Chapter 1 General Provisions

Article 1 In order to strengthen National defense construction, to ensure the smooth progress of the recruitment work, in accordance with the "National Defense Law of the People's Republic of China", the "Military Service Law of the People's Republic of China" and the "Regulations on Recruitment" and other laws and administrative regulations, combined with the actual situation of the province, this document is formulated regulations.

Article 2 These regulations shall apply to the recruitment work in peacetime within the administrative region of this province. Recruitment during wartime shall be carried out in accordance with the orders of the State Council, the Central Military Commission and relevant national regulations.

Agencies, groups, enterprises, institutions, other organizations and citizens within the administrative region of this province, as well as personnel receiving (leading) troops, shall abide by these regulations.

Article 3 It is the sacred duty of every citizen to defend the motherland and resist aggression, and it is the honorable duty of every citizen to perform military service in accordance with the law.

Recruiting new soldiers is an important task in strengthening military construction and consolidating national defense. It is the common responsibility of the whole society.

Article 4 The provincial military region, military division (garrison area) and county (city, district) People’s Armed Forces Department shall also serve as the military service agency of the people’s government at the corresponding level, under the leadership of the superior military agency and the people’s government at the same level. , responsible for handling military service in this region.

Local people's governments at or above the county level shall organize military service agencies and publicity, education, public security, civil affairs, transportation, human resources and social security, health and family planning and other departments to form a recruitment office to be responsible for the recruitment work in their region.

Township people's governments, sub-district offices and agencies, groups, enterprises and institutions are responsible for the recruitment of soldiers in their own regions and units according to the arrangements and requirements of the county (city, district) people's government and military service agencies at the same level. Work.

The recruitment work of ordinary colleges and universities is under the centralized management of the military service agency in the county (city, district) where it is located. If the main campus and branch campuses of ordinary colleges and universities are not in the same county (city, district), the recruitment work shall be managed by the city or county with districts. The (municipal, district) military service agency shall determine this in conjunction with ordinary colleges and universities.

Article 5 The number, scope, time and requirements for the annual recruitment of conscripts in the province shall be determined by the Provincial People's Government and the Provincial Military Region in accordance with the recruitment orders of the State Council and the Central Military Commission.

The allocation of tasks for recruiting conscripts should be determined based on the number and quality of the local registered population and citizens of appropriate age, as well as the production and living conditions of the masses, and in accordance with the principles of overall planning and balanced burdens.

Local people's governments at all levels and military service agencies should implement recruitment orders and other relevant regulations, complete recruitment tasks, and ensure the quality of recruits. Cities and counties (cities, districts) divided into districts that really have difficulty in completing the recruitment tasks can apply to the recruitment office of the people's government at the next higher level, which will make adjustments within the region. The preferential treatment and resettlement funds required to adjust the recruitment indicators shall be borne by the place of transfer. The procedures are handled by the place of transfer.

Non-commissioned officers are recruited directly from non-military departments. The number, major, time, etc. are determined according to the recruitment plan issued by the General Staff Headquarters, and are organized and implemented by the Provincial People's Government Recruitment Office.

Article 6 Local people's governments at all levels shall include recruitment publicity and education into patriotism education, national defense education and legal publicity and education plans, and make it a part of assessment and evaluation.

Agencies, groups, enterprises, institutions and other organizations should strengthen the publicity and education of citizens’ national defense education and military service laws and regulations, cultivate citizens’ patriotism, enhance citizens’ awareness of national defense and perform military service in accordance with the law. concept.

Media and communication operators such as radio, television, newspapers, and the Internet should proactively carry out public welfare recruitment publicity and broadcast public service advertisements free of charge.

Article 7 Local people's governments at or above the county level shall include funds for military conscription and military service registration in their fiscal budgets.

The provincial people's government allocates recruitment funds based on the recruitment tasks of the year, and the deficient portion is guaranteed by the people's governments of cities and counties (cities, districts) divided into districts.

Funds for military recruitment and military service registration are managed by the military recruitment offices of local people's governments at or above the county level, and are earmarked for special use. They are subject to the supervision of higher-level military service agencies and the financial and auditing departments at the same level.

The funds required by ordinary colleges and universities to carry out military recruitment work shall be included in the fiscal budget to ensure it.

The methods for raising preferential treatment for families of conscripts and one-time economic subsidies for self-employment of retired soldiers shall be implemented in accordance with relevant provincial regulations.

Article 8 Active military personnel and their families should be respected by the entire society. Local people's governments at all levels should carry out various forms of activities to support the military and give priority to their families. Encourage social organizations and individuals to participate in supporting military personnel and providing preferential treatment to military personnel, and provide funding for military personnel’s pensions and preferential treatment.

Active duty military personnel and their families enjoy preferential treatment stipulated by the state and the province.

Article 9 encourages citizens of appropriate age to serve in the military in difficult areas such as Tibet. The people's government of the county (city, district) where the recruitment is conducted shall, in accordance with regulations, increase the preferential treatment standards for soldiers serving in the military in difficult areas such as Tibet.

Soldiers who perform military service in difficult areas such as Tibet due to work transfers, troop relocation, etc., shall be given preferential treatment in accordance with the provisions of the preceding paragraph.

Article 10: Local people's governments at all levels should regard military recruitment as an important part of the evaluation of dual support and the performance evaluation of leading cadres. Commendations and rewards will be given to units and individuals who have made outstanding achievements in the recruitment work; units and individuals who fail to complete the recruitment tasks or have the responsibility to withdraw from the army will be held accountable.

Chapter 2 Military Service Registration

Article 11 The county (city, district) military service agency is responsible for the military service registration work in its region.

Township people’s governments, sub-district offices and units that have established grassroots people’s armed forces departments, as well as units determined by county (city, district) military service authorities, are responsible for the specific military service registration work in their respective regions and units.

Article 12 The unit that handles military service registration work shall, in accordance with the requirements of the county (city, district) military service agency, notify and notify in writing the citizens of the appropriate age in the region or unit to complete the military service registration procedures on time, and in When the military service registration work is completed, the military service registration results shall be truthfully reported to the county (city, district) military service agency.

The public security police station shall provide the list of eligible citizens in the area and other relevant information according to the requirements of the county (city, district) military service agency.

Article 13 Citizens of military age shall register for military service before June 30 of that year in accordance with the requirements notified by the county (city, district) military service agency.

When citizens of military age log on to the official national recruitment website to register for military service, the military service agency and the unit that handles military service registration should provide guidance and assistance.

When citizens of appropriate age register for military service, their units shall be deemed to be on duty.

Article 14 This province implements a military service certificate system for citizens of appropriate age.

The unit that handles military service registration shall issue military service certificates to citizens of military service age who have registered for military service, and shall truthfully record on the military service certificates whether the citizens of military age have applied for military service, been deferred, exempted from military service, not required to be drafted, or have been drafted.

The military service certificate is formulated by the provincial military service agency and printed by the districted city military service agency. Military service certificates may not be lent, altered, forged or altered.

Article 15 Citizens of appropriate age who hold military service certificates shall abide by the following regulations:

(1) Keep the military service certificate properly. If it is lost, apply to the issuing unit for a replacement in a timely manner. ;

(2) Within the time limit specified each year, in accordance with the requirements of the military service authority, bring the military service certificate to the military service registration point and perform review procedures;

(3) Change the place of household registration or work If the unit is a unit, it shall go to the unit responsible for military service registration at the location after the change within thirty days from the date of change to go through the change registration procedures.

Article 16 Departments and units such as human resources and social security, education, entry and exit administration, industry and commerce, etc., when hiring civil servants, enrolling new students, recruiting workers, handling exit procedures or industrial and commercial business licenses, shall prompt the appropriate age Citizens fulfill their obligation to register for military service.

Article 17 County (city, district) military service agencies and grassroots units shall select a specified number of pre-conscription candidates through military service registration, and strengthen management, education and inspection.

If the subject of pre-recruitment has left the county (city, district) where the household registration is for more than 30 days, he shall report his whereabouts and contact details to the local villagers committee, residents' committee or the grassroots people's armed forces department within 15 days after leaving. Chapter 3 Physical Examination, Political Assessment and Visits and Investigations

Article 18 The recruitment office of the local people’s government at or above the county level shall uniformly organize and coordinate the physical examination, political assessment and interviews and investigations for conscripts .

The visit and investigation will be conducted simultaneously with the political assessment after the citizen candidates pass the physical examination, and will be completed before the recruits are approved.

Article 19: The health and family planning department is responsible for conducting physical examinations for conscripts, the public security organs, grassroots units, and colleges and universities are responsible for conducting political assessments for conscription, and the township people's governments, sub-district offices, and colleges and universities are responsible for conducting interviews and surveys. .

Provincial and districted city health and family planning departments and public security organs should formulate physical examination and political assessment work plans, train staff, and inspect and guide county (city, district) military recruitment physical examination and political assessment work.

County (city, district) health and family planning departments, public security organs, relevant grassroots units, and ordinary colleges and universities shall, in accordance with the unified arrangements of the local people's government recruitment office, allocate staff to conduct recruitment physical examinations, political assessments and Visit and survey work.

Article 20 The political assessment of fresh graduates and current students from ordinary institutions of higher learning shall be the responsibility of the public security organs of the counties (cities, districts) where the recruitment is conducted and the ordinary institutions of higher learning where the students are located.

For freshmen who have been admitted to ordinary colleges and universities and apply for recruitment at the location of the school, their political assessment shall be carried out by the county (city, district) public security agency of the place of household registration or habitual residence before admission.

Article 21 The recruitment office of the local people's government at or above the county level shall organize political reviews in accordance with regulations, and conduct random inspections of the physical review of conditional soldiers and the quality of physical examinations of ordinary soldiers.

Article 22 A job responsibility system shall be implemented for recruitment physical examinations, political assessments, and interviews and investigations. Staff members must strictly implement relevant regulations and standards to ensure the quality of recruits.

Article 23. Personnel selected to participate in conscription physical examination, political assessment, and visit and investigation shall be given the same treatment as on-duty personnel at the same level by their units during the period of conscription physical examination, political assessment, and visit and investigation. treatment.

When citizens who are drafted participate in the physical examination, cooperate with the political assessment and visit the investigation, their unit shall be regarded as attendance, and their wages, bonuses and benefits shall not be deducted, and the labor relationship shall not be terminated.

Chapter 4 Review and Approval of Recruits

Article 24 The review and approval of new recruits shall adhere to grassroots recommendation, collective deliberation, and merit-based approval, and be fair, open, and fair.

Article 25 Approval of new recruits shall be recommended by the township people’s government, sub-district offices and units that establish grassroots people’s armed forces departments through preliminary review, and shall be reviewed and approved by the recruitment office of the county (city, district) people’s government.

Article 26 When reviewing recruits, the county (city, district) people's government recruitment office shall conduct a comprehensive evaluation of the citizens who have passed the physical examination and political assessment, and select the best soldiers.

Graduates and current students from ordinary colleges and universities who meet the recruitment requirements will be given priority to be approved for enlistment.

Article 27. Fresh graduates and current students from ordinary colleges and universities who meet the recruitment conditions and apply for recruitment from the school shall be approved by the recruitment office of the people's government of the county (city, district) where the school is located to enlist; Those who apply for recruitment in the place where their household registration is located shall be approved by the recruitment office of the people's government of the county (city, district) where their household registration is located before enrollment.

Article 28 The county (city, district) people’s government recruitment office, the township people’s government, the sub-district office and the units that establish grassroots people’s armed forces departments shall combine the physical examination, political examination and The lists of citizens who have passed the assessment, the scheduled recruits recommended by the preliminary review, and the recruits approved to join the army will be announced and will be subject to social supervision.

Article 29 Before the recruitment of new recruits, the recruitment office of the county (city, district) people's government shall, in accordance with regulations, organize a physical review and political review of the new recruits approved to join the army, and those who fail shall be promptly dismissed Swap.

Chapter 5 Handover, Transportation of Recruits and Acceptance of Retired Troops

Article 30 The recruitment offices of the people’s governments of cities divided into districts and counties (cities, districts) shall follow the prescribed time and requirements Complete the handover and transportation of new recruits.

Article 31 The handover of recruits can be carried out by having the county (city, district) people's government recruitment office send someone to deliver the soldiers, the recruits reporting to the army themselves, or the army sending someone to pick up (lead) the soldiers. .

If the army sends people to pick up (lead) the soldiers, the county (city, district) people's government recruitment office shall meet with the recruiting (lead) unit at its location or other convenient transportation location one day before the recruits are shipped. Handle the handover procedures for new recruits and assist the receiving (leading) unit in managing new recruits.

Article 32 If the army sends people to pick up (lead) soldiers and if the county (city, district) people's government recruitment office sends people to send soldiers, the recruitment office of the local people's government at or above the county level shall draft a draft in accordance with regulations Plan for the transportation of new recruits and submit it to superiors for approval. The transportation department should allocate transportation vehicles in a timely manner according to the recruit transportation plan to ensure that the recruits arrive at the unit safely and on time.

Recruiting (leading) troops may not change the recruit transportation plan without approval from the Provincial People’s Government Recruitment Office, and may not arrange their own transportation to transport recruits.

Article 33. Recruits who are returned after quarantine and reexamination by the army and are found to be physically and politically unfit for active service in the army shall be reexamined by the recruitment office of the districted municipal people’s government in accordance with relevant regulations. . For those who meet the conditions for withdrawal, the recruitment office of the people's government of the districted city shall handle the withdrawal procedures, notify the recruitment office of the people's government of the county (city, district) where the original recruitment was made, take them back, cancel their enlistment procedures, and the public security organs shall settle them. For those who were employees of government agencies, groups, enterprises and institutions, their original units should allow them to resume work and resume their duties; for those who were students of ordinary colleges and universities, the school that retains their student status should allow them to resume their studies in accordance with relevant regulations.

Chapter 6 Preferential Treatment and Placement

Article 34 During the period of active service of conscripts, their families shall enjoy preferential treatment from the local people's government.

The preferential allowance for families of conscripts is issued by the people's government of the place where they are approved to join the army, and the specific standards are formulated by the county (city, district) people's government in accordance with the relevant regulations of the provincial people's government.

Article 35 In addition to the preferential treatment stipulated in the "Military Service Law of the People's Republic of China", "Regulations on Military Pensions and Preferential Treatments" and "Regulations on the Placement of Retired Soldiers", soldiers also enjoy the following preferential treatment:< /p>

(1) When expropriating, compensating and resettling, the number of people in the family should be included; shall enjoy the same treatment as other citizens in the original place of residence; during active service, except for paying relevant taxes and fees in accordance with relevant national regulations and the contract agreement, they shall be exempted from other burdens;

(3) In-service employees If a person is drafted into the army, his/her original unit shall pay him/her full wages, bonuses and various subsidies for the month he/she joins the army before joining the army. The term of the original labor contract shall be extended accordingly according to the period of service, unless the person proposes to terminate or terminate the labor relationship;

(5) During disaster relief and poverty alleviation, give priority to the families of soldiers under the same conditions;

(6) Village committees or collective economic organizations raise funds from their members in accordance with legal provisions in order to develop production or establish public welfare undertakings Those who raise labor should take care of the families of soldiers and reduce their burdens;

(7) If conscripts retire from active service and apply for civil servants or positions in public institutions, their years of active service will be counted as seniority, and their service experience will be regarded as grassroots work experience. ;

(8) Other preferential treatment stipulated by the state and province.

Article 36 During the period of compulsory military service for ordinary college graduates and current students who enlist in the army from this province, the people's government of the county (city, district) that approved the enlistment shall issue bonuses according to the following proportions every year: < /p>

(1) The preferential treatment for the families of conscripts in counties (cities, districts) approved for enlistment shall not be less than 40% for college students, and not less than 50% for those who have graduated;

(2) The preferential allowance for families of conscripts in counties (cities, districts) approved for enlistment shall not be less than 50% for students with a bachelor's degree or above, and not less than 60% for those who have graduated.

Article 37 If a conscript obtains an honorary title, performs meritorious service or receives an award during his active service, the people's government of the county (city, district) that approved his enlistment shall issue a reward for meritorious service:

( 1) Those who are awarded first-class merit and are awarded honorary titles by the military region or above shall be paid at a rate of no less than 50% of the preferential payment standard for that year;

(3) For those who are awarded third-class merit, the amount will be paid at a rate of not less than 20% of the current year’s preferential allowance standard; < /p>

Article 38: Local people's governments at or above the county level shall, in accordance with relevant national and provincial regulations, resettle retired soldiers from active service through multiple channels and in various forms.

Agencies, groups, enterprises and institutions have the obligation to accept and resettle retired soldiers who meet the working conditions and should accept the resettlement tasks assigned by the local people's government.

Corresponding preferential policies should be formulated for civil servant recruitment to recruit qualified retired soldiers. When recruiting personnel, public institutions will give priority to retired soldiers under the same conditions. When enrolling students in ordinary colleges and universities and recruiting personnel in state-owned enterprises, a certain proportion will be determined for targeted enrollment or recruitment based on the quota and position conditions, as well as the specific circumstances of eligible retired soldiers. When recruiting full-time people's armed cadres at the grassroots level, priority will be given to recruiting retired soldiers who meet the job requirements.

Encourage enterprises to hire self-employed retired soldiers. Enterprises that accept and place retired soldiers shall enjoy preferential tax policies in accordance with relevant national regulations.

Article 39 After the compulsory soldiers retire, the people's government of the county (city, district) where they approved their enlistment will be granted a one-time economic subsidy for self-employment. Retired non-commissioned officers who are self-employed shall count from the year when they are re-elected as non-commissioned officers, and shall increase accordingly according to their years of active service. Specific standards shall be determined by the Provincial People's Government.

Article 40 Soldiers who retire from active service and find their own jobs shall enjoy the following preferential treatment:

(1) Receive vocational education and skills training organized by the local people’s government for free, and enjoy academic education subsidies; Those who pass the examination will be issued corresponding academic certificates and vocational qualification certificates, and recommended for employment;

(2) Military age is regarded as the number of years of social insurance payment, and will be calculated together with the actual number of years of payment;

(3) Those engaged in self-employment shall enjoy tax exemptions, small-amount guaranteed loans, entrepreneurship support and other policies in accordance with regulations;

(4) Other preferential treatment stipulated by the state and the province.

Article 41 If a person has been admitted to a regular institution of higher learning or is a student of a regular institution of higher learning before enlisting in the army, the school shall retain his student status until two years after retirement. If students request to enroll or resume school after retiring, the school they originally attended shall allow them to enroll or resume school, and enjoy the following preferential treatment:

(1) Freshmen and current students of ordinary colleges and universities who enlisted in the army from this province shall enroll or resume school. The tuition, miscellaneous fees, accommodation fees, and living allowances for the remaining academic period shall be borne by the government, and the people's government of the county (city, district) where the enlistment is approved will provide financial subsidies in accordance with the one-time economic subsidy standard for self-employment of local retired soldiers. Article 42 During the period when retired soldiers who meet the conditions for work arrangement are waiting to be arranged for work, the people's government of the place of resettlement will provide them with living allowances on a monthly basis in accordance with a standard that is not lower than the local minimum living standard. Specific standards are determined by the local people's government.

Chapter 7 Legal Responsibilities

Article 43 If a citizen who is obliged to perform military service commits any of the following acts, the county (city, district) people's government shall order him to make corrections within a time limit; If he fails to make corrections within the time limit, he will be forced to perform his military service obligations and may be fined not less than two times but not more than eight times the local standard of preferential treatment for family members of conscripts that year:

(1) Refusing or evading military service registration and physical examination;< /p>

(2) Concealing the true situation and committing fraud during recruitment physical examinations, political assessments and interviews and surveys; (3) Conscripted citizens refusing or evading recruitment.

Anyone who commits the third act of the preceding paragraph and refuses to make corrections shall not be employed as a civil servant, an employee of a public institution or a state-owned enterprise, or a staff member managed in accordance with the Civil Servant Law, and shall not go abroad or further study within two years.

Article 44: If someone evades military service after joining the army, causing serious consequences, and is ruled by the military service agency to be discharged or removed from the army, the county (city, district) people's government shall cancel the military treatment of his family members , all preferential treatment payments will be confiscated; the relevant units will not allow them to resume work, resume work, or return to school; they will not be employed as civil servants or staff members managed in accordance with the Civil Servant Law, and they will not be allowed to go abroad within two years. Article 45 Anyone who violates the provisions of these regulations by lending, altering, forging or altering a military service certificate shall be fined not less than RMB 1,000 but not more than RMB 5,000 by the county (city, district) people's government.

Article 46 If a relevant unit commits any of the following acts, the local people's government at or above the county level shall order it to make corrections within a time limit; if it fails to make corrections within the time limit, it shall be fined not less than 20,000 yuan but not more than 100,000 yuan; The directly responsible person in charge and other directly responsible personnel may be fined not less than RMB 2,000 but not more than RMB 20,000:

(1) Those who refuse to accept or fail to complete recruitment tasks in accordance with regulations;

(2) Refusing to cooperate with relevant units in conducting military service registration, political assessment, and physical examination of citizens of appropriate age;

(3) Obstructing citizens of appropriate age from participating in military service registration, physical examination, or enlistment; < /p>

(4) Concealing the true situation, committing fraud, or using other means to protect citizens who are applying for military service and refusing or evading recruitment;

(5) Knowing that they have not registered for military service, refusing or evading recruitment or enlisting in the army Those who later evade military service and are discharged from the army or expelled from the army still go through the procedures for leaving the country (border), recruiting, enrolling, returning to work, returning to work, and returning to school.

Article 48 If the relevant unit violates the provisions of these Regulations and refuses to accept the resettlement tasks for retired soldiers assigned by the local people's government, the local people's government's department in charge of the resettlement of retired soldiers shall order it to make corrections within a time limit; if it fails to make corrections within the time limit, If any, the principal persons in charge and directly responsible personnel of agencies, groups, and institutions shall be punished in accordance with the law, and the enterprise shall be fined an amount equal to the number of retired soldiers involved multiplied by ten times the average salary of local urban employees in the previous year, and the receiving unit and its principal personnel shall be fined. Article 49 If any recruitment staff abuses their power, neglects their duties, engages in malpractice for personal gain, or accepts bribes, they shall be punished by their unit; if a crime is constituted, criminal responsibility shall be pursued in accordance with the law.

If a member of the army receiving (leading) troops violates the laws and regulations on recruitment, the recruitment office of the local people's government at or above the county level will report the situation to the unit where he/she is located for handling.

Article 50 Anyone who commits any of the following acts, which constitutes a violation of public security management, shall be punished by the public security organs in accordance with the law; if it constitutes a crime, criminal liability shall be pursued in accordance with the law:

(1) Obstructing military recruitment personnel from performing official duties in accordance with the law;

(2) Using methods such as beating and restricting personal freedom to prevent citizens from participating in military service registration, physical examinations or enlisting in the army;

(3) Other behaviors that disrupt the order of recruitment work.

Article 51 Administrative penalties imposed by local people's governments at or above the county level in accordance with these regulations shall be handled specifically by the military service agencies at or above the county level in conjunction with the public security, civil affairs, health and family planning, education, human resources and social security departments. .

Article 52 If the county (city, district) people's government imposes administrative penalties on citizens in accordance with the provisions of Articles 43 and 44 of these regulations, the county (city, district) military service Agencies should provide the public credit information system with information on citizens subject to administrative penalties.

Chapter 8 Supplementary Provisions

Article 53 The term “age citizens” as mentioned in these Regulations refers to those who are between the ages of 18 and 24 before December 31 of the current year. 1 year old male citizen. Recruiting female citizens for active service shall be carried out in accordance with relevant national regulations.

Article 54 The term "general colleges and universities" as mentioned in these regulations refers to full-time public colleges and universities, private colleges and universities and independent colleges that are approved to be established and implement higher education in accordance with relevant national regulations.

Article 55 The recruitment of non-commissioned officers shall be organized and implemented in accordance with relevant national and provincial regulations.

The specific recruitment methods for graduates and current students of senior technical schools and technical colleges, such as registration, physical examination, political assessment, approval and recruitment, etc., shall be implemented with reference to ordinary colleges and universities.

Article 56 These Regulations shall come into effect on August 1, 2015. The "Jiangsu Province Military Recruitment" was adopted at the 17th meeting of the Standing Committee of the 8th Jiangsu Provincial People's Congress on October 19, 1995 and revised at the 18th meeting of the 10th Standing Committee of the 10th Jiangsu Provincial People's Congress on September 23, 2005.
