Chapter 1 General Provisions Article 1 In order to strengthen the protection and management of drinking water sources in Jinling Reservoir, prevent and control water pollution, and ensure the safety of drinking water, in accordance with the "Law of the People's Republic of China on the Prevention and Control of Water Pollution" The "Liaoning Provincial Regulations on the Prevention and Control of Water Pollution" and other laws and regulations are formulated based on the actual situation of this city. Article 2 These regulations apply to the protection of Jinling Reservoir drinking water source (hereinafter referred to as the water source) and related management activities. Article 3: If laws and regulations have relevant protection and penalty provisions for drinking water sources, those provisions shall prevail. Article 4 The Municipal People's Government shall establish a working mechanism of unified leadership, territorial management, hierarchical responsibilities, and coordination and linkage, formulate special plans for water source protection and incorporate them into national economic and social development plans, and promote the coordinated development of economic construction and water source protection.
Counties (including county-level cities and districts, the same below), township (town) people's governments and sub-district offices within the scope of water source protection are responsible for work related to water source protection within their jurisdiction.
Village committees and residents' committees within the scope of water source protection shall assist in water source protection work. Article 5 The ecological environment department of the people's government of the city or county where the water source is located is responsible for the unified supervision and management of the prevention and control of water source pollution within its own administrative region.
Departments of water conservancy, development and reform, public security, finance, natural resources, housing and urban-rural construction, civil affairs, transportation, agriculture and rural areas, forestry and grassland, health, industrial information, culture, tourism, radio and television, etc. shall, in accordance with their respective responsibilities, Do a good job in water source protection related work.
The Municipal People's Government should clarify the departments or institutions responsible for the daily management of drinking water sources in Jinling Reservoir. Article 6 The Municipal People's Government shall establish a water source protection target responsibility system and an assessment and evaluation system, and include the completion of water source protection targets in the assessment and evaluation of relevant departments and the county people's government where the water source is located and their responsible persons. Article 7 The municipal and county people's governments where water sources are located shall establish a compensation mechanism for water source ecological protection, protect and improve the ecological environment of water source protection areas, and promote the coordinated development of water source protection areas and other areas. Chapter 2 Protection Measures Article 8 Water source protection areas are divided into first-level protection areas and second-level protection areas.
The specific scope of first-level protected areas and second-level protected areas shall be determined in accordance with the scope approved by the Provincial People's Government.
According to the needs of water source protection, a certain area will be designated as a quasi-protected area outside the water source protection zone. The specific scope will be announced to the public after approval by the Provincial People's Government. Article 9 When engaging in activities in water source protection areas and quasi-protection areas, in addition to complying with the relevant prohibitive provisions of laws and regulations, the following provisions must also be observed:
(1) In secondary protection areas , the following behaviors are prohibited:
1. Disposal of domestic garbage;
2. Stacking and storing chemical raw materials, hazardous chemicals, mineral oils and toxic and harmful substances, dumping and stacking industrial solids waste and other toxic and hazardous waste;
3. Establish a dock for loading and unloading garbage, oil and other toxic and hazardous materials;
4. Build a livestock and poultry manure drying ground;
5. Develop real estate;
6. Apply highly toxic and high-residue pesticides.
(2) In the first-level protected area, the following activities are prohibited:
1. New construction, reconstruction, and expansion of oil depots;
2. Raising livestock and poultry;
3. Not for water supply or water source protection needs, new construction, reconstruction, expansion of docks and passing vessels, rafts or other self-made tools;
4. Agricultural planting;
5. Use chemical fertilizers and pesticides;
6. Discharge garbage, feces and other wastes that may pollute water sources;
7. Establish cemeteries and bury animal carcasses;
8. Wash clothes or other daily necessities in the water;
9. Organize water training, camping, and meals.
Behaviors that are prohibited in second-level protected areas are also prohibited in first-level protected areas. Article 10 Vehicles transporting hazardous chemicals, hazardous wastes and other toxic and harmful substances are strictly prohibited from entering water source protection zones without authorization; if they really need to enter, they must be reported to the Municipal People's Government Public Security Bureau for approval.
Transport vehicles should display obvious signs and take effective measures to prevent spills, leaks, and proliferation. Chapter 3 Supervision and Management Article 11 The Municipal People’s Government shall establish a communication and coordination mechanism to prevent cross-municipal water source pollution.
City, county, township (town) people's governments shall, in accordance with national and provincial river (lake, reservoir) chief system work regulations, do a good job in water resource protection and water bank management of Jinling Reservoir and the rivers entering the reservoir. line management, water pollution prevention and control, water environment management and water ecological protection. Article 12 The Municipal People's Government shall strengthen the construction of a grid-based environmental supervision system in water source protection areas and implement the main responsibilities of environmental supervision in water source protection areas.
The municipal and county people's governments should establish a multi-department joint law enforcement mechanism, conduct regular law enforcement inspections, and promptly discover, stop and deal with behaviors that affect water source safety. Article 13 The ecological environment departments of the municipal and county people's governments shall regularly monitor the water quality conditions of water sources, and shall expand the scope of monitoring and increase the frequency and items of monitoring during special periods such as water pollution emergencies. Article 14 Reservoir management units shall do the following water source protection and management work:
(1) Cooperate with the ecological environment and other departments to reasonably arrange water quality monitoring points in the reservoir area;
(2) ) Strengthen the protection and management of water supply engineering facilities in the reservoir area and within the management scope;
(3) Carry out daily inspections and cleaning of the reservoir;
(4) Damage to water sources in the protected area Dissuade and stop illegal activities such as damaging water supply engineering facilities, geographical boundaries of protected areas, warning signs, and isolation and protection facilities in accordance with the law, report in a timely manner and assist relevant departments in investigating and handling; Transfer the land to daily management and prevent re-cultivation.
