Regulations of Ningbo Municipality on Urban Greening (revised on 20 17)

Chapter I General Provisions Article 1 In order to promote the development of urban greening, protect and improve the urban ecological environment, and build an ecological garden city, these Regulations are formulated in accordance with the Regulations of the State Council Municipality on Urban Greening and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, construction, protection and management of urban greening in urban planning areas and town planning areas of this Municipality.

The term "urban greening" as mentioned in these Regulations refers to greening activities such as planting trees, grass, flowers, seedlings and maintenance management in cities and urban planning areas.

Where there are other provisions in laws and regulations on the greening of nature reserves, scenic spots, water source protection areas, country parks, forest parks, wildlife parks, wetlands and woodlands, those provisions shall prevail.

The protection and management of ancient and famous trees shall be implemented in accordance with the relevant laws, regulations and provisions of the state and the province. Article 3 Urban greening shall follow the principles of ecological priority, local conditions, scientific planning and participation of the whole people.

Encourage and support scientific research and technology popularization of urban greening, cultivate and introduce diversified plant varieties adapted to the natural conditions and regional characteristics of this city, rationally allocate plant species and green space functions, and improve the ecological environment effect and landscape effect of urban greening.

City, county (city) people's government shall incorporate urban greening construction into the national economic and social development plan and annual plan, ensure the investment in urban greening construction, implement the target responsibility of urban greening, and improve the level of urban greening work. Article 4 The municipal urban management department is the administrative department in charge of urban greening in this Municipality, responsible for the supervision, management and guidance of urban greening in this Municipality, and its subordinate garden management agencies are responsible for the specific management of urban greening.

County (city) people's government to determine the administrative department of urban greening is responsible for the supervision, management and guidance of urban greening within their respective administrative areas.

The Town People's Government shall be responsible for the urban greening work within its administrative area within the scope of its duties.

Urban and rural planning, housing and urban and rural construction, land and resources, transportation, water conservancy, finance, public security and other administrative departments, according to their respective responsibilities, coordinate in the management of urban greening. Fifth units and individuals are encouraged to participate in the construction, protection and management of urban greening in the form of investment, donation, species recognition, adoption and management. Units or individuals who donate money, recognize construction, adopt and manage can enjoy the naming right of urban green space and trees within a certain period of time. The specific measures shall be formulated separately by the Municipal People's Government.

Encourage social organizations and volunteers to carry out urban greening service activities according to law, and guide citizens to participate in urban greening construction, protection and management. Article 6 All units and individuals have the right to enjoy a good urban greening environment, have the obligation to protect urban greening facilities and the environment, and have the right to dissuade, complain and report acts that damage or destroy urban greening.

The administrative department in charge of urban greening shall announce to the public the telephone number and other contact information for accepting complaints and reports; After receiving a complaint or report, it shall promptly investigate and deal with it, and give a written reply to the complainant or informant within ten days from the date of acceptance.

City, county (city) people's government and its relevant administrative departments shall commend and reward the units and individuals that have made remarkable achievements in urban greening work. Chapter II Greening Indicators Article 7 Urban greening planning indicators shall be implemented in accordance with the following provisions:

(a) the green coverage rate is not less than forty-five percent;

(two) the green rate is not less than thirty-eight percent;

(three) the per capita park green area is not less than twelve square meters. Eighth park green space construction, should be controlled in accordance with the following green indicators:

(a) comprehensive parks, community parks, strip parks, should be based on plant landscaping, trees and shrubs vertical projection area ratio of not less than 70% of the green area, green rate of not less than 70%;

(two) the green rate of roadside green space is not less than sixty-five percent;

(three) the green rate of characteristic parks shall conform to the park design norms stipulated by the state. Ninth production of green space should meet the needs of urban greening construction, and its land area should account for no less than 2% of the total area of urban built-up areas. Article 10 The width of protective green space shall be controlled according to the following greening indicators:

(a) each side of the urban expressway is not less than twenty-five meters;

(two) each side of the railway center line is not less than thirty meters;

(three) Yongjiang River, Yuyao River, Fenghua River embankment on each side of not less than thirty meters;

(4) If the control width of major urban landscape rivers or embankments is more than 20m, each side shall be not less than 20m; if the control width is more than15m but less than 20m, each side shall be not less than15m; if the control width is less than10m, each side shall be not less than10m;

(five) the surrounding area of the newly-built infectious disease hospital is not less than fifty meters;

(6) The surrounding area of the newly-built factory land and the dangerous goods storage land which are easy to generate harmful gases and pollution shall not be less than 50 meters, but other adjacent plots or parks of the same nature shall not be set up repeatedly, except those with explosion-proof requirements;

(seven) the width of other protective green spaces shall be implemented in accordance with the relevant provisions of the state and the province; Where there are no provisions in the state and province, the width shall be controlled according to the detailed planning of control or construction.

Because of the urban expressway, railway, river channel reconstruction (expansion) construction is really difficult to implement the protection green space index specified in the preceding paragraph, the width of protection green space can be appropriately adjusted in accordance with the conditions and procedures specified in the second and third paragraphs of Article 15 of this Ordinance, but no new (expansion) permanent buildings (structures) can be built in the control area.
