Article 2 These Measures shall apply to the establishment, activities, supervision and management of trade associations within the administrative area of this autonomous region. Where laws and regulations provide otherwise, such provisions shall prevail. Article 3 People's governments at or above the county level shall incorporate the development of trade associations into local social and economic development plans, and support and promote the development of trade associations. The people's governments at or above the county level shall establish a system for the government to purchase the services of trade associations. If the people's government and its relevant departments entrust trade associations to undertake relevant business work, they shall give corresponding financial subsidies; If a trade association is required to provide services, it can purchase services in a paid way. Article 4 The civil affairs departments of the people's governments at or above the county level are the registration administration organs of trade associations, and are responsible for the registration administration, annual inspection and law enforcement supervision of trade associations. The relevant departments of the people's governments at or above the county level and the organizations authorized by the people's governments at or above the county level are the competent business units of trade associations, responsible for the daily supervision and management, business guidance and normative guidance of trade associations, and other relevant departments are responsible for the management of special affairs related to trade associations. Fifth to encourage and support the formation of high-tech industries, environmental protection industries, emerging industries in line with the direction of industrial development and industry associations with local advantages and characteristics. Encourage and support industry enterprises with local industry, products and market advantages to form national industry associations according to law. Article 6 Trade associations shall hold their own meetings and implement self-discipline industry management, and their institutions, personnel, assets and finance shall be separated from state organs, enterprises and institutions. On-the-job national public officials may not work part-time in trade associations. Article 7 Trade associations shall abide by the laws, regulations and relevant policies of the state in carrying out their activities, and shall not engage in profit-making business activities or harm the interests of the state and society. Industry associations shall formulate articles of association according to the matters stipulated in the Regulations of the State Council Municipality on the Administration of Registration of Social Organizations. Trade associations carry out activities in accordance with the articles of association, and no organization or individual may illegally interfere. Industry associations shall establish and improve the grass-roots organizations of China * * * production party according to specific conditions. Article 8 Trade associations may be established according to the current national industry classification standards or according to product types, business methods, business links and service types. According to the sub-category standard of national economic industry classification or according to the operation mode and service type of each link in the industrial chain, multiple meetings in one industry can be implemented. Enterprises or other economic organizations with representative industries can initiate the establishment of cross-administrative industry associations in industries or products with concentrated enterprises and regional economic characteristics. Article 9 The promoters of trade associations must be enterprises or other economic organizations that are representative of the industry, registered in accordance with the law, hold business licenses, abide by the law in good faith, and have been operating for more than 2 years. Article 1 The name of a trade association shall specify the administrative division, reflect the business scope, and use the trade association or trade association or chamber of commerce as the suffix name. Do not use the same name as a registered social group. Article 11 The establishment, alteration and cancellation of registration of trade associations shall be implemented in accordance with the Regulations of the State Council Municipality on the Administration of Registration of Social Organizations. The Council shall have a president (chairman), a vice-president (vice-chairman), a secretary-general and several directors, who shall be elected by the members (representatives of members) general assembly. If the Secretary-General is a full-time manager of a trade association, the Council may employ him by way of recruitment. Article 14 A trade association may set up a board of supervisors or supervisors. The board of supervisors or supervisors shall be elected by the general meeting of members (members' representatives). The president (chairman), vice-president (vice-chairman), secretary-general and director of a trade association may not concurrently serve as supervisors. The board of supervisors or supervisors shall supervise the business activities and financial management of trade associations and report their work to the general meeting of members (member representatives). Supervisors may attend meetings of the Council and the Standing Council as nonvoting delegates. Article 15 Industry associations take industry representatives, industry services, industry coordination and industry self-discipline as their basic functions, reflect the demands of industries and members, communicate with people's governments and competent business units, put forward opinions and suggestions on industry development, participate in the formulation and revision of industry development plans, industry standards and industry access conditions, and promote industry development. Article 16 Trade associations shall perform the functions of industry representatives and carry out the following activities as needed:
(1) Conduct industry investigation and research;
(2) to conduct industrial collective bargaining on behalf of members of the industry;
(3) representing members of the industry or assisting people's governments and competent business units to file anti-dumping, countervailing and antitrust investigations according to law;
(4) participating in anti-dumping responding activities;
(5) Industry rights protection work.
