What is maternity allowance?
Maternity allowance refers to the living expenses paid to professional women when they leave their jobs due to childbirth. Those who have participated in maternity insurance shall be paid by the maternity insurance fund according to the standard of the average monthly salary of employees in the previous year. Enjoy maternity allowance: female employees enjoy maternity leave when giving birth; Enjoy family planning operation leave; Other circumstances stipulated by laws and regulations.

(1) Female employees enjoy maternity leave allowance. Maternity leave refers to the rest time given to employees during childbirth as stipulated by national laws and regulations. Specifically, it refers to the holidays enjoyed by female employees before and after childbirth. The main function of maternity leave is to enable female workers to have a proper rest during childbirth, gradually recover their physical strength, and the baby can be carefully cared for and nursed by the mother. Before the 1980s, China set the holiday for pregnancy, childbirth and postnatal care for babies at 56 days. 1988 promulgated the Provisions on Labor Protection of Female Workers, which greatly revised the original provisions. At present, the legal normal maternity leave is 90 days, including prenatal leave 15 days and postpartum leave of 75 days. In case of dystocia, maternity leave shall be increased 15 days. For multiple births, the maternity leave will be increased by 15 days for each additional baby. Maternity leave for abortion is divided into four months. If the abortion is less than four months, maternity leave of 15-30 days shall be granted according to the certificate of the medical department; The maternity leave for abortion for more than 4 months is 42 days. Many areas have also adopted the policy of rewarding employees who marry late and have children late, and the holiday has been extended to 180 days.
(two) enjoy the family planning operation leave allowance.
Citizens who perform family planning operations and enjoy the holidays prescribed by the state shall be implemented in accordance with the relevant provisions of the Notice of the Ministry of Health of the People's Republic of China and the State Family Planning Commission on Forwarding the Routine of Birth Control Operations and the Notice of the Ministry of Labor on Several Issues Concerning the Maternity Treatment of Female Workers, as follows:
1, IUD and subcutaneous drug implantation were placed and rested for 2 days after operation. Do heavy physical labor, do not do heavy physical labor within one week after operation;
2. Take the IUD and rest 1 day;
3, vasectomy, rest for 7 days;
4. Simple tubal ligation and rest for 2 1 day;
5, postpartum tubal ligation, according to maternity leave plus 14 days;
6, induced abortion, pregnancy less than 3 months rest for 20 days, more than 3 months less than 4 months rest for 30 days, more than 4 months rest for 42 days. If induced abortion and tubal ligation are carried out at the same time, the two vacations will be counted together. The above holidays, in case of special circumstances, are decided by the doctor.
(3) Other allowances as prescribed by laws and regulations.
This is an all-encompassing clause. Because there are corresponding regulations on maternity insurance in various places, the scope of allowances is not the same, and the above two items cannot be completely included. If some areas allow female workers to give male workers a certain holiday after giving birth to take care of their wives after giving birth, holiday wages will be paid as usual. In order to make the provisions of maternity allowance more scientific and reasonable, and fully consider the actual situation of current economic and social development and the actual interests of the masses, this law stipulates other circumstances stipulated by laws and regulations.
