety management intelligent system, notify relevant industry departments and units, and announce elevator safety-related information to the society every year.

The competent department of construction is responsible for the supervision and management of the quality of construction projects involving elevator installation and operation, such as elevator shaft, pit, machine room and embedded guide bracket. Other relevant departments shall do a good job in elevator safety within their respective responsibilities. Article 5 The special equipment (elevator) industry association shall establish and improve the industry self-discipline mechanism, carry out industry information analysis and research, collect and publish elevator maintenance hours, maintenance quantity, prices of main parts and other information, promote the construction of industry credit system, and cooperate with and assist the special equipment safety supervision and management department and other relevant departments to do a good job in elevator safety supervision and management.

Encourage special equipment (elevator) industry associations to participate in elevator related standards formulation, credit evaluation, safety training, publicity and education, consulting services and other work. Article 6 A manned elevator shall be equipped with an intelligent monitoring device with the functions of operation parameter collection and remote network transmission, and the collected elevator operation data shall be transmitted to the municipal special equipment emergency disposal institution for real-time monitoring and analysis. The specific plan and steps shall be determined by the Municipal People's Government.

The elevators in public gathering places and residential quarters shall be equipped with video monitoring facilities. Seventh encourage and support elevator manufacturing, use management, maintenance and other units to insure elevator safety liability insurance. Eighth special equipment safety supervision and management departments should strengthen elevator safety publicity and education, popularize elevator safety knowledge, and enhance public awareness of elevator safety.

Elevator production, operation, use management, maintenance units, inspection and testing institutions should strengthen the publicity of elevator safety knowledge and guide the public to use elevators correctly.

Kindergartens and schools should take elevator safety knowledge as an important part of safety education, and cultivate the habit of safe and civilized use of elevators for children and students.

News media should publicize elevator safety laws and regulations and related knowledge. Ninth elevator management unit is the main responsibility of elevator safety management.

The elevator owner is the elevator use management unit; If the owner entrusts other units to manage, the entrusted unit is the elevator use management unit; If the owner has an agreement on the use and management of the place equipped with elevators, it shall be determined in accordance with the agreement. Tenth elevator production units shall be responsible for the safety performance of elevators, and perform the following obligations:

(a) elevator owners or other use management units in accordance with the law or in accordance with the agreement to repair or replace related parts, it should be timely maintenance and replacement;

(2) If the elevator has signs that endanger safety due to reasons such as design and manufacture, it shall immediately stop production, take the initiative to recall, inform the elevator use management unit in time, and report to the special equipment safety supervision and management department;

(three) before the elevator is put into use, provide technical training to the elevator use management unit and maintenance unit;

(four) in the process of using the elevator, there are various difficult faults such as periodic and repetitive stop of the elevator, providing technical support to the elevator use management unit and maintenance unit and assisting in troubleshooting;

(five) other obligations stipulated by laws, administrative regulations, local regulations, rules and safety technical specifications of this province.

Elevator production units shall not set up or set up technical obstacles in the elevator that affect the normal use and maintenance of the elevator in disguise.

When the whole machine sold and installed in this city is imported, the institution designated by the elevator production unit to undertake obligations in China shall fulfill the obligations stipulated in the preceding two paragraphs. Eleventh construction units shall purchase and configure elevators in accordance with relevant safety technical specifications and standards, and perform the following obligations:

(a) the special design of the embedded engineering of elevator shaft, pit, machine room and track support should meet the special requirements of building structure and elevator installation, use, leak-proof and moisture-proof of pit and cooling of machine room;

(two) the selection and configuration of elevators should adapt to the requirements of building structure and use, and meet the requirements of first aid, fire fighting and barrier-free access;

(3) Before elevator installation, design, construction, supervision, elevator installation and other units shall be organized to conduct on-site inspection of civil structures such as elevator shaft, pit, machine room and embedded guide rail support, and sign for the record; If it does not meet the requirements of elevator installation after inspection, it shall immediately organize rectification; Without rectification or rectification still does not meet the requirements of elevator installation, the elevator shall not be installed;

(four) to undertake the elevator warranty responsibility for at least two years from the date of completion and acceptance of the building.

If the special design of elevator engineering does not meet the relevant mandatory norms and standards, the construction drawing review institution shall not issue the qualification certificate for the review of construction drawing design documents.
