Regulations of Liaoning Province on Fisheries Management
Development and reform, finance, water conservancy, transportation, maritime affairs, marine police, public security, environmental protection, land and resources, quality and technical supervision, food and drug supervision and other departments shall do a good job in fishery management according to their respective responsibilities. Article 4 The people's governments of provinces, cities and counties shall incorporate fishery development into the national economic and social development plan, realize unified planning and comprehensive utilization of water beaches, guarantee the funds for fishery law enforcement, strengthen the supervision and management of aquatic products quality and safety, improve the degree of organization and scientific and technological level of fishery production, and protect fishery resources and the ecological environment of water beaches. Chapter II Aquaculture Article 5 The provincial people's government shall organize departments such as fishery, development and reform, water conservancy, transportation, land and resources. According to the marine functional zoning and the overall land use planning, the aquaculture planning of water areas and beaches shall be worked out. The municipal and county people's governments shall, according to the planning of tidal flat culture in the waters at the next higher level, organize relevant departments to prepare the planning of tidal flat culture in the waters of their respective administrative areas. Planning for aquaculture in waters and beaches shall be announced to the public.
The planning of water beach culture should adhere to the principle of ecological priority, scientifically and reasonably determine the species, scale and mode of culture according to the ecological environment and natural carrying capacity of different culture areas, and connect with the planning of environmental function zoning, drinking water source protection, soil and water conservation, port, waterway transportation and coastal water flood control.
Breeding production should develop ecological and healthy breeding and protect the ecological environment. Those that exceed the natural carrying capacity and endanger the ecosystem of wetlands and other waters and beaches should gradually withdraw. Sixth units and individuals engaged in aquaculture production using state-owned waters and beaches shall apply to the county fishery administrative department, and the county people's government shall issue a aquaculture license; If the waters and beaches cross administrative regions, the people's government at the next higher level shall issue a breeding certificate. An application for a breeding certificate shall meet the following conditions:
(a) the scope of the application for aquaculture conforms to the planning of aquaculture in waters and beaches;
(2) The variety, scale and breeding method conform to the relevant provisions of the state;
(3) Having corresponding production and operation capabilities;
(4) Other conditions stipulated by laws and regulations.
Those who contract the waters and beaches owned by rural collectives or the state-owned waters and beaches used by rural collective economic organizations to engage in aquaculture production may apply for aquaculture licenses in accordance with the provisions of the preceding paragraph after signing the contract according to law.
Units and individuals that have obtained the aquaculture license shall conduct aquaculture production in accordance with the scope, variety, scale, mode and time limit specified in the aquaculture license. The transfer or alteration of the aquaculture license shall be carried out in accordance with the provisions of the national Measures for the Certification and Registration of Aquaculture in Waters and Tidal Flat. Seventh engaged in aquaculture production should ensure the quality and safety of aquatic products, comply with the following provisions:
(a) the rational use of fishery veterinary drugs, bait, feed, feed additives and other fishery inputs, and shall not use fishery inputs that are prohibited by the state or do not meet the quality and safety standards;
(two) the safe interval or withdrawal period of fishery veterinary drugs prescribed by the state;
(three) the safe disposal of contaminated or pathogen-containing water bodies and dead aquaculture organisms, to prevent residual bait and excreta from polluting the environment and spreading diseases;
(four) to test the quality and safety of aquatic products by itself or by entrusting a qualified testing institution, and to sell them only after passing the test;
(five) other matters related to the quality and safety of aquatic products as stipulated by laws and regulations. Article 8 Personnel engaged in aquaculture production shall establish records on the production, drug use and sales of aquatic products, and truthfully record the following items, and the retention period of the records shall not be less than two years after sales:
(a) the name and production enterprise of fishery inputs;
(two) the date of use, usage and dosage of fishery inputs;
(3) The epidemic situation of aquatic animals, the occurrence and control of aquatic plant diseases and insect pests;
(four) the date of harvest or fishing of aquatic animals and plants, as well as the date of sale, sales volume and buyers. Article 9 The people's governments of provinces, cities and counties shall integrate aquatic product quality and safety testing resources, establish testing mechanisms and improve testing systems. Tenth fishery administrative departments shall formulate and organize the implementation of aquatic products quality and safety monitoring plan, conduct supervision and spot checks on units and individuals engaged in aquaculture production, and carry out risk monitoring; Announce the results of aquatic product quality and safety monitoring and environmental assessment of aquatic product producing areas to the public according to law, as well as other information related to aquatic product quality and safety.
