Regulations of Yangjiang Municipality on the Protection of Water Quality in Yang Mo River Basin

Chapter I General Provisions Article 1 In order to protect and improve the water quality of Yang Mo River Basin, prevent and control water pollution, protect water ecology, promote the construction of ecological civilization, and promote the sustainable development of economy and society, these Regulations are formulated in accordance with the Environmental Protection Law of People's Republic of China (PRC), the Law on Prevention and Control of Water Pollution of People's Republic of China (PRC) and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the water quality protection of surface water bodies and underground water bodies such as the main stream, tributaries, lakes, reservoirs and channels of Yang Mo River Basin within the administrative area of this Municipality.

The term "Yang Mo River Basin" as mentioned in these Regulations refers to the rainwater collection area that flows through the main stream and tributaries of Yang Mo in Yang Chun, Jiangcheng District and Yangdong District of this Municipality. The specific scope of the river basin shall be delineated by the Municipal People's Government and announced to the public. Article 3 The water quality protection in Yang Mo River Basin adheres to the principles of government leading, priority protection, comprehensive management and public participation. Article 4 The people's governments at all levels in the Yang Mo River Basin shall assume the responsibility of territorial management and implement a management system combining river basin management with regional management. Fully implement the four-level river (lake) length system of city, county, town and village. River (lake) chiefs at all levels are directly responsible for the protection of rivers and lakes under their jurisdiction, and are responsible for organizing and leading the management and protection of rivers and lakes under their jurisdiction.

The competent department of ecological environment of the people's governments at or above the county level shall exercise unified supervision and management over the water quality protection of the Yang Mo River Basin within their respective administrative areas.

The competent departments of water, forestry, agriculture and rural areas, sanitation and health, natural resources, finance, market supervision, development and reform, economy and informatization, housing and urban and rural construction, transportation, urban management, marine fisheries, maritime affairs, port affairs and public security of the people's governments at or above the county level shall, within the scope of their respective functions and duties, do a good job in water quality protection in the Yang Mo River Basin. Article 5 The Municipal People's Government shall establish a coordination mechanism for joint prevention and control of water quality protection and law enforcement in Yang Mo River Basin, regularly study major issues of water quality protection in Yang Mo River Basin, coordinate and handle cross-county (city, district) water pollution disputes, and solve major issues of water quality protection in Yang Mo River Basin. Article 6 The Municipal People's Government shall establish a target responsibility assessment system for water quality protection and management in Yang Mo River Basin, and incorporate the completion of water quality protection in Yang Mo River Basin into the five-year plan target assessment and annual plan target assessment of ecological environmental protection as the assessment content of the people's government and its responsible person. Article 7 The people's governments at or above the county level in Yang Mo River Basin shall formulate plans for the prevention and control of water pollution, which shall be incorporated into the plans for national economic and social development, and the protection funds shall be incorporated into the fiscal budget at the corresponding level. Article 8 The competent department of ecological environment of the people's government at or above the county level in Yang Mo River Basin shall do a good job in publicity work such as protecting the water quality of Yang Mo and preventing and controlling water pollution, so as to enhance the public's awareness of water quality protection. Ninth to encourage and support citizens, legal persons and other organizations to participate in the water quality protection of Yang Mo River Basin through voluntary service and the establishment of non-governmental environmental protection organizations. Article 10 Any unit or individual has the right to report to the competent department of ecological environment of the people's government at or above the county level the acts of polluting the water quality of the Yang Mo River Basin, and to report to the supervisory organ the acts of the people's governments at all levels and their staff who fail to perform their duties of protecting the water quality of the Yang Mo River Basin according to law.

The competent department of ecological environment of the people's government at or above the county level shall announce the telephone number, e-mail address and mailing address of the report to the public, and clarify the scope and responsibility of acceptance.

After receiving the report of water pollution in Yang Mo River Basin, the relevant functional departments shall promptly investigate and deal with it, and keep the information of informants confidential. Chapter II Protection and Prevention Article 11 The people's governments at or above the county level in Yang Mo Basin shall implement the system of drinking water source protection zones, and set up clear geographical landmarks and obvious warning signs at the boundaries of drinking water source protection zones and quasi-protection zones within the basin. Isolation facilities such as guardrails and purse seines should be set around the first-class protection area of drinking water sources.

No unit or individual may damage, alter or move geographical landmarks, warning signs or isolation facilities without authorization. Twelfth it is forbidden to build, rebuild and expand construction projects that have nothing to do with water supply facilities and water source protection in the first-class protected areas of drinking water sources. The people's governments at or above the county level shall order the demolition or closure of the construction projects that have been completed in the first-class protected areas of drinking water sources and have nothing to do with water supply facilities and water source protection, and the construction projects that have been completed in the second-class protected areas of drinking water sources and discharge pollutants.

In the drinking water source protection area of Yang Mo River Basin, it is forbidden to set up sewage outlets. In the rainwater catchment area of the reservoir with the function of drinking water source, mining, smelting, mineral processing and other mineral activities and land use changes that are not conducive to the protection of drinking water source shall not be carried out.

It is forbidden to build or expand construction projects that cause serious water pollution in the quasi-protected areas of drinking water sources; Reconstruction of construction projects, shall not increase the amount of sewage. Article 13 When constructing production and construction projects that may cause soil erosion in mountainous areas, hilly areas and other areas that are prone to soil erosion as determined in the soil and water conservation plan of Yang Mo River Basin, the production and construction units shall work out the soil and water conservation plan according to the technical specifications and standards of soil and water conservation. Report to the water administrative department of the people's government at or above the county level for examination and approval, and take measures to prevent and control soil erosion in accordance with the approved water and soil conservation plan.

The soil and water conservation plan shall include the scope, objectives, measures and investment of soil and water loss prevention and control, and the funds needed for soil and water loss prevention and control shall be included in the total investment of the project.
