Regulations of Sichuan Province on Management of Water Conservancy Projects (revised on 20 17)

Chapter I General Provisions Article 1 In order to strengthen the management and protection of water conservancy projects, ensure the safe operation of water conservancy projects, give full play to the comprehensive benefits of water conservancy projects, promote the construction of water ecological civilization and promote the sustainable development of economy and society, these Regulations are formulated in accordance with the provisions of People's Republic of China (PRC) Water Law and other laws and regulations, and combined with the actual situation of Sichuan Province. Article 2 These Regulations shall apply to the construction, management, utilization and protection of various water conservancy projects within the administrative area of Sichuan Province. Article 3 The management of water conservancy projects shall adhere to the principle of combining unified management with hierarchical management and combining professional management with mass management. Article 4 The local people's governments at or above the county level shall incorporate the construction, management, water conservation and water ecological protection of water conservancy projects into the national economic and social development plan of their respective administrative areas, strengthen the leadership over the management and protection of water conservancy projects, organize and coordinate relevant departments, institutions and units to do a good job in the construction, management, water conservation and water ecological protection of water conservancy projects, promote the progress of water conservancy science and technology, and ensure the safe and normal operation of water conservancy projects.

The township (town) people's government shall, in accordance with the requirements of the people's government at a higher level and its water administrative department, do a good job in the construction, management, water conservation and water ecological protection of water conservancy projects in this area. Article 5 The water administrative departments of local people's governments at or above the county level shall be responsible for the management, supervision and guidance of water conservancy projects within their respective administrative areas, and the farmland water conservancy institutions to which they belong shall be responsible for specific work.

Water conservancy project management units established according to law specifically undertake the daily management of water conservancy projects under their jurisdiction. Article 6 The development and reform, public security, finance, land and resources, environmental protection, housing and urban and rural construction, transportation, agriculture, forestry, culture, auditing, safety supervision, poverty alleviation and relocation, archives and other departments of local people's governments at or above the county level shall, according to their respective functions and duties, do a good job in the management, supervision and protection of water conservancy projects. Seventh to encourage multi-channel investment in water conservancy projects, the use of government and social capital cooperation model to carry out water conservancy project construction, management, water source protection and water ecological protection.

The water administrative department of the people's government at the county level shall, in accordance with relevant laws and regulations, clarify the relevant ownership and management responsibilities of rural collective economic organizations, water cooperation organizations and individuals for small water conservancy projects. Eighth to encourage and support the use of advanced technologies and measures in water conservancy projects, the implementation of standardization, information and modern management. Ninth all units and individuals have the obligation to protect water conservancy projects, and have the right to stop and report acts of embezzlement and damage to water conservancy projects. Tenth units and individuals who have made remarkable achievements in water conservancy project construction, management, protection, water conservation, water ecological civilization construction and water conservancy science and technology progress shall be commended and rewarded in accordance with the relevant provisions of the state and the province. Chapter II Management System Article 11 Water conservancy projects that benefit or are submerged across cities (states) shall be managed by the water administrative department of the provincial people's government, among which small and medium-sized water conservancy projects may be managed by the water administrative department of the people's government of the city (state) or county (city, district) that mainly benefits with the approval of the provincial people's government.

Within the administrative area of the same city (state), water conservancy projects that benefit or are submerged across counties (cities, districts) shall be managed by the water administrative department of the people's government of the city (state), approved by the people's government of the city (state), or managed by the water administrative department of the people's government of the county (city, district) that mainly benefits.

Water conservancy projects that benefit or are submerged in a county (city, district) shall be managed by the water administrative department of the county (city, district) people's government, among which small water conservancy projects may be managed by rural collective economic organizations, water cooperation organizations and individuals determined by the water administrative department of the county (city, district) people's government.

Large reservoir projects are managed by the water administrative department of the local people's government at or above the city (state). Article 12 The water administrative departments of the people's governments of cities (prefectures) and counties (cities, districts) shall protect all kinds of water conservancy projects within their respective administrative areas, maintain the operation order of water conservancy projects, protect the ecological safety of water, prevent and control water pollution, and investigate and punish all kinds of illegal acts that damage water conservancy projects according to law. Thirteenth water conservancy projects should be managed by setting up management units, purchasing services and determining special personnel according to the project scale and investment mode. Specific management measures shall be put forward by the water administrative department of the local people's government at or above the county level in conjunction with relevant departments in accordance with relevant state regulations and submitted to the people's government at the same level for approval. Fourteenth water conservancy project management units belong to public welfare institutions, and their funding guarantee methods shall be implemented in accordance with relevant policies and regulations. The local people's governments at or above the county level shall establish a mechanism to reasonably bear the operation and maintenance costs of water conservancy projects.

The funds needed for the operation, management, maintenance, water damage repair, supporting construction and renovation of public welfare water conservancy projects shall be included in the fiscal budget at the same level according to the affiliation of water conservancy projects, and the people's governments of the cities (prefectures) and counties (cities, districts) that benefit shall bear the corresponding funds according to the degree of benefit and be included in the fiscal budget at the same level.

For water conservancy projects with operating income, the water conservancy project management unit shall, in accordance with the relevant provisions of the state, accrue the project overhaul, depreciation and maintenance management fees in its operating income, which shall be used for special purposes. Operating income can not meet the project operation and maintenance, maintenance expenses, in accordance with the affiliation of water conservancy projects, by the people's government at the same level and the people's government of the beneficiary area to give subsidies.

Specific measures for fund management shall be formulated by local people's governments at or above the county level.

The maintenance and renovation funds of other water conservancy projects are mainly borne by the project owners and operators.
