The minimum wage standard refers to the minimum labor remuneration that the employer shall pay in accordance with the law on the premise that the employee provides normal labor within the statutory working hours or the working hours stipulated in the labor contract signed in accordance with the law. Normal labor refers to the labor that workers perform within the legal working hours or the working hours stipulated in the labor contract in accordance with the labor contract signed in accordance with the law. Workers are deemed to have provided normal labor during the period when they enjoy paid annual leave, family leave, wedding and funeral leave, childbirth (maternity) leave, birth control surgery leave and other state-stipulated leaves in accordance with the law, as well as during the period when they participate in social activities in accordance with the law during statutory working hours. The minimum wage standard applies to enterprises, private non-enterprise units, individual industrial and commercial households with employees and workers who form labor relationships with them within the territory of the People's Republic of China. Minimum wage standards are also applicable to state agencies, public institutions, social groups and workers with whom they have established labor contracts. Specifically, the minimum wage standard only applies to on-the-job employees. It does not apply to retirees, early-retirement employees, unemployed employees and laid-off employees.

Legal basis: The "Shanghai Municipal Labor Bureau" and the "Social Security Bureau" recently issued a notice that the new minimum wage standard will be implemented from July 1. By then, Shanghai's monthly minimum wage will be adjusted to 635 yuan, about 11% higher than the current 570 yuan. The new standards stipulate that starting from July 1, in addition to paying a minimum wage of 635 yuan per month, units must also pay social insurance premiums and housing provident funds paid by workers in accordance with the law. However, this does not include wages for extended legal working hours; allowances and food subsidies, transportation subsidies to and from get off work, and housing subsidies under special working environment conditions such as middle shifts, night shifts, high temperatures, low temperatures, underground, toxic and hazardous conditions.
