Measures of Nanjing Municipality on Funeral Management (revised on 20 17)

Chapter I General Provisions Article 1 In order to strengthen funeral management, implement funeral reform, guide and standardize funeral activities, and promote the construction of socialist spiritual civilization, these Measures are formulated in accordance with the Regulations of the State Council Municipality on Funeral Management and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 All units and individuals that build funeral facilities, engage in funeral management and services, and hold funeral activities within the administrative area of this Municipality shall abide by these Measures. Article 3 Nanjing Civil Affairs Bureau is the administrative department in charge of funeral management in this Municipality. Nanjing funeral management institutions are specifically responsible for the daily work of funeral management.

The civil affairs departments of all districts shall be responsible for the funeral management within their respective jurisdictions in accordance with the prescribed duties.

Public security, industry and commerce, health, transportation, finance, price, construction, land, ethnic religion, environmental protection, culture, press and publication, radio and television and other departments shall, within their respective functions and duties, cooperate with the civil affairs departments to do a good job in funeral management. Article 4 State organs, public organizations, enterprises and institutions, neighborhood (village) committees and other organizations shall carry out publicity and education on funeral reform in their own units or regions, guide citizens to get rid of feudal superstitious funeral customs, and conduct funerals in a civilized and thrifty manner. Fifth people's governments at all levels and civil affairs departments shall commend and reward units and individuals that have made outstanding contributions in funeral management and service. Chapter II Funeral Services and Management Article 6 Cremation shall be carried out in cremation areas within the administrative area of this Municipality, and burial shall be abolished. Except as otherwise provided by laws and regulations. Seventh people who died in this city should be cremated in the funeral home. If it is really necessary to transport the body back to the domicile or residence, it shall be approved by the civil affairs department where the deceased is located.

If Buddhism requires cremation in a jar according to religious customs, it shall be carried out at a designated place with the approval of the religious work department of the government. Article 8 Funeral services such as transportation, preservation, refrigeration, cosmetic surgery and cremation of the remains shall be undertaken by the funeral home where the deceased is located. Other units and individuals shall not engage in funeral services.

Eligible residents in this city are exempted from the basic funeral service fees such as body pick-up, handling, refrigeration, makeup, cremation and public welfare storage, and the related expenses are borne by the municipal and district finance. Ninth health administrative departments and medical units should strengthen the management of mortuary. The medical unit shall promptly notify the funeral home to pick up the body of the deceased. Without the approval of the civil affairs department, no unit or individual may transport the remains abroad.

It is forbidden to set up a mourning hall or hold funeral activities in the mortuary. Article 10 Hui and other ethnic minorities with special funeral customs should bury their remains in places designated by the local government. No unit or individual may interfere with voluntary cremation. Eleventh overseas Chinese, Hong Kong, Macao and Taiwan personnel died while visiting relatives, traveling and working in this city, and their relatives requested that the remains be disposed of on the spot, which shall be handled in accordance with the relevant provisions of the state.

Foreigners, Hong Kong, Macao and Taiwan personnel died in this city, and their relatives asked to transport their remains abroad, or the above-mentioned personnel died outside this city, and their relatives asked to transport their remains and ashes back to this city for cremation and burial, which shall be handled in accordance with the relevant provisions of the state. Twelfth cremated remains must be based on the death certificate issued by the public security organ or the medical institution specified by the administrative department of health of the State Council. The remains of normal dead persons should be cremated within 3 days; Special circumstances need to postpone cremation, should be approved by the funeral management agencies, but not more than 7 days. Highly corrupt remains must be cremated immediately. The remains of people who died of infectious diseases shall be handled in accordance with the relevant provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Infectious Diseases.

If the body of an abnormal death needs to be temporarily preserved, it shall be stored in a funeral home with anti-corrosion equipment. The storage period shall not exceed 3 months, except for the extension decided by the public security organ; If it is not handled within the time limit, the funeral management institution may, with the assistance of the public security organ, dispose of the remains according to law. The required expenses shall be paid by the responsible person. If the responsible person is not clear or there is no responsible person, it shall be paid by the local financial department.

The unknown body was notified by the local public security organ to the funeral parlour for reception. After the public security organ has made an appraisal and gone through the cremation formalities, the funds needed by funeral home cremation shall be paid by the local financial department. The city encourages land-saving burials, and if residents take river burials, tree burials, flower burials, lawn burials, deep burials, etc. without retaining permanent signs, the financial department shall give subsidies in accordance with the relevant provisions of Huimin funeral.

Funeral homes should strengthen the management of ashes, and the ashes must be temporarily stored in funeral homes before the methods specified in the preceding paragraph are determined. Fourteenth it is forbidden to put ashes in coffins or bury them in private places outside cemeteries. Except for the tombs of martyrs, overseas Chinese ancestors, historical celebrities and tombs with scientific and artistic value, which can be preserved in situ with the approval of the people's governments at or above the county level, other privately buried tombs must be moved to designated places or demolished in situ. Fifteenth ashes buried in the cemetery or Taling, you can buy a grave or Taling with the cremation certificate issued by the funeral home. The area of double holes in the operating cemetery shall not exceed 1 m2, and the single hole shall not exceed 0.7 m2. If the deceased belongs to overseas Chinese, Hong Kong, Macao and Taiwan people and celebrities, it shall be reported to the funeral management agency for approval to increase the tomb area, but it shall not exceed 5 square meters. The service life of the tomb tower of the operating ashes cemetery is generally not more than 20 years, and the maximum one-time management fee is not more than 20 years. After the expiration of the service life of the tomb (tower), if it needs to be used continuously, it shall go through the renewal procedures and pay the use fee according to the relevant provisions.

Before the implementation of the provisions of the preceding paragraph, the service period of the tomb (tower) of the operating ashes cemetery shall be implemented according to the original provisions.

No unit or individual may build a grave or family grave that exceeds the prescribed area.
