Chapter I General Provisions Article 1 In order to strengthen the leadership over the work of production safety, implement the responsibility of the people's governments at all levels in the city and their relevant departments for the supervision and administration of production safety, effectively curb all kinds of production safety accidents and ensure the safety of people's lives and property, According to the Law of People's Republic of China (PRC) on Work Safety (DecreeNo. 13 of the President of the People's Republic of China), Regulations on Reporting, Investigation and Handling of Work Safety Accidents (Decree No.493 of the State Council), Provisions on Administrative Responsibility for Work Safety in Ningxia Hui Autonomous Region (Decree No.70 of the People's Government of Ningxia Hui Autonomous Region), Regulations on Work Safety in Ningxia Hui Autonomous Region and other laws and regulations, And according to the "Regulations of Yinchuan Municipality on the Supervision and Administration of Work Safety" (Yin [201]155), combined with the actual situation of our city, these Provisions are formulated. Article 2 These Provisions shall apply to the acts of people's governments at all levels in Yinchuan City, the safety production supervision and management departments of people's governments at or above the county level, and the safety production supervision and management departments in related industries (hereinafter referred to as the departments responsible for safety production supervision and management) that fail to perform their duties of safety production supervision and management, and investigate the administrative responsibilities of the relevant responsible persons. Article 3 People's governments at all levels and departments responsible for the supervision and administration of production safety shall undertake the supervision and administration of production safety in their respective administrative regions and departments in accordance with the principle of combining territorial management with graded responsibility and combining comprehensive supervision with industry supervision. Article 4 The supervision and management of production safety shall implement the system of "one post and two responsibilities". People's governments at all levels should establish and improve the responsibility system of "one post and two responsibilities", and the main person in charge of governments at all levels is the first responsible person for the supervision and management of production safety, and concurrently serves as the director of the safety Committee, fully assuming the leadership responsibility for production safety; The person in charge of production safety bears direct leadership responsibility for production safety; Other members of the government team implement the system of "one post and two responsibilities" and take the leadership responsibility for safety production within their respective responsibilities. Article 5 The supervision and management of production safety must implement the principle that industries, enterprises and production and operation must manage safety.

Departments responsible for the supervision and management of production safety at all levels are responsible for the supervision and management of production safety in industries and fields, and the main person in charge of the department is the first person responsible for the supervision and management of production safety, who serves as the director of the production safety Committee of the department and fully assumes the leadership responsibility of production safety; The person in charge of production safety is the person directly responsible for the work of production safety; Other members of the team implement "one post and two responsibilities" and take the leadership responsibility for the safety production work within the scope of their duties. Article 6 The supervision and management of production safety shall be subject to "five-level full coverage", and cities, counties (cities), industrial parks, towns (streets) and administrative villages shall establish and improve production safety committees or work safety institutions, clarify their work responsibilities, report the performance of production safety to the governments (villagers' committees) at the same level every year, and coordinate the work of production safety; The Chief Executive is the director of the Safety Committee, who is fully responsible for the leadership of production safety, and the person in charge of production safety is directly responsible for the work of production safety; Other team members implement "one post and two responsibilities" and take leadership responsibility for safety production within their responsibilities. Chapter II Government Supervision and Management Duties and Division of Duties Article 7 The Work Safety Committee of Yinchuan Municipal People's Government (hereinafter referred to as the Municipal Safety Committee) shall carry out its work under the leadership of the Municipal People's Government and perform the following duties: formulate specific opinions and measures to implement the national, autonomous region and Yinchuan's work safety policies; Arrange, guide, coordinate, supervise and inspect the work of production safety within their respective administrative areas; Analyze the situation of safety production and study and solve major problems in safety production; Supervise and inspect the people's governments at lower levels and the relevant departments of the people's governments at the corresponding levels to implement the responsibilities of production safety; Decompose and issue annual assessment indicators for safety production control, formulate detailed rules for safety production assessment, guide the office of the Municipal Safety Committee to do a good job in safety production assessment, and put forward suggestions for rewards and punishments to the government at the same level.

The office of the Municipal Safety Committee is located in the Municipal Safety Supervision Bureau, responsible for the daily work of the Municipal Safety Committee, and supervising the member units of the Municipal Safety Committee to perform their duties of production safety; Conduct a separate assessment of the annual performance of the chief administrative officer in charge of the county (city) District People's government and the member units of the Municipal Safety Committee, and make suggestions to the Municipal People's Government for failing to perform their duties. Article 8 The people's governments of counties (cities) and districts shall perform the following duties of production safety supervision in accordance with laws and regulations:

(a) to strengthen the leadership of production safety, production safety work into the overall layout of national economic and social development in the region, formulate and organize the implementation of long-term development planning of production safety.

(two) to publicize and implement the laws, regulations and policies of the state on production safety, and to study and formulate major policies and measures on production safety.

(three) to organize, supervise and support the relevant departments to perform their duties of supervision and management of production safety according to law, implement the responsibility system for target management of production safety and the administrative accountability system, and coordinate and solve major problems in production safety work in a timely manner.

(four) to establish and supervise the implementation of the system of special funds for production safety, and incorporate it into the fiscal budget at the corresponding level, and increase the government's investment in production safety funds. According to the per capita standard of no less than 1 yuan in the jurisdiction, the annual administrative expenses for safety production shall be guaranteed, and the necessary administrative expenses such as safety supervision and law enforcement equipment, public safety facilities, emergency rescue equipment, accident hidden danger management, safety training, publicity and education, and strengthening the capacity building and basic work of grass-roots safety production supervision shall be ensured.

(five) responsible for organizing the investigation of illegal production, management, construction and other illegal acts.

(six) to organize the special rectification of production safety and the investigation and management of hidden dangers in key industries and fields, eliminate hidden dangers in time, and investigate and deal with production and business units that do not meet the conditions for safe production according to law.

(seven) establish and improve the county (city) district, industrial park, township (street), administrative village safety supervision and management institutions, clear full-time and part-time safety production personnel, establish and improve the safety supervision and law enforcement team.

(eight) to urge enterprises within the jurisdiction to implement the main responsibility of production safety, guide enterprises to complete the construction of production safety information system, and urge enterprises to implement self-inspection and self-reporting of hidden dangers.

(nine) the establishment of health and safety production emergency rescue command system, formulate and improve the emergency rescue plan for production safety accidents, organize emergency rescue drills regularly, and lead and organize emergency rescue work.

(ten) in accordance with the relevant provisions, responsible or authorized, entrusted with the qualification of law enforcement departments to organize accident investigation, make a reply to the investigation report, and urge the relevant departments to implement the handling opinions.

(1 1) Establish and improve the assessment and reward system for safety production, commend and reward units that have made remarkable achievements in safety production and individuals that have made outstanding contributions to safety production, and implement the "one-vote veto" system for units that have exceeded the control targets.

(twelve) to encourage and support the scientific and technological research of safety production and the popularization and application of advanced technology of safety production, strengthen the guidance of industrial policies, adjust and optimize the industrial structure, and gradually eliminate the production and business units that do not meet the industrial policies and safety production standards.

(13) Complete the Twelfth Five-Year Plan for Safety in Production, do a good job in the spatial development planning of safety in production and chemical parks in the Thirteenth Five-Year Plan area, and make a scientific layout to link up with the overall urban spatial planning.

(fourteen) to complete other safety production duties stipulated by laws and regulations and the people's government at a higher level.
