Regulations of Weihai Municipality on Coastal Zone Protection

Chapter I General Provisions Article 1 In order to strengthen the protection, utilization and management of coastal areas, ensure the ecological safety of coastal areas, and promote sustained and healthy economic and social development, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Use and Management of Sea Areas, the Law of People's Republic of China (PRC) on Urban and Rural Planning, the Law of the People's Republic of China on the Protection of Marine Environment and other laws and regulations, and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the protection, utilization and management of coastal zones within the administrative area of this Municipality.

Relevant laws and regulations have provisions on island protection, maritime traffic, ship pollution, mariculture, etc. Those regulations shall prevail.

The protection, utilization and management of Liu Gongdao and other inhabited islands, where there are no provisions in laws and regulations on island protection, shall be implemented in accordance with the provisions of these regulations. Article 3 The term "coastal zone" as mentioned in these Regulations refers to the intersection of ocean and land, including coastal waters with coastline extending to the ocean side and coastal land extending to the land side.

The coastal waters extending to one side of the ocean range from coastline to one kilometer equidistant line. The extension of coastal land to the land side shall be delineated and announced to the public by the Municipal People's Government according to the actual situation of the protected area and the principles of ecological priority, optimizing structure and strengthening control, and at the same time, protection landmarks shall be set up. Article 4 The protection, utilization and management of coastal zones shall follow the principles of scientific planning, overall planning of land and sea, priority of protection, sustainable development and strict management. Article 5 The municipal and district (county-level city) people's governments shall incorporate the protection, utilization and management of the coastal zone into the national economic and social development plan and annual plan, and the required funds shall be included in the fiscal budget at the corresponding level. Article 6 The municipal, district (county-level city) people's governments shall strengthen the unified leadership over the protection, utilization and management of coastal zones, establish and improve the deliberation and coordination mechanism, integrate management forces, and form a joint force of supervision.

The administrative department of marine and fishery is responsible for the comprehensive coordination of coastal zone protection and the supervision and management of coastal zone protection on the seaward side of the coastline.

The administrative department of land and resources shall be responsible for the supervision and management of land and resources protection in the coastal zone on the land side of the coastline.

The planning administrative department is responsible for the construction planning, supervision and management of urban and rural planning and construction land within the coastal zone.

Forestry administrative departments are responsible for the construction, protection and management of coastal shelter forest system, and organize, guide and supervise the wetland protection within the coastal zone.

The competent administrative department of environmental protection shall be responsible for the environmental protection of coastal engineering construction projects, standardize the setting of sewage outlets into the sea, and prevent pollution damage of land-based pollutants to the coastal zone.

Development and reform, housing and urban construction, urban management and law enforcement, transportation, water conservancy, tourism, maritime affairs, port and shipping departments shall, according to their respective functions and duties, do a good job in coastal zone protection. Article 7 The municipal, district (county-level city) people's governments shall establish a dynamic monitoring and inspection system for the coastal zone, and conduct dynamic monitoring and inspection of the coastal zone through on-site inspections, receiving reports, and comparing and inspecting satellite images, so as to timely discover and dispose of illegal acts, grasp the dynamic information of coastal zone protection, and establish graphic files on the status quo and changes of the coastal zone.

The comprehensive coordination department responsible for coastal zone protection shall set up a report telephone number and announce it to the public, and uniformly accept reports of illegal acts in coastal zones. Article 8 The municipal, district (county-level city) people's governments shall strengthen the scientific research on coastal zone protection and the popularization and application of advanced technologies, make full use of modern scientific and technological achievements, and improve the ability and level of coastal zone protection. Article 9 The people's governments of cities and districts (county-level cities) shall strengthen the publicity and education of coastal zone protection and raise the awareness of protection of the whole society.

Encourage citizens, legal persons and other organizations to participate in coastal zone protection, and the municipal and district (county-level city) people's governments shall commend and reward the units and individuals that have made outstanding contributions to coastal zone protection.

Any unit or individual has the right to report violations of laws and regulations on coastal zone protection. The report acceptance department shall handle it according to law or hand it over to the competent department for handling, and timely feedback the processing results. Chapter II Protection Planning Article 10 The municipal administrative department of urban and rural planning shall, jointly with the departments of development and reform, land and resources, housing and urban and rural construction, water conservancy, forestry, ocean and fishery, environmental protection, maritime affairs, port and shipping, and other district (county-level city) people's governments, organize the preparation of a unified special plan for coastal zone protection in the whole city, and determine the scope of coastal zone protection, classified protection system and control requirements.

The special planning of coastal zone protection is the basic basis of coastal zone protection, and all kinds of protection, utilization and management activities should meet the planning requirements. Article 11 The preparation of special planning for coastal zone protection shall follow the red line of ecological protection, conform to the overall urban planning, overall land use planning, planning of marine main functional areas and marine functional zoning, and be connected with special planning such as environmental protection planning, tourism planning and port planning. Article 12 The special plan for coastal zone protection shall, according to the requirements of coastal natural environment protection and coastal economic and social development, divide the coastal zone into strict protection zones, restricted development zones and optimized utilization zones, and formulate protection objectives and control measures respectively. Thirteenth the following areas should be designated as strictly protected areas:

(1) quality beaches;

(2) Typical geological landscape;

(3) The core scenic spots of the seaside scenic spots;

(4) Important coastal wetlands, migratory bird habitats and wintering sites;

(5) Nature reserves and special marine reserves;

(6) Coastal shelterbelt;

(seven) the scope of protection of the islands at the base of the territorial sea;

(eight) other natural forms remain intact, and the ecological function and resource value are remarkable.
