A Basic Review of the Court's Work in 2003
In 2003, under the correct leadership of the Municipal Party Committee, under the supervision and guidance of the Municipal People's Congress and the High Court, and with the strong support of the Municipal Party Committee, the Municipal Government, the CPPCC and relevant departments, our hospital conscientiously implemented the spirit of the 16th National Congress of the Communist Party of China and the Third Plenary Session of the 16th Central Committee, adhered to the guidance of Deng Xiaoping Theory and Theory of Three Represents, took "reviewing the past and opening up the future" as the carrier, and took the professionalization of legal workers as the main line to carry out thematic education activities. Firmly establish a sense of the purpose of justice for the people, comprehensively carry out trial work, vigorously strengthen team building, actively promote judicial reform, and make new progress and new achievements in all work. In the whole year, * * * accepted 5 166 cases (including old cases 196 cases), and concluded 4,887 cases, with a closing target of 254,820,500 yuan. The police officers in the hospital are full of energy and enthusiasm for work, and their overall awareness, dedication and enterprising awareness are constantly enhanced, and their overall image is further enhanced. Throughout the year, 1 1 internal departments and 42 individuals were commended and rewarded by the Provincial Political and Legal Committee, the Provincial High Court, the Changzhou Political and Legal Committee and the Changzhou Intermediate People's Court. Last year, on the basis of winning the honors of "People's Satisfaction Court of the whole province", "Third Class Merit" and "Uniting and Honesty to Develop a Good Team" for many years in a row, our hospital made persistent efforts and worked hard in unity, and won the honor of "Building an Advanced Unit of the Two Institutes" and "Building an Advanced Collective of Party Style and Clean Government" by the provincial court every five years. Recently, the party group of Changzhou Intermediate People's Court decided to declare the collective for our hospital. Our method is:
First, adhere to justice for the people, strengthen service awareness, and comprehensively carry out various trials.
Justice for the people is the essential requirement of socialist legal system. Over the past year, in accordance with the requirements of "focusing on justice, focusing on people and focusing on execution", our hospital has continuously strengthened its service awareness, given full play to its judicial functions, and effectively safeguarded the legitimate rights and interests of the broad masses of the people.
(a) to crack down on all kinds of criminal activities, and strive to create a safe public security environment.
It is a long-term strategic task of the people's court to crack down on criminal offences. Our hospital continues to implement the policy of "strike hard", further highlights the key points of the crackdown, and severely punishes eight kinds of vicious crimes such as murder and robbery that seriously endanger people's lives and property, as well as multiple crimes such as theft and robbery. Adhere to "strike hard" according to law, ensure the quality of handling cases, and strictly control the facts, evidence, procedures and applicable laws of each case. In 2001, 276 criminal cases involving 349 people were concluded, among them, 22 people were sentenced to fixed-term imprisonment of more than 12, 22 people were sentenced to fixed-term imprisonment of more than 5 years and less than 10, and 3 people were sentenced to fixed-term imprisonment or criminal detention of less than 5 years. At the same time, our hospital also pays attention to closely combining the "strike hard" rectification with rectifying and standardizing the market economic order, fully applying property punishment according to law, paying attention to recovering stolen money and goods, confiscating the illegally accumulated property of criminals, and completely destroying their economic pillars. In the whole year, criminals were fined 189, and more than 3.8 million yuan of property was confiscated. In order to cooperate with the tax law publicity month, our hospital tried a number of major tax-related criminal cases and severely punished all kinds of tax-related criminals. * * * Five such cases were concluded 10, involving a tax amount of 7.6 million yuan, saving the country an economic loss of 3 10 million yuan. According to the unified arrangements and requirements of the higher courts, a number of vicious criminal cases were pronounced in time, which formed a momentum, deterred crimes and played a positive role in preventing and reducing crimes.
(two) to strengthen civil and commercial and administrative trials, and strive to create a fair market environment.
In 2001, our hospital accepted 2,937 civil and commercial cases (including 138 cases), concluded 2,755 cases, and settled the disputed object of12261570,000 yuan, which protected all kinds of civil subjects equally, better solved all kinds of contradictions among people, and further promoted social stability and unity and the establishment of socialist market economic order.
First, mediate various civil disputes according to law and resolve contradictions among the people in a timely manner. Through the trial of various disputes such as marriage and family, neighborhood relations and labor disputes according to law, we will vigorously advocate the social fashion of respecting the elderly and loving the young, neighborhood harmony, unity and mutual assistance. Strengthen the function of mediation mechanism, give full play to the role of mediation in all stages of litigation, deepen, refine and practice pre-trial mediation, in-court mediation and post-judgment education and persuasion, and minimize the opposition between the parties. In the whole year, 904 cases of marriage and family disputes were concluded, 607 cases of ownership and property inheritance disputes between citizens were concluded, 60 cases of labor remuneration and labor disputes were concluded, and 79/kloc-0 cases of civil cases were concluded through mediation, with the settlement rate of mediation exceeding 50%. At the same time, we have strengthened the prevention and handling of group civil cases. According to the working principle of "we can't get together, we can't get together, we can't solve problems, we can follow nature, pay attention to strategies, seize the opportunity and strengthen education and guidance". In several agricultural group cases tried by our hospital, the undertaker resolved the contradictions in the bud through patient and meticulous ideological work, and achieved good legal and social effects.
The second is to try all kinds of civil and commercial cases according to law and protect the legitimate rights and interests of the parties equally. Our hospital properly handles cases such as enterprise restructuring, purchase and sale contracts, financial disputes, enterprise contracting and leasing, gives full play to the function of civil and commercial trials to support, guide and standardize various economic reforms, and strives to create a fair and reasonable investment environment. Especially in the trial of enterprise restructuring cases, we should pay equal attention to supporting reform and standardizing reform, and apply laws, regulations and restructuring policies to protect the legitimate rights and interests of all parties equally. For financial cases, we should strengthen protection, take effective measures such as sealing up and freezing in time, try our best to help financial institutions prevent and resolve financial risks, safeguard national financial security, and promote the creation of "financial safety zones" in our city. In the whole year, * * * accepted 647 cases of various economic contracts, concluded 575 cases, and settled disputes of 42,343,700 yuan, which promoted the healthy and stable development of the economy.
The third is to handle administrative cases safely according to law and promote the administration of administrative organs according to law. The administrative trial work in our hospital always adheres to the concept of supervising and supporting administration according to law and protecting the legitimate rights and interests of the administrative counterpart, effectively checks the legality of specific administrative acts, continuously expands the extension of administrative trials, strengthens contact and communication with administrative organs, and helps the staff of administrative organs to improve their awareness of administration according to law and standardize specific administrative acts through lectures and exchanges with relevant administrative organs. In the whole year, 32 administrative cases were concluded, up 23% year-on-year. In addition, our hospital has also implemented the hearing system of non-litigation administrative execution cases, and reviewed 206 non-litigation administrative execution cases in the whole year, including 10 1 case. After trial, in 40 cases, the parties voluntarily went to the administrative organ to perform their obligations. In 10 cases, it is suggested to withdraw the application for execution because the specific administrative act applied for execution does not meet the conditions for compulsory execution. Through the examination of the hearing, a bridge of understanding was really built between the government and the masses.
(three) actively participate in the comprehensive management of social security, and strive to create a stable social environment
As one of the member units of the comprehensive management of social security, our hospital has actively participated in the comprehensive management of social security in various forms over the past year and continuously provided extended services for the trial work. First, strengthen the guidance of people's mediation work. Our hospital has strengthened communication and coordination with the Bureau of Justice, and formulated the Opinions on Further Strengthening People's Mediation in Our City, which has promoted the improvement of people's mediation work and thus solved a large number of grassroots civil disputes. The second is to improve the trial method of juvenile delinquency. In view of the characteristics of juvenile delinquency, we tried the "round-table trial" mode, that is, judges, prosecutors, defenders and legal representatives of defendants conducted a "discussion-style" trial around the same round table, which truly implemented the education, probation and rescue work for minors throughout the trial process and was fully affirmed by the society. The third is to carry out extensive publicity and education on the legal system. Through in-depth publicity of the legal system in schools, students can learn to protect themselves and prevent crimes; By establishing a special issue of Liyang Daily Fayuan, let the broad masses of people learn legal knowledge; Live trial activities through Changzhou TV's "Inside and Outside the Court" program to let the public know about the litigation process; Send laws to communities and villages through legal publicity activities in streets and villages.
(four) to further strengthen the implementation work, and strive to create a standardized legal environment.
Over the past year, our hospital has thoroughly studied the new characteristics of implementation work under the new situation, identified the crux of "difficult implementation", grasped the key links, and put forward targeted solutions, which effectively improved the implementation effect. In the whole year, * * * handled all kinds of cases 1802, with the bid amount of 132 1480 yuan, and the detection rate reached 97%. First, give up holidays and build a rapid implementation mechanism. With the increase of the difficulty of case execution and the improvement of the "skills" of the executed person to evade execution, the executors in our hospital voluntarily give up rest days, adhere to the fine tradition of overtime execution on holidays, and implement the duty system on holidays. In case of legal holidays, an executive team takes turns to be on duty every day. As long as the person subjected to execution is unaccounted for or appears in the city, the obligee can report it at any time, and the person subjected to execution will rush to the scene in time to deal with it according to law, whether it is windy or rainy day or night. The second is to grasp the sense of restriction and effectively improve the actual implementation rate. In order to further improve the restraint consciousness of the executives, our hospital launched a case-handling competition in each executive group. Encourage the advanced and spur the backward through the monthly evaluation. At the same time, in order to actively implement the spirit of clearing cases in the national court system, we have also implemented a weekly report and analysis system on the implementation, stipulating that each dean should report on the implementation of cases every week, analyze the problems encountered in the implementation, propose solutions to the problems, and urge the deadline for the implementation of cases. By paying close attention to enforcement, the average handling period of enforcement cases has been greatly shortened, from 99 days in the previous year to 45 days now. The third is to innovate the implementation concept and implement the hearing system. Some parties involved in difficult and complicated enforcement cases often go to the court or petition the relevant departments because they don't understand the court's enforcement work, which has caused certain pressure on social stability. To this end, our hospital has implemented an enforcement hearing system, inviting people from the Municipal People's Congress, the Political and Legal Committee, the Letters and Calls Bureau, the local government and other relevant departments to be present, so that all parties can fully claim compensation, give evidence and debate, and at the same time do a good job in publicizing laws and regulations, announce the facts and implementation of the case, eliminate the complaints of the parties, and solve some thorny old problems of letters and visits.
Two, adhere to the people-oriented, deepen the theme education, and strive to shape a team of high-quality judges.
Last year, according to the unified arrangement of the higher court, our college carried out an educational activity with the theme of "reviewing the past and opening up the future", which took a solid step to cultivate a team of high-quality judges satisfied by the party and the people.
(a) to strengthen the construction of judges' professional ethics as the core, and carry out in-depth thematic education activities.
In June last year, the Supreme Court made unified arrangements in the national court system to carry out educational activities with the theme of "Reviewing the past and opening up the future". The party group of our college attached great importance to it, set up a leading group on theme education, and formulated a series of specific implementation opinions and timetables, which ensured the organization, systematization and timeliness of this activity. During the activity, we sent 95 letters to the Standing Committee of NPC Municipal Committee, the Standing Committee of CPPCC Municipal Committee, towns and streets and relevant departments to solicit their opinions and suggestions on the work of the court. Also take the way of going out, led by the leaders of the hospital and attended by the heads of relevant departments of the hospital, and visited four teams, political and legal departments, financial departments, relevant administrative law enforcement organs, key towns and key enterprises to solicit opinions and listen to suggestions. Collect all kinds of opinions and suggestions in time and formulate rectification measures. In order to make the theme education activities effective, we carried out the activity of "I contribute to the construction of the court", and the police officers actively participated in it as masters, and put forward many good opinions and suggestions (* * * Collection 100), many of which were highly targeted and practical. At the same time, in order to enhance the police officers' sense of responsibility and sympathy and care for the socially disadvantaged groups, we also organized police officers to visit the "poor people" in poverty-stricken areas and receive ideological education after organizing the police officers in the whole hospital to visit the "prisoners" and receive warning education the year before last. In August, we donated 5630 yuan in two days, and 60 cadres above the presiding judge and chief executive officer were divided into 6 groups to visit 6 poor families in Shangxing Town/Kloc-0 in this city, which made the police officers deeply educated. Through this theme education activity, the mental outlook of the police officers in the hospital has changed, their thoughts are more active, their suggestions are more active, and they pay more attention to study than work, which has achieved satisfactory results. Changzhou Intermediate People's Court spoke highly of our thematic education activities and recommended them to the Provincial High Court. The Provincial High Court is very interested in this, and specially came to our hospital for investigation and research, and fully affirmed it, and recommended it to the Supreme Court.
(2) Focus on strengthening ideological and political construction and strive to create a cohesive atmosphere to promote development.
Following 200 1 and 2002, the leaders of our hospital were rated as "United, clean and pioneering" by the municipal party Committee, our hospital further strengthened the ideological and political construction of police officers and continuously improved the ideological and political work methods. The first is to strengthen the theoretical study of the party group. At the beginning of the year, the Opinions on Theoretical Study of the Party Group in 2003 and the Special Plan for the Central Group of the Party Group to Study Theory of Three Represents were formulated. By strengthening theoretical study, we have continuously improved the level of political theory and effectively enhanced the awareness of "building the party for the public and governing for the people". The second is to strengthen the construction of party style and clean government. At the beginning of the year, we specially formulated opinions on discipline inspection and supervision, put forward requirements on how to further strengthen the building of a clean and honest party style, increase the intensity of preventing and controlling corruption at the source, and pay close attention to the implementation of leading cadres' honesty and self-discipline, investigating and handling cases of violations of law and discipline, and correcting unhealthy judicial practices. We have carried out "two musts" education, advanced typical education and negative warning education in the whole hospital, and also signed the "Responsibility Letter for Building a Clean and Honest Party Style" layer by layer to ensure that there are no problems in the team. Over the past year, the awareness of honesty and self-discipline of police officers in the hospital has been significantly enhanced. * * * Refused to accept gifts worth 43 230 yuan and invited 386 people to dinner. In February 65438, our hospital was awarded as an advanced unit in the province at the commendation meeting for the construction of party style and clean government in the court system of the whole province, and as an advanced representative of grass-roots courts, we made an experience exchange speech at the meeting, which won wide acclaim. The third is to strengthen the creation of grassroots safety. In order to conscientiously implement the relevant work requirements of the municipal party committee, the municipal government and the higher courts, we have formulated the Implementation Opinions of the People's Court of liyang city on Serving "Two Leads" and Creating "Safe Liyang", so as to identify the entry point and combination point, give full play to the main role of cracking down on crimes according to law, standardizing civil relations, maintaining social stability and promoting economic development, and provide strong judicial guarantee for realizing "Two Leads" and creating "Safe Liyang".
(three) to strengthen the system construction as the focus, and earnestly grasp the standardized management of the team.
Over the past year, our hospital has vigorously strengthened the system construction. First, improve the assessment mechanism and strengthen the responsibility of police officers. On June+10, 5438, our hospital implemented the "double percentage" target management assessment method. Every quarter, the work of each department (including team building and business work) is assessed with a percentage system, and the assessment results are linked to the evaluation and bonus distribution, and the rewards are excellent and the bad are punished. Through the assessment, the work of all departments has been greatly improved, and the sense of responsibility, mission and ownership of police officers has been further enhanced. The second is to implement the "six prohibitions" and enhance the image of the court. After the "six bans" were issued by the Provincial High Court on April 18 last year, our hospital quickly deployed and held a special meeting for police officers to implement it, requiring the police officers in the hospital to attach great importance to it and conduct regular inspections. We also publicized the "Six Prohibitions" in Liyang Daily, accepted social supervision and made unannounced visits to the implementation. Once those who violate the ban are found, they will not be tolerated. The third is to formulate "eight commitments" and improve work style. On the basis of extensively soliciting opinions, our hospital has carefully studied and formulated the "two firsts" and "eight social commitments" of serving the people's courts in liyang city, namely, the "first priority" of responsibilities, building an iron case project, strictly limiting trials, ensuring clean handling of cases, unblocking channels for letters and visits, implementing judicial assistance, strengthening legal publicity, and building a highland for talents, which has significantly improved our hospital's hospital management, trial quality, case handling efficiency and work style.
(4) Taking the opportunity of promoting the professionalization of judges to comprehensively improve the professional quality of judges.
On the basis of some achievements in the professionalization of judges, our hospital continues to increase its efforts. The first is to open up a "judge forum" and expand the professional communication channels for judges. Since May, we have held a symposium for judges of the whole hospital, which is held every two months. The presiding judge introduces his own experience and successful experience in the process of studying, working and handling cases for your reference, and can also put forward his own views on the difficult problems encountered in the trial work and the application of the law to discuss and debate with you to guide the trial practice. Judging from the four forums that have been organized, the police officers have high consciousness and enthusiasm, and the atmosphere is quite active, which has received ideal and expected results. The second is to strengthen publicity and research, and strive to create a strong learning atmosphere. Our hospital continues to regard investigation and research as a very important basic work to promote the professionalization of judges. On the investigation, I sorted out five issues of Liyang Trial Research, published more than 70 academic papers and excellent judgment documents of police officers in our hospital, and published 20 articles in provincial, prefectural and municipal journals. Court information and briefing work is also among the best in Changzhou district court system. We also compiled the special edition of Liyang Daily,No. 10, and published 57 propaganda articles, which achieved good social effects. Third, pay attention to on-the-job training and strive to improve the professional quality of police officers. Our college continues to strengthen long-term cooperation with institutions of higher learning, and invites famous professors such as Nantah and Huazheng to give lectures on law, so that police officers can further broaden their horizons and understand the legal trends. We organized 2/kloc-0 police officers to participate in the second computer training. So far, most police officers under the age of 50 in our hospital have been proficient in computer operation and obtained the first-class and second-class qualification certificates of computer in China. At the same time, we are constantly striving to improve the academic qualifications of the police. At present, 44.4% of in-service judges have a bachelor's degree or above, and the remaining judges who have not yet obtained a bachelor's degree are also participating in various forms of undergraduate education. Eight young comrades also applied for postgraduate studies and studied for a master's degree in law. In addition, we also carried out trial observation activities to improve the judge's trial control ability; Select excellent legal documents to be displayed on the wall every month to cultivate judges' rigorous and meticulous trial style; Every quarter, the number, quality and cycle of judges' handling cases are published on the wall to improve judges' awareness of trial limitation and quality.
Third, strengthen the sense of innovation, enhance the judicial concept and actively promote the reform of the judicial system.
Innovation is the driving force for the continuous development of court work. Over the past year, according to the unified deployment of the Supreme Court, our hospital began to hear cases. At the same time, combined with the actual situation, we have further intensified the reform of the judicial system, which has continuously improved the law enforcement level of our hospital.
(1) Improve the trial operation mechanism and establish a new concept of justice and efficiency.
First, actively explore the diversion of complex cases and expand the scope of application of summary procedures. Our hospital has set up a "quick adjudication group" in the filing court to hear civil cases with clear facts, clear legal relations and little controversy, and without the need for the court to investigate and collect evidence ex officio. In the whole year, 58 cases were tried by the speedy adjudication group, all of which were settled within half a working day. The mediation rate reached 1.000%, which improved the efficiency of handling cases, saved the trial resources and reduced the litigation burden of the parties, and was well received by the parties. Second, centralized management of judicial expertise to further ensure judicial justice. In view of the problem that the identification work was entrusted by the case undertaker in the past, which not only distracted manpower, financial resources and energy, but also aroused the reasonable suspicion of the parties, our hospital set up a judicial identification room at the beginning of the year to centrally manage the identification involved, accept and file a case in a unified way, and entrust it to the outside world, eliminating the direct contact between the case undertaker and the social identification agency. At the same time, when choosing foreign certification bodies, the parties' autonomy should be fully respected, and the parties should choose through consultation. If the negotiation fails, the judicial authentication room will randomly select from the library of institutions with authentication qualifications. In this way, the judicial expertise in our hospital has achieved a virtuous circle and provided a strong guarantee for fair law enforcement. The third is to strengthen the people's jury system and give full play to the coordinating role of jurors. In the marriage and family cases accepted by our hospital, some contradictions are quite fierce, and improper handling can easily lead to vicious incidents of social interaction. In April last year, our hospital hired 12 women's Federation cadres as newly invited people's jurors, with the purpose of giving full play to their own advantages, earnestly safeguarding the legitimate rights and interests of women, the elderly and children, and doing a good job in guidance, mediation, publicity and prosecution. Practice has proved that female invited people's jurors have played a unique and positive role in handling relevant cases in the court, and have been well received by lesbians and presiding judges.
(2) Reform the personnel management system and establish a scientific and reasonable new mechanism for employing people.
The key to the rise and fall of a career lies in people. At the beginning of the year, in accordance with the relevant policies on the selection and appointment of cadres, we adhered to the principle of having both ability and political integrity in the "four modernizations" of cadres, selected a group of police officers with good mass foundation and great work performance to middle-level leadership positions, strengthened the usual inspection of cadres, and conducted targeted education in time to keep the alarm bells ringing and prevent delays. Last March, on the basis of summing up experience, we launched a new round of selection and appointment of presiding judges and chief executives. Through fair and open competition, 17 comrades took up a new round of posts of presiding judge and chief executive officer in our hospital and played an important role in their respective posts.
(three) improve the reception mechanism of letters and visits, and establish a new image of the court that is close to the people and convenient for the people.
Last year, our hospital made a useful exploration on how to further strengthen the reception of letters and visits and improve the pattern of letters and visits. The first is to implement the system of judges on duty. In the first half of the year, our hospital implemented the judge duty system, and middle-level cadres took turns as duty judges, who were responsible for verifying the identity of the person in charge, answering the questions of the parties, guiding the litigation of the parties, and maintaining the trial and office order. The party group of the institute holds a meeting every two weeks to analyze the petition situation, and the petition supervision group makes a written report on the recent petition situation and puts forward relevant suggestions. Since the implementation of the judge's duty system, * * * has received 56 14 visitors, registered for the record, and submitted more than 50 cases to the petition supervision team. The second is to improve the presidential reception system. On the original basis, our hospital has strengthened the reception system of the president, from once a week to twice a week, with the assistance of the executive president. In the whole year, the president received 28 1 person-times, which further smoothed the channels of letters and visits and improved the quality of letters and visits. With the gradual improvement of the reception system of letters and visits in our hospital, some incipient problems that may lead to intensified contradictions have been solved in the bud, which has really played the role of "shock absorber" for social stability.
Delegates, looking back on the past year, with the concerted efforts of Qi Xin, a police officer in the whole hospital, our hospital has made new progress on the original basis, and achieved remarkable results in some aspects, which has been affirmed and praised by superiors. Here, I would like to mention in particular that the new trial office building in our hospital has been successfully completed and put into use after more than two years of construction. As a century-long plan of our hospital, the project was carried out in an open, fair and just manner, and was praised by many leaders as a model of "big planning, strict management and high-quality construction", which made our hospital's trial conditions rank among the advanced ranks of grassroots courts in the province and even the whole country. This achievement can not be achieved without the care and support of leaders at all levels, the cooperation and help from all walks of life, and the concerted efforts of Qi Xin, a police officer in the hospital, which also includes the care, support, help and hard work of all of you present. In the face of achievements, we have always been soberly aware that there are still many problems and shortcomings. The main manifestations are as follows: First, after the promulgation of the "six bans" of the Provincial High Court, most police officers performed well, but a few police officers did not perform thoroughly enough. The privilege thought of individual police officers still exists, lacking service consciousness and professional accomplishment, which affects the overall image of our hospital; Second, with the continuous advancement of judges' professionalization, some judges have the problem that their professional quality is not high enough, which affects the quality of trial work; Third, the problem of "difficulty in enforcement" has not been fundamentally solved, and there is still a big gap between the actual implementation rate and the expectations of the people, which has affected the people's satisfaction with the court; Fourth, the overall academic level of police officers in our hospital is not high enough, and there is still a big gap between the proportion of undergraduate education and the requirements of trial work, which has affected the full play of trial functions to some extent. We will take practical and effective measures to solve this problem step by step.

In 2004, we will continue to try all kinds of cases fairly and efficiently according to law, pay close attention to the conclusion rate and actual execution rate of cases, and constantly consolidate the foundation of serving the "two firsts" according to law. Continue to adhere to the policy of "strike hard" and consolidate and develop the achievements of the "strike hard" rectification struggle; Continue to participate in rectifying and standardizing the market economic order, try all kinds of civil, commercial and administrative cases according to law, and create a fair and orderly market environment; Continue to thoroughly implement the spirit of the central document 1 1, constantly explore new execution methods, improve the actual execution rate of cases, and effectively solve the "implementation difficulties"; Continue to adhere to the organic unity of the legal effect and social effect of handling cases, expand the field of serving "two firsts", and create a good legal environment for economic construction and social development.

In 2004, the second five-year reform program of people's courts will be implemented. We should continue to proceed from the actual needs of trial work, rationalize the relationship between trial work, optimize the allocation of trial resources, and deepen the reform of trial methods. According to the requirements of the diversion of complex cases, the application scope of summary procedure should be further expanded, the litigation burden of the parties should be reduced as much as possible, the litigation cost should be reduced and the trial efficiency should be improved. It is necessary to further improve the awareness of trial limitation, improve the application of litigation evidence rules, and improve the ability of judges to control trials; We should make full use of scientific and technological means with computer and network technology as the core to enhance the scientific and technological content of judicial activities and improve the level of office informatization and modernization; It is necessary to continue to deepen the reform of the execution management system and the operation mechanism of the execution power, safeguard the legitimate rights and interests of the parties to the maximum extent, and safeguard the authority of the referee.
Third, take the professionalization of judges as the main line and strive to improve the quality of judges.

First, strengthen the overall concept and improve the operation mechanism of representative liaison work. In 2004, we will select some typical cases and invite NPC representatives to attend the trial.
