Measures of Pingxiang Municipality on the Administration of Electric Vehicles (for Trial Implementation)

Chapter I General Provisions Article 1 In order to strengthen the management of electric vehicles, ensure the orderly and safe road traffic, and safeguard the legitimate rights and interests of citizens, legal persons and other organizations, according to the Road Traffic Safety Law of the People's Republic of China, the Product Quality Law of People's Republic of China (PRC), the Measures for Implementing the Road Traffic Safety Law of the People's Republic of China in Jiangxi Province and the Measures for the Administration of Non-motor Vehicles in Jiangxi Province, Article 2 of these Measures refers to electric vehicles, including electric bicycles and electric vehicles with temporary traffic signs.

Electric bicycle refers to a two-wheeled bicycle that meets the compulsory national standard of electric bicycle when driving on the road.

Electric vehicles with temporary traffic signs refer to two-wheeled, low-speed three-wheeled and four-wheeled electric vehicles that were purchased before the implementation of the compulsory national standard for electric bicycles, and did not obtain the access of road motor vehicle manufacturers and products of the Ministry of Industry and Information Technology. Article 3 These Measures shall apply to the sales, registration, traffic and related management activities of electric vehicles within the administrative area of this Municipality. Fourth people's governments at or above the county level shall be responsible for the unified management of electric vehicles within their respective administrative areas.

The traffic management department of the public security organ is responsible for the registration and traffic management of electric vehicles.

The competent market supervision department is responsible for the supervision and management of the quality and sales of electric vehicle products.

The competent department of ecological environment is responsible for the supervision and management of the disposal of used batteries of electric vehicles.

Development and reform, industry and informatization, natural resources and planning, housing and urban and rural construction, transportation, postal management, Internet information management, urban management, emergency management and other relevant departments shall, within their respective functions and duties, do a good job in the management of electric vehicles. Article 5 State organs, enterprises, institutions, social organizations and other organizations within the administrative area of this Municipality shall educate their own personnel on road traffic safety, publicize the laws and regulations on the management of electric vehicles through newspapers, radio, television, internet and other media, and raise their awareness of road traffic safety. Article 6 The people's governments at or above the county level shall include the funds for the management of electric vehicles into the fiscal budget at the corresponding level and guarantee them. Chapter II Sales and Recycling Article 7 No unit or individual may commit any of the following acts:

(1) Assembling electric vehicles;

(2) Adding or modifying the power device of an electric vehicle or removing or changing the speed limiting device, and changing the technical parameters of the electric vehicle such as the model, motor model, frame number or vehicle identification number of the electric vehicle;

(3) installing a hood, a sunshade, a carriage, a seat and other devices on the electric vehicle to change the external structure of the electric vehicle;

(four) other illegal installation and modification. Article 8 A seller of electric bicycles shall publicize in a prominent position in the sales place that the products they sell conform to the national compulsory product certification catalogue; When selling, register the identity information and contact information of car buyers, issue national unified sales invoices and vouchers, and establish sales ledgers.

If the electric bicycle purchased by a consumer cannot be registered, the seller may be required to return or replace it according to law. Article 9 Operators of e-commerce platforms shall, in accordance with the provisions of consumer rights protection and e-commerce laws and regulations, verify and register the identity of sellers who apply to enter the platform to sell electric bicycles, and clarify the rights and obligations of sellers in terms of platform access and exit, quality and safety of goods and services, and protection of consumers' rights and interests.

If the operator of e-commerce platform finds that the electric bicycles sold on the platform violate relevant laws and regulations, it shall take necessary measures according to law and report to the competent market supervision department.

If the competent market supervision department finds that the platform violates relevant laws and regulations, it shall require the platform operator to take immediate measures to stop it, and the platform operator shall cooperate. Article 10 The seller of electric bicycles shall provide the service of replacing and recycling used batteries, set up a work ledger, store the used batteries according to the pollution control standards for hazardous waste storage, and hand over the recovered used batteries to the production enterprises for recycling or to the units qualified for hazardous waste disposal.

The owner, manager or maintainer of the electric bicycle shall hand over the used batteries of the electric bicycle to the seller of the electric bicycle or other units with the qualification of hazardous waste disposal, and shall not discard them at will. Chapter III Registration and Numbering Article 11 A registration system shall be implemented for electric bicycles running on roads, and non-motor vehicle number plates and registration certificates shall be issued.

For two-wheeled, low-speed three-wheeled and four-wheeled electric vehicles purchased before the implementation of the mandatory national standard for electric bicycles without obtaining the access of road motor vehicle manufacturers and products of the Ministry of Industry and Information Technology and driving on the road, a temporary pass number management system will be implemented and temporary pass signs will be issued.

Temporary traffic signs, including temporary traffic number plates and registration certificates, are valid until June 30, 2022. Article 12 To apply for registration of an electric bicycle, the vehicle shall be submitted to the traffic management department of the county (district) public security organ where the owner of the electric bicycle is located within 30 days from the date of purchase, and the following materials shall be submitted:

(a) the identity certificate of the owner of the motor vehicle;

(two) proof of the origin of the vehicle, such as the purchase invoice;

(3) Vehicle ex-factory certificate.

An electric bicycle that should be registered may temporarily run on the road with the vehicle origin certificate such as the car purchase invoice and the vehicle ex-factory qualification certificate before the expiration of the application registration period specified in the preceding paragraph.

The owner of an electric vehicle specified in the second paragraph of Article 11 of these Measures shall, within 30 days after the implementation of these Measures, apply to the traffic management department of the local county (district) public security organ for temporary traffic signs, and submit the materials required for the application in accordance with the provisions of the first paragraph of this article.
