Measures of Jilin Province for the Administration of Appointment of Civilian Personnel in Procuratorial Organs
Article 1 In order to standardize the management of police auxiliary personnel in public security organs, give full play to the role of police auxiliary personnel in assisting public security organs to maintain social order, crack down on illegal crimes, implement administrative management and serve the people, and safeguard the legitimate rights and interests of police auxiliary personnel, these measures are formulated in accordance with relevant national laws, regulations and provisions, combined with the actual situation of this province.
Article 2 These Measures shall apply to the administration of police auxiliary personnel of public security organs within the administrative area of this province.
Article 3 The auxiliary police officers mentioned in these Measures (hereinafter referred to as auxiliary police officers) refer to those who are recruited for the society and provide auxiliary support for the daily operation and police activities of public security organs.
Auxiliary police are divided into civilian auxiliary police and service auxiliary police according to the division of responsibilities.
Auxiliary police implement a hierarchical management system.
Article 4 Auxiliary police shall carry out auxiliary police work under the command and supervision of public security organs and their people's police.
The auxiliary police's assistance to the people's police in performing their duties according to law is protected by law, and the consequences of performing their duties shall be borne by their public security organs.
Fifth people's governments at all levels should incorporate the construction of auxiliary police into the local economic and social development plan.
People's governments at all levels shall include the auxiliary police's salary and welfare, social insurance, clothing and equipment, education and training, daily management and other funds in the fiscal budget at the corresponding level.
Article 6 The public security organs of the people's governments at or above the county level shall be responsible for the recruitment, use and management of auxiliary police.
The departments of finance, human resources and social security, civil affairs and institutional establishment of the people's governments at or above the county level shall be responsible for the management of auxiliary police according to their respective responsibilities.
Chapter II Job Responsibilities
Seventh civilian auxiliary police can engage in the following auxiliary work of non-law enforcement posts of public security organs:
(a) to assist the clerical assistant, file management, wiring inquiry, window service, certificate processing, information collection and entry and other administrative work;
(two) to assist in psychological counseling, medical treatment, translation, computer network maintenance, data analysis, software research and development, security monitoring, communication guarantee, fund analysis, non-confidential financial management, laboratory analysis, on-site investigation, inspection and identification and other technical support work;
(three) to assist in the custody and maintenance of police equipment, logistics services and other police security work;
(four) other tasks that can be performed by the civilian auxiliary police.
Eighth auxiliary police officers in active service may engage in the following auxiliary work related to law enforcement posts of public security organs:
(a) To help prevent and stop illegal and criminal activities;
(two) to assist in public security patrol, public security inspection and safety inspection of personnel gathering places;
(three) to assist in the investigation, blocking, monitoring and detention of criminal suspects;
(four) to help maintain the order of cases (events), protect cases (events), and rescue the injured;
(five) to help ease traffic, discourage and correct traffic safety violations, and collect traffic violation information;
(six) to assist in the daily management of drug addicts, to inspect the enterprises of precursor chemicals, and to make public the drug investigation;
(seven) to assist in the management and supervision of public security;
(eight) to assist in the development of entry-exit management services and border inspection;
(nine) to participate in fire fighting and rescue, and to assist in fire supervision and management;
(ten) to assist in public security, traffic safety, drug control and other publicity and education;
(eleven) other tasks that can be assisted by the auxiliary police.
Ninth auxiliary police shall not engage in the following work:
(1) domestic security, technical reconnaissance, anti-cult and anti-terrorism work;
(2) Handling matters involving state secrets;
(three) the case investigation and evidence collection, issue an appraisal report, and identify the responsibility for traffic accidents;
(four) the implementation of criminal compulsory measures;
(5) Making administrative decisions;
(6) Examining cases;
(7) Keeping weapons and police equipment;
(eight) law enforcement alone;
(nine) other jobs that the auxiliary police are not allowed to engage in according to laws and regulations.
Chapter III Recruitment
Tenth people's governments at or above the county level or the public security organs of people's governments at or above the county level shall employ auxiliary police by purchasing services from social forces, signing labor contracts or employment contracts according to law.
The conclusion, performance, alteration, dissolution or termination of the auxiliary police labor contract or employment contract shall be implemented in accordance with relevant laws and regulations.
Article 11 The public security organs of the provincial people's government put forward opinions on the employment quota of auxiliary police in the whole province, which were audited by the finance, human resources and social security departments of the provincial people's government and implemented after being approved by the provincial people's government.
Article 12 The public security organ of the people's government at or above the county level shall, according to the social security situation and the level of economic development, put forward an employment plan within the quota of auxiliary police personnel, and report it to the people's government at the same level for approval after being audited by the finance, human resources and social security departments at the same level.
Thirteenth auxiliary police recruitment by the public security organs of the people's governments at or above the county level in conjunction with the human resources and social security departments at the same level unified organization and implementation, can also be independently implemented by the public security organs of the people's governments at or above the county level according to the approved employment plan.
The recruitment and use of auxiliary police by the public security organs of the people's governments at or above the county level shall be reported to the public security organs of the people's governments at the next higher level for the record.
Article 14 An auxiliary police officer shall meet the following basic requirements:
(1) Having China nationality;
(2) Upholding the Constitution and abiding by national laws;
(three) at least eighteen years of age;
(4) Having a high school education or above;
(five) have the ability to perform their duties;
(6) physical and mental health.
Civilian auxiliary police should have college education or above and professional qualifications or special skills required to perform their duties.
Fifteenth auxiliary police recruitment should follow the principles of openness, equality, competition and merit, unified recruitment standards and procedures, and accept social supervision.
The recruitment of auxiliary police should be conducted in public, by competitive selection, and implemented in accordance with procedures such as registration, examination, physical examination, inspection and publicity. With the consent of the public security organ of the people's government at the next higher level, the recruitment procedures may be appropriately simplified for positions with strong professionalism and talents in short supply.
Article 16 Under the same conditions, persons under any of the following circumstances shall be given priority in being employed as auxiliary police:
(a) retired soldiers, courageous activists and advanced individuals;
(2) graduates from public security or political and legal colleges;
(3) personnel with professional qualifications or special skills required for the post.
Article 17 A person under any of the following circumstances shall not be employed as an auxiliary police:
(1) Having received criminal punishment;
(2) Being under administrative detention, reeducation through labor, education or having a history of drug abuse;
(3) Being expelled, dismissed or dismissed by state organs, enterprises and institutions for violating discipline and regulations;
(4) Having a serious personal bad credit record;
(five) other personnel who are not suitable for police auxiliary work.
Chapter IV Occupational Safety
Eighteenth auxiliary police wages should be higher than the local minimum wage. The public security organ of the people's government at or above the county level shall, within the budget, formulate the salary standard of auxiliary police reasonably and establish a dynamic adjustment mechanism according to the local social and economic development and with reference to the local average salary of employees in the previous year, the per capita disposable income of urban residents and the payment base of basic old-age insurance.
The salary of the auxiliary police should correspond to the police rank of the auxiliary police, and the salary standard of the auxiliary police working in high-risk positions should be adapted to their work.
Article 19 The public security organs of the people's governments at or above the county level shall handle basic social insurance for the auxiliary police, such as pension, medical care, unemployment, maternity and work injury, and pay the housing accumulation fund.
Article 20 If an auxiliary police officer dies in the line of duty and meets the conditions for the evaluation of martyrs, he shall be assessed as a martyr according to law, and his family members shall enjoy the treatment stipulated in the Regulations on Commending Martyrs.
Twenty-first auxiliary police users should regularly organize auxiliary police to participate in health examination, and establish auxiliary police health records.
Article 22 The public security organs of the people's governments at or above the county level shall issue the auxiliary police with work permits and clothes that meet the requirements of the Ministry of Public Security. Auxiliary police should be well dressed.
According to the needs of the work, the auxiliary police may be equipped with necessary duty and safety protection equipment, but shall not be equipped with or use weapons.
When the auxiliary police leave their posts, they shall return the allotted work permit, clothing and equipment to the local public security organ.
Chapter V Management and Supervision
Article 23 The public security organs of the people's governments at or above the county level shall designate specialized agencies to be responsible for the management and supervision of the local auxiliary police. Auxiliary police users are responsible for the daily management of auxiliary police.
Twenty-fourth public security organs of the people's governments at or above the county level shall establish and improve the daily management system of auxiliary police, and improve the training, assessment, promotion, reward and punishment and withdrawal mechanism of auxiliary police.
Twenty-fifth public security organs of the people's governments at or above the county level shall conduct pre-job training and annual training for auxiliary police.
Twenty-sixth auxiliary police users should conduct daily assessment of the performance, discipline, education and training of auxiliary police. The public security organ of the people's government at or above the county level shall make an annual assessment of the auxiliary police with reference to the daily assessment.
The assessment results serve as the main basis for the promotion, renewal or termination of the contract of the auxiliary police, and are linked to the salary and treatment of the auxiliary police.
Article 27 The public security organs of the people's governments at or above the county level shall publicize the assessment of auxiliary police officers and the promotion of police ranks, establish a complaint acceptance and feedback system, and handle relevant complaints and reports according to law.
Twenty-eighth public security organs of the people's governments at or above the county level shall, in accordance with the relevant provisions, commend the auxiliary police for their outstanding performance, remarkable achievements and important contributions. In accordance with the provisions of the state, appropriate care shall be given to the outstanding auxiliary police who apply for the posts of the people's police of public security organs.
Chapter VI Legal Liability
Twenty-ninth public security organs and their people's police in violation of the provisions of these measures, one of the following acts, shall be punished according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
(a) Illegal recruitment and use of auxiliary police;
(two) due to improper management, the auxiliary police team is chaotic and the problem is serious.
Thirtieth auxiliary police in violation of the provisions of these measures or the disciplinary requirements of public security organs, with reference to the relevant provisions of the Regulations on Disciplinary Actions of the People's Police of Public Security Organs, give corresponding punishment or treatment; If the circumstances are serious, the employee shall be dismissed or the personnel (labor) relationship shall be dissolved according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 31 The public security organ shall punish or deal with the auxiliary police with clear facts, conclusive evidence, legal procedures and complete procedures. Auxiliary police have the right to state and defend. If the auxiliary police have any objection to the punishment or handling, it shall be handled in accordance with relevant regulations.
Chapter VII Supplementary Provisions
Thirty-second provincial people's government public security organs can formulate detailed rules for implementation according to these measures.
Article 33 These Measures shall come into force on May 20 17 1 day.
