To start a nursing home, we must first draft the articles of association and have a specific place for the aged. After receiving the application, the civil affairs department at or above the county level shall review the materials, and if they meet the requirements, make a decision on approving the preparation for the record within the prescribed time limit, and notify the applicant to receive the Certificate of Approval for the Establishment of Social Welfare Institutions. After receiving the Certificate of Approval for the Establishment of Social Welfare Institutions, the applicant shall, together with relevant materials, apply to the industrial and commercial department for registration of establishment. After receiving the application, the industrial and commercial department shall examine whether it has obtained the approval of the civil affairs department for filing and whether the name meets the requirements, and grant registration and issue a business license if it meets the requirements. For nursing homes, the following conditions should be met:

1, with a fixed service place, necessary living facilities and outdoor activities;

2, in line with national fire safety, health and epidemic prevention standards, in line with the elderly and urban road building design specifications, convenient for the disabled;

3, there is a start-up fund to adapt to its service content and scale;

4. It has perfect articles of association, and the name of the institution conforms to the provisions and requirements of the registration authority;

5, there are management and service personnel to adapt to the service, medical personnel should meet the qualifications stipulated by the administrative department of health, nursing staff and staff should meet the health standards stipulated by the relevant departments. Social welfare institutions serving orphans and abandoned babies must be established by the civil affairs departments of local people's governments at or above the county level.

: When applying for the Certificate of Approval for the Establishment of Social Welfare Institutions, the following documents shall be submitted:

1, a written report on the application for the approval certificate for the establishment of social welfare institutions;

2, the civil affairs department issued by the social welfare organization approval;

3. Ownership certificate or lease contract of the service place;

4, construction, fire protection, health and epidemic prevention and other relevant departments of the acceptance report or review comments;

5, capital verification certificate and asset evaluation report;

6. Articles of association and rules and regulations;

7, management personnel, professional and technical personnel and nursing staff list and a copy of valid documents and employee health certificate;

8. Convenient and fast medical service conditions (medical service agreement or internal medical institution approval certificate can be signed with the community medical institution where the social welfare institution is located).

Legal basis: Article 7 of the Interim Measures for the Administration of Social Welfare Institutions: An organization established according to law or an individual with full capacity for civil conduct (hereinafter referred to as the applicant) may apply to the civil affairs department of the people's government at or above the county level where the social welfare institution is located in accordance with the provisions of these Measures.

Article 8 To apply for the establishment of a social welfare institution, the applicant shall submit the following materials:

(a) the application and feasibility study report;

(two) the applicant's qualification documents;

(three) the source of funds of the social welfare institution to be established;

(four) the certificate of the fixed place where the social welfare institution is to be established.

The applicant holds the above materials to apply to the civil affairs department of the people's government at or above the county level where the social welfare institution is located, and the application shall be examined and approved by the civil affairs department that accepts the application.

Organizations and individuals from Hongkong, Macao and Taiwan Province Province, overseas Chinese and foreign applicants who set up social welfare institutions in the form of joint venture or cooperation shall apply to the civil affairs department of the provincial people's government for preparation. And report to the competent foreign trade department of the provincial people's government for review.
