Article 2 The term "blacklist" as mentioned in these Measures refers to the recorded information that employers, social insurance service institutions and their related personnel, all kinds of insured persons and recipients violate the relevant laws, regulations and rules of social insurance.

Article 3 Ministry of Human Resources and Social Security is responsible for guiding and supervising the management of the "blacklist" of serious dishonesty in the field of social insurance throughout the country. Social insurance agencies shall establish social insurance credit records of employers, social insurance service institutions and their related personnel, all kinds of insured persons and treatment recipients, and be responsible for the publicity, inclusion and elimination of information submission and other management work of the "blacklist" of serious dishonesty in the social insurance field (hereinafter referred to as the "blacklist" of social security).

Article 4 The "blacklist" of social security shall be "whoever is included, who is managed and who is responsible", and shall follow the principles of compliance with laws, fairness, impartiality, objectivity, truth and dynamic management.

Fifth social insurance agencies at or above the county level (hereinafter referred to as agencies) shall include units or individuals in any of the following circumstances in the social security "blacklist":

(a) the employer fails to participate in social insurance as required and refuses to rectify;

(two) to participate in and declare social insurance by fraud, forgery of certification materials or other means to defraud social insurance benefits or social insurance fund expenditures;

(3) Illegal acquisition, sale or disguised sale of social insurance personal rights and interests data;

(four) the social insurance service institution violates the service agreement or the relevant provisions and refuses to rectify;

(5) The employer with repayment obligation, its legal representative or the third party refuses to repay the social insurance fund and has paid the industrial injury insurance benefits in advance;

(6) Other circumstances stipulated by laws and administrative regulations.

The administrative department of human resources and social insurance shall promptly transfer the relevant untrustworthy information to the social insurance agency at the same level for list publicity and data submission.
