How many years was the former president of Quanzhou Branch of CITIC Bank sentenced to bribery in the first instance?
On 20 18 65438+ 10/0/9, Fujian Nan 'an City Court pronounced the case in the first instance: Li Yaodong was found guilty of accepting bribes, sentenced to fixed-term imprisonment of 10 years and fined 1 10,000 yuan.
Li Yaodong refused to accept the judgment of the first instance and has filed an appeal.
Accused of accepting bribes of 3.4 million, after four court sessions.
Li Yaodong's case originated from the bribery clue provided by Qiu Huizu, a Fujian businessman who was questioned by the procuratorate. After Qiu was arrested, many responsible persons of Quanzhou banking system were controlled for allegedly accepting bribes, and Li Yaodong was one of them.
Li Yaodong's case went through the preliminary hearing in June 20 1 16, and went through four sessions from September 20 17 to June 20 18.
At the first trial, the prosecution accused Li Yaodong of illegally accepting bribes of more than 3.4 million yuan by taking advantage of his position. The public prosecution agency believes that the confessions of the briber and the defendant are stable and can confirm each other, which is enough to prove Li Yaodong's criminal facts.
Li Yaodong only admitted that during the period of 20 14, he received 10 yuan cash, 5 wine cards and10,000 shopping cards respectively.
Li Yaodong said that when Qingdao held a customer forum in the autumn of 2065.438+04, the owner of Fujian Food Co., Ltd. Xu put 65438+ 10,000 yuan in cash in the hotel room in the name of activity fee. Before the Spring Festival of 20 14, Wang Rong, the boss of Inner and Outer Mining (Fujian) Co., Ltd., laid out five wine cards and a shopping card of 1 10,000 yuan in his office.
Regarding the other allegations of the prosecution, Li Yaodong said that they were not true, saying that the guilty confession was made under the coercion of investigators, and asked for the audio and video recordings during the investigation.
The presiding judge said that he had sent a letter to the procuratorate to collect the audio-visual evidence materials, but the procuratorate did not hand them over.
The prosecutor believes that the evidence in this case is clear and there is no need to retrieve audio and video recordings.
Li Yaodong's defense lawyers, Wang Shihua and Wang Zhenyu, defended Li Yaodong's innocence, arguing that the evidence in this case was verbal, unstable and inconsistent, and could not be used as the basis for deciding the case.
He was sentenced to fixed-term imprisonment at first instance 10 years, and has appealed.
20 18, 18, Fujian Nanan city court made a first-instance judgment on Li Yaodong's bribery case, and found him guilty of bribery, with a huge amount. He was sentenced to fixed-term imprisonment of 10 year and fined 1 10,000 yuan.
In the judgment, the court held that the four guilty confessions made by Li Yaodong before the trial were basically stable (the fourth and fifth confessions were made in Nan 'an Detention Center), which confirmed each other with the testimony evidence of the briber. Li Yaodong's defense in the trial and the lawyer's defense opinions were not accepted.
The prosecution accused Li Yaodong of criminal facts 10, and the court found 8 of them.
The public prosecutor accused Li Yaodong of accepting bribes from Wang and others at the entrance of a hotel in Hong Kong during the period of 2065.438+04, totaling HK$ 65,438+10,000. According to the exit records, Li Yaodong left Hong Kong from 201319 to 2 1, and there was no record of leaving Hong Kong on 20 14.
In this regard, the court held that the relevant evidence could not confirm each other on the important plot of the time when the bribery took place, and Li Yaodong denied both charges in the trial. Therefore, the public prosecution agency accused two facts of insufficient evidence and refused to recognize them.
The court ruled that Li Yaodong's biggest bribe of 2 million yuan came from Qiu Huizu, the boss of Xiamen Jiahua Import and Export Trading Company. Previously, Qiu Huizu was found guilty of accepting bribes by the court of first instance and sentenced to fixed-term imprisonment of 10 years. After Qiu appealed, Quanzhou Intermediate People's Court sent the case back for retrial on February 29th, 2007 on the grounds of unclear facts and insufficient evidence.
Li Yaodong refused to accept the verdict, arguing that the first trial only found bribery based on testimony, the evidence was insufficient, and the procedure was illegal. He has appealed.
