How to approve the foundation of rural housing

Village environmental protection office shall conduct on-site investigation and site selection to verify the basic situation of building households and the existing housing situation. In line with the conditions of construction and land use, the township environmental protection office shall issue the planning and land use approval form. With the consent of the society and the village (signature and seal), the staff of the Construction Environmental Protection Office will review and fill in the form and sign the preliminary examination opinions. Fill in the form by the staff of the National Land Institute and submit it to the leaders of the National Land Institute for approval. After the approval of the leaders in charge of the town people's government, they will go to the Party and Government Office to affix their seals, and the Construction Environment Office will issue the "Permit for Planning of Township Construction", which will be reviewed and approved by the County Land Resources and Housing Administration, and the construction land permit will be issued.

With the introduction of the new policy, rural areas cannot build houses casually, and certain conditions need to be met. What are the conditions for building houses in rural areas? First, rural residents must be at least 18 years old, which meets the conditions of separation of people and households;

Second, the building of rural residents must conform to the overall land use planning, the annual land use plan and the urban construction plan;

The third is the rural residents' housing quota standard. The quota area for using the original homestead and the village land is180m2, and the quota area for using agricultural land is140m2;

Fourth, rural residents must "one household, one house";

Fifth, if rural villagers rent or sell the original homestead and then apply for homestead, they will not be approved;

Sixth, non-farmers and other personnel are prohibited from buying homesteads in the village;

Seventh, farmers should use the original homestead and village land to build houses. Those who can use inferior land should not occupy good land, those who can occupy wasteland should not occupy cultivated land, and those who use state-owned land must go through the transfer procedures.

Occupation standard of homestead for one household and one house

In 2020, the regulation of "one household, one house" will be strictly implemented: homestead is the collective construction land used by rural villagers to build houses and their ancillary facilities, including houses, ancillary houses and courtyards. Rural villagers can only own one homestead, and the area shall not exceed the standards set by provinces, autonomous regions and municipalities directly under the central government.

Land standard for rural homestead: the occupied agricultural land shall not exceed 200m2 (0.30mu), and the occupied construction land and unused land shall not exceed 233m2 (0.35mu).

Legal basis: Article 13 of the Measures for the Administration of Rural Homestead may apply for a homestead under any of the following circumstances:

(a) because of national or collective construction, migration, disasters and other needs to relocate and rebuild;

(two) the implementation of city, village and market town planning or the transformation of old villages, the need to adjust the demolition;

(three) the existing homestead area has not yet reached the quota standard stipulated in these measures and needs to be rebuilt or expanded;

(four) with household conditions and the original homestead area has not yet reached the limit standard stipulated in these measures, which needs to be rebuilt or expanded;

(five) with the approval of the county people's government, the professional and technical personnel introduced or recruited by rural collective economic organizations really need to settle in rural areas;

(six) retired workers, demobilized soldiers and overseas Chinese, their relatives, Hong Kong, Macao and Taiwan compatriots with legal documents to return to their original places to settle down;

(seven) as otherwise provided by laws, regulations and rules.
