Regulations of Inner Mongolia Autonomous Region on Forest Management

Chapter I General Provisions Article 1 In order to protect, cultivate and rationally utilize forest resources, speed up greening, give full play to various benefits of forests, and meet the needs of socialist construction and people's life, these Regulations are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on Regional National Autonomy and the Forest Law of People's Republic of China (PRC), and in light of the actual situation of the autonomous region. Second in the autonomous region engaged in forest harvesting, cultivation, planting and management activities, must abide by these regulations. Article 3 Forests, trees and woodlands within the autonomous region shall be owned by the whole people and collectively.

Forests, trees and woodlands owned by the whole people and collectively, and trees and woodlands owned by individuals shall be registered by the people's governments at or above the county level, and certificates shall be issued to confirm ownership or use rights.

The legitimate rights and interests of owners and users of forests, trees and woodlands are protected by law, and no unit or individual may infringe upon them.

Any unit or individual has the right to stop or report acts of destroying forest resources. Article 4 The competent forestry authorities of the autonomous region shall be responsible for organizing the delineation of shelter forests, timber forests, economic forests, firewood forests and special-purpose forests in the autonomous region according to the provisions of the national forest resources inventory and forest variety zoning.

The key shelterbelts and special-purpose forests in the autonomous region are proposed by the competent forestry authorities of the autonomous region and reported to the people's government of the autonomous region for approval and promulgation. Fifth forestry construction should be based on forest management, universal forest protection, vigorous afforestation, combination of harvesting and cultivation, and sustainable utilization. Article 6 Develop forestry education, actively cultivate scientific and technological talents, strengthen forestry scientific research, strive to improve scientific research conditions and improve forestry science and technology and management level. Article 7 The autonomous region shall implement the following protection measures for forest resources:

(a) the implementation of forest harvesting quota, encourage afforestation, closing hillsides to facilitate afforestation, and expand forest coverage.

(two) the people's Government of the autonomous region should take effective measures to implement "replacing wood with coal" in the Daxinganling forest region to save wood.

(three) according to the relevant provisions of the state and the people's government of the autonomous region, give economic support or low-interest long-term loans to the collective and individual afforestation.

(four) according to the timber harvesting and the sales revenue of the main forest products, a certain proportion of afforestation fees shall be levied for afforestation. Measures for the collection of afforestation fees shall be formulated by the competent departments of forestry and finance of the autonomous region.

(five) coal, metallurgy, paper, salt pond, alkali mine, railway, transportation, agriculture, animal husbandry and fishery, hydropower, urban construction and other departments. A certain amount of afforestation funds shall be withdrawn or arranged, and measures for management and use shall be formulated for special purposes.

(six) the establishment of forestry fund system. The specific measures for the administration of forestry funds shall be formulated by the competent departments of forestry and finance of the autonomous region and reported to the people's government of the autonomous region for approval. Article 8 It is the duty of citizens to plant trees and protect forests. People's governments at all levels shall organize the whole people to plant trees voluntarily and carry out afforestation activities. Article 9 The competent forestry authorities of the autonomous region shall be in charge of forestry work in the whole region. The competent forestry department of the county (city) people's government is in charge of the forestry work in this area. The people's governments of hematoxylin, townships and towns shall set up full-time or part-time personnel to be responsible for forestry work. Article 10 State-owned forest areas in autonomous regions should closely integrate the protection and development of forests with the economic interests of ethnic autonomous areas, and give ethnic autonomous areas more autonomy and economic benefits in timber distribution and profit sharing. Eleventh in afforestation, forest protection and forest management, to mobilize all kinds of positive factors, units or individuals that have made remarkable achievements, by the people's governments at all levels in the autonomous region to give spiritual or material rewards. Chapter II Forest Management Article 12 The competent forestry authorities at all levels shall manage and supervise the protection, utilization and renewal of forest resources in accordance with national laws and the provisions of these Regulations. Forests owned by the whole people are managed by state-owned forestry bureaus and state-owned forest farms. Thirteenth in the Daxinganling virgin forest area, the principle of "giving priority to forest management, combining cutting and breeding, comprehensive utilization and diversified management" is implemented. In the secondary forest area, the policy of "enclosure first, simultaneous cultivation, comprehensive utilization and diversified management" is implemented. Article 14 The competent forestry department of the autonomous region shall, according to the provisions of the state and the deployment of the people's government of the autonomous region, organize regular forest resources surveys, so as to provide a basis for the preparation of forest management plans, the establishment of forest resources archives and the determination of forest cutting quotas. The competent forestry departments at all levels shall, according to the actual needs, put forward the institutional setup plan for forest resources management and investigation and design, and report it to the people's government at the same level for approval. Fifteenth people's governments at or above the county level shall formulate long-term forestry planning. State-owned forestry enterprises and institutions and forest nature reserves shall, according to the long-term forestry planning, formulate forest management plans and report them to the higher authorities for approval before implementation.

Forestry departments at all levels shall guide rural and pastoral collective economic organizations and state-owned farms, pastures, industrial and mining enterprises and other units to formulate forest management plans. Article 16 Disputes over the ownership and use right of trees and woodlands between units under ownership by the whole people, between units under collective ownership and between units under ownership by the whole people and units under collective ownership shall be handled by the people's governments at or above the township level in Sumu. Within the scope of the county (city), it shall be handled by the people's government of hematoxylin, township, town or county (city); Between counties (cities), it shall be handled by the Union Administrative Office and the Municipal People's Government; Between the union cities, it shall be handled by the union cities through consultation. If negotiation fails, both parties may submit their opinions to the people's government of the autonomous region for adjudication.

Any dispute involving the ownership and use right of forest trees and woodlands in various forestry bureaus in Daxing 'anling primeval forest region shall be decided by the people's government of forest banner (city) and the State Forestry Administration at the people's government of the autonomous region.

Disputes between individuals or between individuals and units under ownership by the whole people or units under collective ownership over ownership and use rights of trees and woodlands shall be handled by the local people's governments of Sumu, townships, towns and counties (cities).

If a party refuses to accept the decision of the people's government, he may bring a lawsuit to the people's court within one month from the date of receiving the notice.

Before the dispute over the ownership of trees and forest land is resolved, no party may cut down the disputed trees.
